Perez, Senior Planner Current Development December 17, 2014 SUB201400191— Donald Richardson - Family Division Fax 434 - 972 -4126 The County of Albemarle Division of Current Development will grant or recommend approval of the Family Subdivision plat referenced above once the following comments have been addressed: [Each comment is preceded by the applicable reference, which is to the Subdivision/Zoning Ordinances unless otherwise specified.] [14 -106] Private Streets. The existing 50' restricted right of way (DB 525 -146) does not meet the definition of a private street per section 14 -1061. Thus the "New 50' Private Street Easement" does not provide the required frontage to divide the lot. In order to move forward with the division, the existing 50' restricted right of way would need to be modified to become a private road approved by the County. A potential option to do this would be on this Family Subdivision plat to place a New Private Street Easement over the restricted right of way and have the owners of the land whose property it crosses also sign the plat to modify the road designation. It appears that the only parcel/property owners affected by this modification would be TMP 27 -39 (Donald and Sheila Richardson). Revise plat appropriately. 2. [14 -106] Private Streets. Also, it appears that the "Existing Entrance Road and 20' Right -of -way" was previously designated as a Private Street by virtue of the Family Subdivision plat of TMP 02700 - 00- 00 -039BO dated October 3, 2000 and approved on November 17, 2000. That plat relied on that road for it's frontage. To make this clear for the current family division being proposed and future divisions please put the Deed Book Page Number of the Family Division of TMP 02700-00-00 - 039B0 approved on Nov 17, 2000 under the road label along with the other DB Ref #s (DB279PG574), and label that road as a "Private Street ". 3. [14 -212] Affidavit. The County has received the required affidavit from the applicant. This document will be provided to the County Attorney for his review once the applicant submits the restrictive covenant mentioned in the following comment which must also be sent to the County Attorney for review /approval. 1 Street, private. The term "private street" means any street or other way or means of vehicular access approved as a "private street" pursuant to sections 14 -232 through 14 -235 or as a "private road" under any prior ordinance regulating the subdivision of land, that is not designed, constructed, bonded or approved to be maintained by the Virginia Department of Transportation as part of the secondary system of state highways, regardless of ownership. Any street identified on a recorded plat as a restricted road, access road or other designation which was not approved by the county as a private street or a private road as described herein is not a private street. 4. [14- 212(B)] Family subdivisions; conditions of approval. The subdivider shall place a restrictive covenant on the lots created by the family subdivision prohibiting the transfer of the lots so created to a person who is not a member of the immediate family for the retention period after the date of recordation. A template for this covenant is attached. Please submit a draft of the restrictive covenant to me, and I will review them and forward them to the County Attorney for his review/ approval. [14- 412(A)4] Streets serving family subdivisions. Each private street authorized to serve a family subdivision under section 14- 232(B)(1) shall satisfy the following: ... (ii) the surveyor shall include the following wording on the plat: "The existing and /or proposed right -of -way is of adequate width and horizontal and vertical alignment to accommodate a travelway passable by ordinary passenger vehicles in all but temporary extreme weather conditions, together with area adequate for maintenance of the travelway, as required by section 14 -412 of the Albemarle County Code. " Revise plat to include the above note. 6. [Comment] There appears to be a perpetuating typographical error in the recorded documents for TMP 27 -41, staff suggests this error be corrected with this plat. This plat lists DB 4053 PG 264 as the last recorded document for TMP 27 -41 and lists DB 403 PG 731 as the originating document for TMP 27 -41; however, staff has pulled these documents and notice that DB 4053 PG 264 references DB 403 PG 731. When staff sought DB 403 PG 731 we were unable to locate it. The reason being that DB 4053 PG 264 incorrectly listed DB 403 PG 731 as the plat ... that was the typographical error. The true document was recorded as DB 403 PG 71 and the plat can be found at DB 403 PG 73. Staff suggests it be corrected with this plat. 7. [14 -312] The subdivider shall submit with the final plat a survey showing the location of all existing buildings on the land to be subdivided within fifty (50) feet of a proposed lot line or a proposed street. Are there any existing buildings within 50' of the proposed property lines? If so, provide the required information, if not please provide that in the response letter. Revise appropriately. 8. [18 -10, 14- 302(B)8] It is suggested that the setbacks note on sheet 1 be clarified to state: "Front (internal public or private road) 25 foot" 9. [14- 303(S)] Control Points. Provide at least 4 control points, evenly distributed across the property and located at survey property corners. At the option of the subdivider, the control points may be shown on a copy of the final plat, rather than the original signed/notarized version for recordation. Revise. 10. [14- 302(B)(1)] General Information. When the plat is revised, please provide the date of the last revision on the plat. 11. [14 -309 & 14 -310] Soil evaluations; Health Director Approval of wells and septic systems. Provide three copies of the results of percolation tests or other methods of soil evaluation used to determine the suitability of the soil for septic systems with conventional drain fields for review and approval by the Health Department. The above requirement is for both Lot B and the Residue (Lot Q. Currently the Soil work for the proposed Lot B is all that was provided with the application; this documentation has been forwarded onto the Health Department for review along with a request for the Health Department to search their files to assure that the residue has an existing primary and reserve onsite. If the Health Department is unable to determine if Lot C has previously approved primary and reserve onsite you will be requested to provide Soil Work or previous Health Department approval for the existing home on Lot C. Approval by the HD is required before the plat can be approved. Soil work was sent to the HD on 12- 15 -14.
