Review/discuss any project specific plan review comment items needed with next plan submission Presentation: The last revised preliminary plat (rev. date 01-16-2013) was referenced. Steve gave a brief history of the project calling specific attention to Proffer 2, clearly labeled "Final Grading Plan". The plan, which was last submitted, includes the information requirements to meet items A-I as listed in Proffer 2. Steve Driver then suggested resubmitting the plan, for review and approval, relabeled as "Proffer 2 Final Grading Plan"to be reviewed specifically for Proffer 2 requirements as listed in items A-I. Thus the "Final Grading Plan" meeting Proffer 2 requirements could be approved and then resubmit the Preliminary Plat for review and approval. Discussion: Megan stated: The County does not have a process for submitting a "Final Grading Plan" by itself. The county process includes the grading plan as part of the WPO. Will need to defer to Glenn Brooks. David briefly reviewed the proffer to see if there was any wording to allow for the interpretation of Glenn Brooks. Megan agreed that the proffer was vague and could have been worded more clearly. Steve pointed out that Proffer 2 was brought about because the developer sold lots in previous phases to separate builders. After which the builders graded the lots out onto adjacent lots and created multiple issues (runoff, legal, etc.) The county approached the developer, the developer stated he did not create the problem it was the builders. Proffer 2 was brought about specifically to prevent this. David noted that for what its worth, the county staff report refers to the "Final Grading Plan" as an "Over Lot Grading Plan" David also stated that Steve has made a valid point but neither he or Megan can make the final decision. The final decision would be left up to the Zoning Administrator. Megan then asked: Now that the developer has met other proffer requirements and the preliminary plat can be submitted for approval, can the " final Grading Plan" be included with the Preliminary Plat to meet the conditions specifically in Proffer 2.„This is more of a what-if statement; decision will need to be made by Zo d i� n istrat ed County Engineer if the process is acceptable. ii Steve stated this is the process we have had in mind.Megan pointed out the County has a new subdivision ordina and s4 , slope code with specific requirements which we will need to meet. A copy of the new subdivision plat application was provided by Megan. k d Question was asked: What are the new critical slope requirements? Bill Fritz was brought in to better explain the new requirements. The code in provided in Section 30 Overlay Districts of the County Zoning Ordinance. Bill provided a brief summary of the requirements and stated we should not have any problems meeting said requirements. Steve asked if the proffers supersede the new steep slope requi ments. Bill responded No, because there were not any proff ° -elk s r teep sloes. .
