SPECIAL USE PERMIT APPLICATION (1-64 West Site) 360° Communications Company of Charlottesville d/b/a ALLTEL Communications, Inc. (the "Applicant") is complying with the Albemarle County draft guidelines for communications towers under protest. The Applicant's facility will not be as effective in sending and receiving quality communications because the height of the antennas will not sufficiently clear surrounding trees. Furthermore, because of the facility's compliance with the County's stringent guidelines, the Applicant must erect numerous additional towers nearby to provide adequate service within the coverage area. Therefore, this application is being submitted, along with other similar applications, to create a system intended to provide seamless wireless communications coverage along 1-64, west of Charlottesville. Construction of this and the other sites is necessary in order to provide seamless coverage to an area which could be covered by two 150' monopole towers. At least eight (8) tree top towers will be required to approximate the coverage of two (2) 150' monopoles. Thus the cost to comply with the County's guidelines will be four (4) times greater. The cost for the two monopole sites over a 25 year lease is approximately $1,800,000.00, and the cost to comply with the County's draft guidelines is $7,200,000.00, an increase of $5,400,000.00. This application proposes a communications facility located off Route 690 near Newtown, Tax map no. 53-6. The parcel is vacant,timber land, and is surrounded on all sides by vacant timber land. The facility will consist of: • a tapered monopole, 53.5' in height (equal in height to the adjacent CFW tower), painted brown, unlit, extendable by 15' in height for collocation; • three (3) panel antennas, painted brown to match the tower, flush mounted, plus collocation antennas; • two (2) equipment cabinets for ALLTEL, tan in color, each 66" high, 56"wide and 34" deep, plus comparable cabinets for another wireless carrier; • an emergency generator; • a security fence, 8' high, green in color • landscaping The proposed facility will be immediately adjacent to the CFW facility recently approved by the Board of Supervisors. The total area of the parent parcel is 83.17 acres, and ALLTEL's lease area will be 1200 square feet. Because of the size of the parent parcel and the fact that another communications facility will already be located at the site, ALLTEL's proposed facility will not create any adverse impact on adjacent parcels or other surrounding areas. rare The proposed facility is in harmony with the purpose and intent of the RA district, as stated in the zoning ordinance. • Preservation of agricultural and forestal lands and activities Construction of the proposed facility will not affect any agricultural or forestal lands or activities, nor will it prevent any surrounding areas from being agriculturally developed. • Water supply protection The proposed facility will not require water utilities and will not otherwise affect the water supply. • Limited service delivery to the rural areas Once construction is complete, the proposed facility will not be occupied and will only require occasional visits for maintenance and inspection. • Conservation of natural, scenic and historic resources The proposed facility will not adversely affect any natural, scenic or historic resources. Construction of the facility will have minimal effect on a small area of currently vacant land, and the facility itself will not impact any natural scenic or historic resources. ALLTEL's proposed facility is also harmonious with the uses permitted in the district. Those permitted uses generally consist of buildings for home occupation or storage. The permitted uses also include other utilities such as electric, gas and oil, including poles, lines, transformers, pipes, meters and related facilities. The proposed communication facility would not adversely impact any residential dwellings in the area, but rather would provide improved wireless communications to those properties. The facility itself, because of the tapered monopole design and limited height will have no greater adverse impact than electrical poles which are allowed by right, or than the existing adjacent CFW tower. The proposed facility is governed by Section 5.1.12 of the Zoning Ordinance and is in compliance with its provisions as indicated below: a. The proposed facility will not endanger the health and safety of workers and/or residents in the community. The facility produces no health risks, and the tower is designed to withstand high winds. Furthermore, in the unlikely event tower failure occurred, the monopole is designed to collapse into itself, and there are no occupied structures within the fall zone of the tower. The entire facility will be enclosed by an 8' security fence, thereby eliminating any potential dangers to trespassers. In addition, the proposed facility will not impair or prove detrimental to neighboring properties or the development of those properties. Because of the size of the underlying parcel, few neighboring parcels are within close proximity to the proposed facility. No adjacent properties will be adversely affected, and no restrictions will be placed on the development of those properties as a result of the existence ALLTEL's 2 New facility. b. The facility will include two equipment cabinets, an RF cabinet and a power cabinet, each 66"x 56"x 34" and tan in color. The facility will be enclosed by an 8' security fence to protect the public welfare. Landscaping will not be necessary because the existing timber land sufficiently shields the proposed facility from view. Erosion control will be provided for where necessary and all disturbed earth outside the lease area will be reseeded. c. In the event the facility becomes abandoned, damaged or is otherwise in a state of disrepair, ALLTEL will repair, replace or remove the relevant part of the facility. d. Because of its proximity to the existing CFW facility, ALLTEL's facility will not require an additional right-of-way easement over the subject parcel.
