The owner or operator of the family day home shall provide a copy of the license to the zoning administrator. The owner or operator's failure to provide a copy of the license to the zoning administrator shall be deemed to be willful noncompliance with the provisions of this chapter. The owner or operator's failure to promptly admit the fire official onto the premises and into the dwelling unit to conduct an inspection in a manner authorized by law shall be deemed to be willful noncompliance with the provisions of this chapter. At least thirty (30) days prior to acting on the zoning clearance, the zoning administrator shall provide written notice of the application for a zoning clearance to the owner of each abutting lot under different ownership than the lot on which the proposed family day home would be located. The notice shall identify the proposed Itf family day home, its size and capacity, its location, and whether a special exception under subsection (see below) is requested. The notice shall invite the recipient to submit any comments before the zoning clearance is acted upon. The depth of a required rear yard shall be measured in such a manner that the yard is a strip of minimum depth required by district regulations with its inner edge parallel to its outer edge. If an alley abuts the rear yard, the required rear yard shall be measured from the edge of the alley right-of-way or easement. (§ 20-4.6.4, 12-10-80; § 1.8-4.6.4, Ord. 98-A(1), 8-5-98; Ord. 02-18(2), 2-6-02) 4.6.5 SIDE YARDS ON LOTS Side yards on lots are defined as running from the required front yard line to the required rear yard line. On corner lots, the required side yards shall run from the point where side yard lines intersect to required front yard lines. (§ 20-4.6.5, 12-80-80; § 18-4.6.5, Ord. 98-A(1), 8-5-98) 4.6.6 LOT ACCESS REQUIREMENTS Vehicular access on a lot shall be provided as follows: a. In all zoning districts, a structure requiring a permit under the Uniform Statewide Building Code may be established only on a lot having frontage on a public or private street as authorized by the subdivision ordinance, except that this requirement shall not apply to lots lacking such frontage on the effective date of this chapter. 0 In the rural areas zoning district, in addition to the requirements in subsection (a) and in order to provide public safety vehicles with safe and reasonable access to a new dwelling unit on a lot, each driveway that wil�ra��ve e-2 new dwelling unit: (1) shall not exceed a sixteen (16) percent grade; (2) shall have _that is at least ten (10) feet in width; (3) shall extend to within fifty (50) feet of each dwelling unit on the lot; and (4) shall include a rectangular zone superjacent to the driveway that is clear of all obstructions, including any structures and vegetation, that is at least ten (10) feet in width and fourteen (14) feet in height. The landowner shall demonstrate to the satisfaction of the county engineer that the driveway will meet the requirements of this subsection before a building permit is issued. C. Notwithstanding the requirements of subsection (b), the county engineer, with the recommendation of the fire marshal, may authorize a driveway having a grade that exceeds sixteen (16) percent if the landowner demonstrates to the satisfaction of the county engineer and the fire marshal that public safety vehicles would be able to access the dwelling unit even though the grade may exceed sixteen (16) percent. In considering a waiver request, the county engineer and the fire marshal shall consider: (1) the length of the segment of the driveway that would exceed sixteen (16) percent; (2) whether the segment that would exceed sixteen (16) percent would require the public safety vehicle to travel uphill towards the dwelling unit; (3) whether fire suppression equipment such as sprinklers would be installed within the dwelling unit; and (4) whether the dwelling unit is within fifty (50) feet of a public or private street. In authorizing such a grade, the county engineer may impose reasonable conditions to assure that the public safety vehicles may access the dwelling unit including, but not limited to, a condition limiting the maximum length any segment of the driveway may exceed sixteen (16) percent. The landowner may appeal the disapproval of a waiver under subsection (c), or the approval of a waiver with conditions objectionable to the landowner, to the commission. The appeal shall be in writing and be filed with the department of community development within ten (10) days after the date of the county engineer's and the fire marshal's decision. That would be up to 50 trips a day. Keep in mind that if they live there, that's 10 trips off the bat. Also, for 1 child driven separately — drop off in the morning, pick up in the afternoon — it is considered 4 trips, i.e. morning come to the house, 1 trip, leave the house after dropping of child, 1 trip, come to house in the afternoon, 1 trip, leave house after picking up child, 1 trip. (VDOT) Subject: RE: Sight Distance ---870 Carriage Trail Place That is correct, it is up to 24 round trips which was based on up to 12 children in care, assuming they all arrive separately. Usually the family day homes car pool or have siblings that arrive together. I can get some more information about her summer program as far as actually number of car trips and if she typically even goes up to 12. Summer months (June -Aug) is the only time period would go up to 12 children. The rest of the year, she has 5 or fewer, which doesn't require a clearance from the County. Our ordinance language is below for your reference. Please let me know if getting more data from the applicant would be helpful to you. Also, would a low volume commercial entrance be more appropriate in this case? We also have the ability to condition the clearance so that we can ensure vehicle trips can be reduced. The sight distance is ok as long as the trees are kept cut back along Keswick Road. I can't tell from the aerial view if the only access off of Carriage Trail Place is single family residences or not (looks like 3 of them). The trips for the day care was indicated as 24 round trips. We look at a car coming to the site then leaving as 2 trips. Does this mean that we are talking about 48 trips per VDOT definition? If so, the entrance would need to be improved to Moderate Volume Commercial Entrance standards. The larger issue is that the spacing to Route 250 would be inadequate under this situation and the entrance would either need to be moved or they would need a spacing exception. Troy Austin, P.E. (VDOT) Subject: Sight Distance ---870 Carriage Trail Place Troy, We have a zoning clearance for an existing family day home under review at 870 Carriage Trail Place (off Rt. 731 Keswick Road near Rt. 250E) and would like to confirm there is adequate site distance for the driveway. Family day home zoning regulations would allow up to an additional 24 round trips per day. Typically, there are 10 additional round trips to the site during the school year and then up to 24 in the summer when more children are in care. We may be asking them to widen the driveway near the entrance to achieve a 10' travelway. They will also need to know when they are doing that work if they need to remove any additional vegetation at the entrance to achieve sight distance.
