This is the proposed revision to the Belvedere easement abandonment plat. If this is
acceptable to everyone, we will plot new mylars and call David for pick-up in the
morning.

David,
The mylars are here and ready for signature. The owner needs to sign the mylars
before the County will sign them. We have a notary here, Wanda Wright, so I am
copying her on this email in the event that you need to set up a time with her to sign
the plats.

We are trying to get our Title Company to accept the fact that we have submitted a plat and there should be no reason
that we cannot close our loan without this process fully complete. They are hedging on this and our attorney has asked
that we at lease get comments from the other reviewing parties. Do you know if reviewers have been assigned at ACSA
and Engineering and have they provided any idea when they expect to review the plat and provide comments.

Ellie,
We had initially had our attorney prepare a draft Deed of Vacation of County Easements that I sent to Mark Graham on
April 14th. Mark had later replied that the County would be treating this as amending the previously approved plat
therefore we were under the impression that a Declaration of Vacation would not be required.
Both emails are attached. I've also gone ahead and attached the draft Deed of Vacation of County Easements to this
email as a separate document.
Please let me know if this Deed of Vacation will still be required and I'll have my attorney review it against the examples
and submit to Greg Kamptner.

I haven't reviewed the easement plat yet(hope to later this week) but it occurred to me that vacating these easements
will require a Declaration of Vacation to be submitted and reviewed by the County Attorney's Office. This generally

In response to Jack's question:
1. Board action is not required if the easements(public or private)were created as part of a subdivision plat.Those
portions of the plat can be vacated and the procedure is laid out in the Subdivision Ordinance and VC 15.2-2271
and 15.2-2272.The subdivision agent can approve the document vacating a portion of the plat after I have
approved it as to form.A couple of samples are attached.
2. If the easements were not created as part of a subdivision plat and are public easements held by the County,
Board action to release the easements will be required.
3. If the easements were not created as part of a subdivision plat and are private easements,the Reserve can seek
written releases from the easement holder.
