Dear Mr. Bowling;
Your development proposal on parcel 48 of tax map 73 has been reviewed. Your inquiry for exemptions
under the Water Protection Ordinance, County Code Chapter 17, has been considered. While the
proposed residence is not eligible for an exemption, a single family residence could be built within the
stream buffer according to County Code 17 -604, subsections A or F. Section T provides for a building
site where the buffer would not otherwise allow one on a lot which existed prior to the ordinance.
Section A allows a building site in the outer 50 feet of buffer where a reasonable alternative does not
exist. Both of these sections appear to be appropriate.
Section 17 -604 requires the submission of a mitigation plan. A mitigation plan would show the
expected clearing and grading for the house, driveway, sanitary system and yard area. Work in the
buffer should be minimized, and the sanitary system should be out of the buffer. Mitigation typically
consists of planting or restoration work at a 2:1 ratio to disturbed area in the buffer. In this case, a
stream crossing is involved, and this should follow the requirements of code section 17 -604C.
Your'inquiry concerning the Zoning Ordinance, County Code Chapter 18, sections 4.6.6(b) and (d), has
also been considered. Section 4.6.6(b) contains regulations concerning the driveway. You have not
provided enough information regarding the driveway to make a determination. The mitigation plan will
provide a more detailed look at the proposed stream crossing and driveway grading. If the designer is
not able to meet the grade and layout requirements for the driveway, alternatives can be allowed under
section 18- 4.6.6(c). Under section 4.6.6(d), I agree that disturbance of the critical slopes is necessary for
the establishment of the first single family residence.
