Fisher Route 1, Box 261 Afton, Virginia 22920 RE: official Determination of Number of Parcels - Section 10.3.1 Tax Map 85, Parcel 11 Dear Mrs. Fisher, The County Attorney and I have reviewed the chain of title you have submitted for the above -noted property. It is the County Attorney's advisory opinion and my official determination that this property consists of 2 separate parcels, which total 6.88 acres. The larger parcel contains 6.25 acres; the smaller, a pie -shaped lot to the northeast, contains .63'acres. Each of these lawfully separate parcels is entitled to associated development rights. There is one additional lot; therefore, than is shown on the tax map. This determination considered the descriptive clauses of the deed, which delineate and enumerate the property as consisting of two parcels. This consideration is based on the findings of the Va. Supreme Court in the case, Faison v. Union Camp 224 VA 54. The most recent deed of record as of the date of adoption of the Zoning Ordinance is found in Deed Book 410, Page 68. It is dated August 11, 1965 from Anna Belle Kirby to Nay A. Fisher and Cora L. Fisher. This deed describes the properties as follows: a tract of land, consisting of two parcels . containing 6.88 acres and fully described by metes and bounds in deed from Downing L. Smith and wife dated December 1, 1950, recorded in the Clerk's Office of the Circuit Court of Albemarle County in D. B. 293, p. 248 . Reference is made to the aforesaid deed for a more detailed description of the property herein conveyed.
