HomeMy WebLinkAboutSP201500023 Review Comments Special Use Permit 2015-07-28County of Albemarle Department of Community Development Memorandum To: Sarah Baldwin From: Bill Fritz Date: July 28, 2015 Subject: SP 2015-23 5" Street Station Ventures LLC I have reviewed the information submitted in support of this application. The purpose of my review was to evaluate the information submitted to determine if it provided design standards which could be used for future special use permits for drive-through windows or as the foundation of a zoning text amendment to eliminate the requirement for a special use permit. I will provide comments on each of the proposed conditions: Buffer The limit is that any drive-through that is within 30 feet of a residential zoning district will have buffering/screening. This should be clarified: - What is the drive-through? Is it the building, any window used for distribution of product/service or receipt of payment, stacking lanes, ordering station? The nature of the proposed buffer is at the discretion of the County. It could take the form of landscaping or screening. This could result in the construction of screening walls coupled with landscaping. Stacking — What is meant by a stacking lane being separated from "other site areas"? Is the intent that the stacking lane be physically separated from all other vehicle circulation areas? The current ordinance does not define the size of a stacking space. The applicants proposed conditions are clearer than the existing ordinance. However, the applicant should clarify where the stacking measurement begins. Does it begin at the centerline of the last window (if multiple windows are used), centerline of first window, ordering station or some other point? Is any stacking beyond the window proposed or may the window be located at the corner of the building so that the vehicle must enter a travelway directly? The applicant proposes to use ITE or other studies to support alternate stacking requirements. Who determines if a reduction is authorized and who could determine that an increase may be required? Circulation — The condition about traffic control devices is not necessary. This is already a requirement of the ordinance. Pedestrian crossing design should be specified. Is it limited to pavement markings and signage or could raised or alternative surface materials be required? The statement about designing to minimize conflicts is vague and without detail. Who determines that conflict has been minimized? Minimized to what level? General comments — It is my opinion that the applicants conditions lack specificity and should be clarified. It is possible that this may be done with design standards or by the submission of detailed plans for each proposed drive-through. The two locations shown on drive thru location exhibit do not appear to create concerns for the traffic of Bent Creek Parkway; however, more detail is needed to determine the impact of the drive thru locations. 2. The travel lane between the northern most drive thru and Brent Creek Parkway remains a concern. While no longer part of the drive thru lane, the proximity of this lane appears to not meet the minimum throat lengths of the entrance onto Bent Creek Parkway, it appears that vehicles will have difficulty in exiting this lane onto Bent Creek Parkway. We continue to recommend locating this lane further from Bent Creek Parkway. If you need additional information concerning this project, please do not hesitate to contact me at (434)422-9782.
