On behalf of the Zoning Administrator for Albemarle County, I hereby certify the following information: The Property is currently zoned Neighborhood Model Development ("NMD") All Adjacent properties are also zoned NMD. 2. The Property is part of a larger planned development (NMD) currently known as "Stonefield" and which was previously known as "Albemarle Place." 3. The Property is subject to the Entrance Corridor ("EC") and the Airport Impact Area ("AIA") overlay districts. 4. The uses that are permitted within the Project are regulated by the Code of Development for Albemarle Place entitled "ZMA Code of Development, Albemarle Place" as approved by the Board of Supervisors on October 22, 2003 as part of ZMA 2001-007, and was amended by the Board of Supervisors on August 4, 2010, as part of ZMA 2008-0003, and subsequently amended on March 14, 2012, as part of ZMA 2011-7. The most recent amendment ZMA2013-9 was approved November 13, 2013. Appendix A of the Code of Development lists the uses that are permitted within each block of the Project. The Property is located within block D of the Project. Appendix A permits hotels as a permitted use within block D. 5, Albemarle County approved a final site plan on February 10, 2012 for the Property entitled "Stonefield Town Center, Albemarle County, Virginia," prepared by WW Associates, dated August 6, 2011, and identified by the County as SDP2011-054 (the "Final Site Plan"). A minor amendment was approved on June 6, 2012 and is identified as SDP2012-01. The Plans permit the construction of 6 story hotel and subject to the terms and conditions of the Final Site Plan. A copy of the plan is on file; however, our office does not have the necessary resources to reproduce it in house. 6. If the Property is developed in conformance with the Final Site Plan, it will be in compliance with the Albemarle County zoning ordinance and all other applicable regulations. 7. In the event of casualty, in whole or in part, the structure located on the Property may be rebuilt in the current form. 8. There are no open violations on file in our records.
