Perez, Senior Planner Division: Planning Date: June 17, 2015 Subject: SUB 201500095 TMP 39 — 6 & 7 — BLA The County of Albemarle Planning Division will grant or recommend approval of the Subdivision Plat referenced above once the following comments have been addressed: [Each comment is preceded by the applicable reference, which is to the Subdivision/Zoning Ordinances unless otherwise specified.] [Comment] The property boundaries depicted on the survey do not match that of the County GIS or previous plats. Specifically Map Ref 10 (TMP 39 -7 — Portion B) which is depicted on the plat as an abutting property; however, County records have this parcel as being part of the larger TMP 39 -7 and never having been subdivided. Revise the plat to show it as part of the larger portion of 39 -7. If the applicant contends that this portion is its own lot of record then a Parcel Determination will be required prior to plat approval. Please provide documentation of when this portion was subdivided off to be its own parcel of record. 2. [14- 302(A)] Vicinity map. The plat currently depicts a 1 inch = 3,000 feet scaled vicinity map; however, the County ordinance requires the vicinity map to be at a scale of 1 inch = 2,000 feet. Revise. 3. [14- 302(A)] Also, within the vicinity map a portion of TMP 39 Parcel 7 is labeled as "Tract 2 ", this is the same portion as mentioned in comment #1. Please omit this language from the vicinity map. Revise. 4. [14- 302(A)(10)] Right of further division of proposed lots. Planning staff has conducted research on the property and find that parcel 6 was in existence in 1979 in its current form and has remained unchanged since then, thus it was assigned 4 theoretical development rights at that time based on the acreage of the parcel. Also, Parcel 7 seems to also have been in existence in 1979 and has remained unchanged since then, thus it was assigned 5 theoretical development rights at that time based on the acreage. Does parcel 7 intend to transfer any developments rights to parcel 6 with this BLA? If not, on the plat revise note #6 for development rights: "Parcel 6, Tax Map 39 is assigned 4 development rights and may be further divided. The residue of Tax Map 39 Parcel 7 is retaining 5 development rights and may be further divided. " 5. [14- 302(B)10] Stream buffers. County GIS depicts a stream on the Western portion of TMP 39- 7. On the plat depict the stream and the required 100' stream buffer on each side of the stream/feature. Also, provide the required note: "The stream buffer(s) shown hereon shall be managed in accordance with the Albemarle County Water Protection Ordinance. " Revise appropriately. 6. [14- 302(B)(1)] General Information. When the plat is revised, please provide the date of the last revision on the plat. 7. [Recommendation] Most of Planning's comments can be averted by revising the plat to only depict the Boundary Line Adjustment taking place on the plat and not depicting the entire 262.608 Acres of Parcel 7. The Code is kept up to date by the County Attorney's office. The Code may found on the County Attorney's website which may be found under "Departments and Services" at Albemarle.org. In accord with the provisions of Section 14- 229(B) of Chapter 14 of the Code if the developer fails to submit a revised final plat to address all of the requirements within six (6) months after the date of this letter the application shall be deemed to have been voluntarily withdrawn by the developer.
