Jefferson Street Charlottesville, VA 22902 RE: North Fork Research Park, Town Center Building #2 SDP-2002-110 & SDP-2005-102 North Fork Research Park, Town Center Building #1 SDP-1999-115, SDP-2000-6 & SDP-2000-128 Dear Ms. George: This letter replaces the letter dated December 13, 2005. This includes reference to SDP-2002-110. You have requested an off-site shared parking arrangement to allow 65 of the spaces on the Building #1 site to serve Building #2. This requires modification of Section 4.12.5.a, which requires that parking be established on the same lot as the primary use except as authorized by Section 4.12.8. Town Center Building #1 was approved on October 6, 1999 as shown on SDP-1999- 115. Building #1, approved as a commercial office and containing 69,736 square feet, requires 279 parking spaces, based on 1 space per 200 square feet of net floor area. The plan indicated that 284 spaces were provided. This plan was amended by SDP- 2000-6 on May 11, 2000. The amended plan added 98 spaces to the site to provide a total of 381 parking spaces. As a result, Building #1 has a surplus of 102 spaces. North Fork Research Park, Town Center Building #2 was originally approved as a 70,000 square foot office building per SDP-2002-110. An amended plan, SDP-2005- 102, shows an office building that contains 83,665.7 square feet and requires 335 spaces. The plan shows that 270 spaces are provided on the site, a deficit of 65 spaces. We approve your proposal to allow 65 spaces on the Building #1 site to serve the Building #2 site. This is authorized under Section 4.12.8 (b) which permits a I:\DEPT\BCZS\Prkg Determ\UREF Buildings #1 & #2 corrected.doc Ammy George — December 15, 2005 Page 2 combination of parking alternatives, in this case shared parking (4.12.10) and off-site stand alone parking (4.12.11). As a result, Building #1 retains a surplus of 37 parking spaces. This approval is based on the fact that this arrangement provides the total number of spaces that are required for both buildings. We note that the site plan shows a 6-foot wide cross walk between the two sites. This determination assumes a general office use. Certain office uses, such as dental clinics and service industries that require more than 1 space per 200 square feet of net floor area are not approved under this determination. (Please check with us prior to finalizing leases with future tenants.) This arrangement may be amended in the future in the event that the Foundation elects to reallocate the parking in the Town Center District as the project builds out. Please be aware that an instrument assuring the continuation of this arrangement must be recorded in the event that the sites are ever held by separate owners. This determination also serves as a as a "Letter of Revision" to the latest approved site plan for Town Center Building #1, SDP-2000-6 Minor Site Plan amendment. A total of three (3) Letters of Revision are allowed before all subsequent changes to the plan are required to be submitted in the form of a minor site plan amendment. I assume it is a non issue because I assume that the Foundation owns and manages the parking both parks. It comes into play if the buildings were to be sold. John From: Fred M. What instrument are you referring to? I don't recall doing this on the Fontaine parking wavers...maybe we should have. Is this new? We anticipate owning these buildings for quite some time so maybe this is a non-issue in this specific case.
