[18- 6.4(D)2] Boundary line adjustment between a nonconforming lot and a conforming lot. One or more boundary lines between a nonconforming lot and a conforming lot may be adjusted provided: 1. The boundary line adjustment does not make the conforming lot nonconforming or the nonconforming lot more nonconforming; and 2. If the lots are in the rural areas zoning district, the boundary line adjustment does not result in an increase in the number of lots or dwelling, units that could otherwise be established on each lot. It appears that Francis MacCall, Principle Planner with Albemarle County has spoken with you about the proposal and the relinquishment of the original development right associated with TMP 119 -22A and the utilization of one of the five development rights from TMP 119 -22 to facilitate the BLA. In order to track the development rights appropriately replace notes #7 & #8 on the plat with the following note: "Parcel 22A Tax Map 119 is assigned I development right from Parcel 22 and may not be further divided. Parcel 22 Tax Map 119 is retaining 4 development rights and may be further divided. " Rev 1. Comment Addressed 2. [14- 303(C)] County GIS depicts a noncontiguous portion of Tax Map 119 Parcel 56 along the Southern parcel boundary shared with Tax Map 119 Parcel 17A and Tax Map 119 Parcel 22 (see attached GIS depiction). Also, attached I am providing a recorded plat by Roger Ray circa 2008, which depicts such a residue parcel (see sheet 3 of the PDF). Please revise the plat to depict this parcel and all applicable information for it. Rev 1. Comment not adequately addressed. Please provide a recorded plat which depicts the portion of TMP 119 -56 in question in the location you have suggested. Rev I research: Roger Ray 2009 plat in DB 3838 -354, depicts the non - continuous portion of the parcel I've been talking about as "Parcel W" and having been depicted as an error, and has incorrect property lines. The plat insists the new boundary between 22 and 17A the road Deanna Lane. Comment adequately addressed. 3. [14- 303(D)] Lot acreages. To avoid confusion, on the plat combine the two labels "Parcel 119- 22_122.322 Acres" and "Revised Parcel l 19- 22_112 009 Acres by c ^1rulation ". Rev 1. Comment Addressed. 4. [14- 303(D)j Lot acreages. On the plat clearly list how much acreage is contained in the original Parcel 22A, currently it is not clear. Also, on the plat utilize land hooks to depict the portions of TMP 119 -22A that are being added to TMP 119 -22. Also depict where on the plat the 0.354 acres of TMP 119 -22A is located that is being added to TMP 119 -22. Revise appropriately. Rev 1. The plat has been revised in an attempt to clarify the acreages; however, it still is not clearly depicted. Currently the plat has two portions listed as: "Portion of 119 -22A being added to 119 -22 (0.354 Acres Total) ", one portion on the left and one on the right. This actually makes it appear like there are two segments of 119 -22A that are each 0.354 acres and each is being added to 119 -22. The area tabulations chart is the only item which helps provide clarity. The land hooks would be simpler and avoid confusion. I'll leaving this one up to your professional opinion on how to handle it (leave it as is, or revise w/ land hooks). 5. [14- 303(0)] Signature panel. On the plat provide a signature line for the Subdivision Agent. This signature line shall be provided immediately below the owner's signature /notary statement. Revise appropriately. Rev 1. Comment Addressed. 6. [14- 302(B)(1)] General Information. When the plat is revised, please provide the date of the last revision on the plat. Rev]. Comment Addressed. 7. [14 -309 & 14 -3101 Soil evaluations & Health director approval of septic systems. The submitted soils evaluations were forwarded to the Health Department, pending their approval. The plat cannot be approved until their approval is received. Rev 1. The County received Health Department approval on 7- 14 -15. Additional comment since revision 8. [14 -309 & 14 -3101 The plat has been revised to depict proposed drainfields which appear to slightly cross the proposed southern property line of the revised TMP 119 -22A. This is not permitted, rather the drainfields are to be located entirely on the lot created. Either revise the drainfield depiction on the plat to go back to how it was originally shown on the initial plat or revise the proposed southern property line to encompass the entire drainfields. The end result of either action should be that the drainfields are to be located entirely on the lot created. Christopher P.
