HomeMy WebLinkAboutWPO201300032 Inspection 2015-05-07� IRGIISIP COUNTY OF ALBEMARLE Department of Community Development 401 McIntire Road Charlottesville, Virginia 22902 7 May 2015 Cascadia Development LLC 170 South Pantops Dr Charlottesville VA 22911 Hand delivered RE: WP0201300032 Cascadia NOTICE TO COMPLY Dear Sirs; Under section 17 -900 of the Albemarle County Code, this is your NOTICE TO COMPLY with the requirements of the Erosion and Sediment Control Plan for the referenced property and to immediately take corrective measures that address the following; The approved plan is taking far too long to implement, and the site is inadequately protected and does not meet code in the interim. The site began construction in January, with a permit issuance date of 1/7/2015. It is now 4 months later, and the basic sediment trapping measures shown on the plan have not been installed. 9VAC25- 850 -40 Minimum Standards number 4 requires sediment basins and traps, dikes, and other measures to be installed as a first step in any land disturbance, and they must be made functional before upslope land disturbance takes place. This is a clear and ongoing violation. While some leeway is tolerated for construction purposes on many jobs, this project has gone beyond any reasonable timeframe. 1) Sediment is being diverted to the existing pond, and it has not been fitted for sediment control. This needs to be converted, and the dam and outlet works cleaned up so they can be inspected completely. 2) Sediment Basin 2 was started late, it has not been installed, and excavation work has hit rock. This basin has proven too large to install in a reasonable amount of time, and the entire area draining to it should not have been disturbed. Provide an interim plan to implement. 3) Sediment Basin 4 has not been installed. There is a haul road to SB -2 in this location. Install the basin and reroute the haul road. 4) Sediment Basin 3 has been installed incorrectly. The side slopes are too steep, the riser crooked and too short, there is no base, the dewatering device is placed incorrectly, the Notice To Comply 7 May 2015 floor of the basin is incorrect, the barrel is too steep, the stream bank has been disturbed, and the outlet placed too low. The spillway is not dimensioned correctly, and fabric not placed correctly. There is nothing about this that follows the plan. Correct to follow plans or revise plans with the interim plan. 5) Sediment Trap 3 is installed incorrectly. Sides are too steep, dimensions are incorrect, spillway is incorrect, etc. The fill and pad placed upslope of the trap is not per plans and must be removed. Correct the trap to follow plans. 6) Two interim sediment basins /traps and stone weirs have been installed in place of SB -2 which are not adequate to contain the flow. These need to be engineered per code and redone with the interim plan. 7) The entrance wash rack is set up incorrectly, with a garden hose. The plan calls for a 1" tap and 1.5" hose. Install per plan. Provide an acceptable interim Erosion and Sediment Control Plan which meets code, with immediate corrective measures as stated above, and a schedule to implement the interim and overall plan. This must be provided within 7 days. Unless subsequently amended in writing by this office, it is expected all of these corrective measures will be completed by May 14th, 2015. If an acceptable plan and path forward cannot be found which meets state requirements, we must assume that the current plan was impossible to implement, at which point work needs to stop and the site needs to be stabilized until a plan can be approved which it is possible to implement in a reasonable amount of time. If corrective action is not taken as given above, your grading or other permits may be revoked, and you will be deemed in violation. Re- inspection of this notice to verify corrective measures will incur a $250 fee. Sincerely, Glenn Brooks, P.E.
