believe there is anything in the way of the subdivision agent approving the plat for lot 1 and the

I hope your day finds you well.
A little history note, we have been involved with Mountain Valley from the birth and our research files, county corn
an agreement even in its draft form exist unit now. I think we have all been evenly taken back that the agreement wz
Well as this review process has developed our thoughts were simply record the plat that creates the Open Space and
existing HOA as "Association Property" with the maintenance intent as it is noted on the plat. Then immediately fol
President/Vice President of the HOA. The County's control point to insure compliance would be no building permi
recorded. A simple letter on County letter head stating that would govern.
I'm not for sure if Glenn's intent here is for the Agreement to be signed by the individual Lot owners or what as this
around the County. This community shares access and maintenance to all "Association Property" as noted in the Co
parcels are even an issue and in this case has been a delay.

If the issue is that "Landowner" the agreement needs to be revised to say Mountain ntain Valley Association, Inc., whi
quite sure we can make this happen rather quickly and smoothly.

for this project. I have spent lots of hours researching for this stormwater agreement and I have not found it in our
office or at the clerk's office. If Justin is not able to provide additional information, I will contact our contact

The first one is the SWMA. They had signed this before I was able to give them the Engineering File
number. I had no idea they were signing it at this point. We will add the number to it before final

and WPO for the plan.
Subdivision Plan would be Mountain Valley as far as I know. I don't have the actual Engineering Plans to be
able to quote the exact title and the WPO number I have no idea unless we are talking about either
SUB20010293 or SUB2003140.

Ana reviewed the SWM files and was not able to locate a copy of the maintenance agreement. Notably these
SWM facilities still have bonds on them.
It needs to be determined if the SWM facilities have a maintenance agreement on them or not. If not, such an
agreement will need to be made/recorded prior to approval of this plat. The agreement will need to be entered
into between the current owner of the open space lot and the County.
Please continue your research and provide the recorded documents once (if) you find them.

I don't see where an agreement has been recorded for either times the SWM easements were created.
One easement was created back in the beginning stages of Mosby Mountain when an easement (D.B. 2667,
Pg. 681) was created over on the adjacent land on what would become Mt Valley to benefit Mosby. And then
when we came back and actually platted the Mt. Valley subdivision additional easements were created within
that same area.
We are looking more into it to see if we are overlooking it somehow. ok
Please let me know if Ana comes up with anything. We will wait to discuss with their attorney until we hear
from you.

Rob,
I have discussed the project with the County Attorney and I offer the following:
The Stormwater Management facilities located in the open space lot are existing and depicted on the original
subdivision plat(SUB2003-140) which was approved by the County on December 22, 2005. As such the
SWM maintenance agreement for this subdivision should have been approved by the County and should have
been recorded by the applicant. Please provide me a copy of the recorded SWM agreement or the correct DB
page ref number for me to pull this document. (Please note, I've also asked Ana Kilmer to look through her
files to see if she has a copy of the recorded document). If the agreement was recorded then a new agreement
will not be needed unless the facilities are being changed in some way.
Aside from the above, all other platting comments have been addressed with the revised plat.

It has been pointed out to us that within the Covenants and Restrictions on Page 16 (Paragraph "L") it
discusses Sign and Landscape maintenance. Does this address your comment number 5 or do the Covenants
and Restrictions need to be revised to better address this. The client also asked is there a note that can be
crafted to be put on the plat to state that the Developer/Owner will maintain the open space until at a later date
when it will be turned over to the HOA?

I have the surveyor, Rob Cummings, asking the County to provide history research assistance for his project
(see the email below). This should be fairly quick for you being you did all that history research during your
initial review. Essentially the applicant is going to develop and set to record a NEW maintenance agreement
for the existing SWM facilities as it currently appears that there was never one for these facilities before;
however, the surveyor needs to know the description/title of the WPO/and WPO number which was
approved back in the day for the original Mountain Valley subdivision. He needs this for the legal
documents.
Please track down this information for him and cc me to your response.

Chris,
I don't see where an agreement has been recorded for either times the SWM easements were created.
One easement was created back in the beginning stages of Mosby Mountain when an easement (D.B. 2667, Pg.
681) was created over on the adjacent land on what would become Mt Valley to benefit Mosby. And then when
we came back and actually platted the Mt. Valley subdivision additional easements were created within that
same area.
We are looking more into it to see if we are overlooking it somehow. ok
Please let me know if Ana comes up with anything. We will wait to discuss with their attorney until we hear
from you.

I have discussed the project with the County Attorney and I offer the following:

The Stormwater Management facilities located in the open space lot are existing and depicted on the original
subdivision plat(SUB2003-140) which was approved by the County on December 22, 2005. As such the SWM
maintenance agreement for this subdivision should have been approved by the County and should have been
recorded by the applicant. Please provide me a copy of the recorded SWM agreement or the correct DB page
ref number for me to pull this document. (Please note, I've also asked Ana Kilmer to look through her files to
see if she has a copy of the recorded document). If the agreement was recorded then a new agreement will not
be needed unless the facilities are being changed in some way.
Aside from the above, all other platting comments have been addressed with the revised plat.

crafted to be put on the plat to state that the Developer/Owner will maintain the open space until at a later date
when it will be turned over to the HOA?

kept up to date by the County Attorney's office. The Code may found on the County Attorney's website which

In accord with the provisions of Section 14-229(B) of Chapter 14 of the Code if the developer fails to submit a
