He will be sending you a letter which will outline: a) Their opinion of the number of lots lawfully of record; b) History of the lots from 1980 to date. This will include deed book references and County action. It is in my opinion, a question of whether the lots comply with the Subdivision regulations in effect at the time of their recordation. ST.JCHN COUNTY ATTORNEY I have reference to a memorandum from Mason Caperton to Gay Carver dated June 7, 1983 and relating to Bentivar Subdivision. As you know, this matter has been the subject of considerable discussion for a number of years. The issue is what lots, if any, are lawfully recorded. ?Miss Capterton's memorandum recites that onlv lots 9-19 of Bentivar are lawfully recorded. This seems to have been the product of a letter written to you by Bob Tucker in 1981. Since the date of Mr. Tucker's letter, I have reviewed a large quantity of authority regarding the status of the subdivision and find that the comments contained in that letter are not accurate. It is my opinion that lots 1-30 of Bentivar Subdivision were lawfully recorded. I base that opinion upon the fact that in December of 1977, a plat was recorded on your behalf showing the Bentivar property, including lots 1-30. Each of these lots appears on its face to be more than 5 acres in area. My research reveals that the road on which lots 1-28 front is the same road which was adjudicated in the so-called "bridge case" to be an old County road which has not been abandoned. The road on which lots 29 and 30 front appears, at least to have been an easement in favor of certain other properties further to the south. The definition of subdivision in December of 1977 was (in paraphrase) a division of land into bne or more parcels of which any one is less than 5 acres in area or which involve the creation of the new street or access easement. Since all of these lots were in excess of 5 acres and the roads were previously in existence either as private or public thoroughfares, it is my opinion that this division into 30 lots did not constitute a subdivision which Charles W. June 9, 1933 By contrast, certain later plats of the Bentivar property show a division of the remainder of the land into a further 19 lots, (numbered 31 through. 49). There are also other plats which show certain other divisions in the similar time frame. Each o= these plats was recorded subsequent to March 29, 1973. This is the date on which the definition of subdivision was chanaed to substantially its present form, i.e., that no division of land is exempt unless all lots exceed 5 acres an area and have a specified frontage on State maintained highways. For the .foregoing reasons, it is my opinion that lots 1-30 of Bentivar were lawfully recorded as exempt from the subdivision ordinance as it existed at that time. The other numbered lots in Bentivar.- together entivar;together with certain other parcels, appear not to have been lawful because they were recorded after the effective date of the amended ordinance. This has been a confusing subject for all concerned, and I hope that this letter lays the matter to rest once and .for all. By copy of this letter, I am notifying Mr. Tucker, Mrs. Carver and Mr. Vaughn of my opinion in this matter so that, hopefully, there will be no confusion about it in the future. IMHOFF Planner RE: Bentivar Subdivision, Tax Map 46, Parcels 111-159 On May 20, 1981, Mr. Robert W. Tucker, Jr. notified Dr. Charles W. Hurt of a subdivision violation which had occurred when the -plat of the Bentivar Subdivision was recorded showing forty-nine (49) lots. It was determined at that time that thirteen (13) of those lots may have been legal if they were recorded prior to March, 1978 (lots 9-19, 29 and 30). It was Dr. Hurt's responsibility to prove to the County Attorney that a road existed prior to March, 1978 in order to prove the legal recordation of these lots . _ The Count _.-tor ne has advised me that lots 9-19 are legally recorded because the outcome of the Albemarle County Circuit Court's decision or. R. E. Vaughn versus Charles W. Hurt (bridge case) determined the existence of the road. However, Mr. Payne also noted that no similar evidence has been presented to him to prove the legality of lots 29 and 30. Given the above information, I recommend that lots 1-8 and 20-30 be deleted from the tax map (parcels 111-118 and 130-140). In addition, it has been m_v understanding that parcels 151-159 never existed legally and unless further information is provided by Dr. Hurt, these parcels should be removed also.
