I'm confused - they are not on the to be avoided list, but they also weren't on the list of signs to come down that VDOT
provided to the County. Does this mean their sign will be coming down?

It has come to our attention that Albemarle Square needs to move their sign at Rt. 29 in order to avoid an underground
utility. Can you confirm if this and any other business signs have been added to VDOT's list, so we can be aware of
whether or not they qualify for an extended temporary sign?

Good afternoon. As I discussed with Mandy on Friday, we have received confirmation from LANE /Corman JV that they
will be able to avoid several additional signs and light poles that were previously marked to be removed as a result of
utility work for the US29 /Rio Road GSI. Our Right of Way attorney has been communicating this information to the
appropriate property owners.
The following fixtures can remain per LANE /Corman JV:
• D -915 (Fashion Square Mall light), D -701 (Fashion Square Mall sign) and D -900 (light for fashion square mall
sign) located at the Fashion Square mall entrance across from Brown's Body Shop & Virginia National Bank
• D -901 & D -902 (Wells Fargo Light poles) just south of Rio Road Shops
• D -905 and D -914 (Light Poles) at the old Pioneer bank property — northwest quadrant of the US29 /Rio Road
intersection
• D -706 — Titlemax /Gamestop sign at the southwest quadrant of the US29 /Rio Road intersection
This list does not include additional signs and light poles that were deemed by Centurylink to be out of their work area
and can remain in place along the West Rio Road segment for the Bristles and Photoworks properties (D -708, D -910, D-
911 and D -709).

eminent domain matters. I have sent notice letters to property owners identified above who have signs within the
utility right of way that have been acquired by VDOT through the certificate filing method of condemnation. These signs
are in the acquired right of way and must be removed by the landowner beginning in June and July, 2015 when
construction is scheduled to begin.

1 have informed these individuals that if they desire to remove the currently existing sign on the property, they must do
so by the deadline date indicated above. After that date, VDOT contractors relocating the utilities will remove and
dispose of the sign. If the landowner desires to remove the sign, this removal must be done at the landowners' cost.
I have also informed the landowners' representatives that regarding the future location of the permanent sign there
may be restrictions on placing the sign back in the existing easement acquisition area due to future access and
maintenance concerns by either VDOT or the utilities involved. Any permanent sign location in the utility acquisition
area will be contingent upon final utility location and permission granted by the utility owner. VDOT's design builders is
in the process of finalizing plans, which we should have in a week or two.
Finally, I have told landowners that they can contact Dave Covington, the regional VDOT manager of this project, to
directly discuss these issues, and he will coordinate meeting with the client or representative to discuss the issue. Mr.
Covington's email address is dave .covington @vdot.virginia.gov. I have also informed the landowner that the Albemarle
County Board of Supervisors is taking steps to lessen the impact of VDOTs project on their property by adopting a new
zoning text amendment, set on the Board's agenda for May 6, 2015. This zoning text amendment is designed to making
thing easier for Route 29 Design Solutions affected landowners, including waiver of certain otherwise required
formalities concerning the County's Architecture Review Board. I have informed the landowners that the contact person
for the County is Amelia McCulley, the County Zoning Administrator, and her email is amuccullev @albemarle.org. That
was the best information I had available prior to talking to you.
The reason for this email is to alert you that landowners may be contacting your office to seek your help. Please feel
free to contact Mr. Covington to coordinate efforts to satisfactorily achieve sign removal. If I can be of help, please let
me know. Will you forward me the name and email address of the person in your office who will be responsible for
making the decisions concerning temporary and permanent sign locations. I will forward this information on to the
affected landowners. � & ,;vk ->
In addition to the above described parcels, VDOT is currently handli in -house two additional parcels/ice nced
above: parcel 031, owned by Geoffrey D. Kilmer and Denise B. Kil er; and parcel 030, owned by Rio 0 sociates,
Inc. Because these matters being handled internally, I do not have the contact information forthese two landowners;
however, the deadline for the Kilmers to remove their sign is June 19, 2015 and the deadline for Rio Office Associates,
Inc. to remove its sign is also June 19, 2015.
