RE: OFFICIAL DETERMINATION OF NUMBER OF PARCELS - Section 10.3.1
Tax Map 105, Parcel 11; Property of Bear Island Timberlands
Dear Mr. Ray:
The County Attorney and I have reviewed the documentation of
records you have submitted for the above -noted property. It is the
County Attorney's advisory opinion and my official determination,
that this property consisted of two (2) separate parcels on the
date of adoption of the Zoning Ordinance (December 10, 1980): One
parcel on the east side of Route 729 and the other on the west side
of Route 729.
Each of these lawfully separate parcels is entitled to associated
development rights. This determination results in one (1)
additional parcel than is shown with a parcel number on the 1980
County tax maps. (Subsequent to 1980, a "subdivision plat" was
approved in 1988).
This determination considered the Sanford v. Albemarle County Board
of Zoning Appeals case. In both cases, fee -simple right-of-way
dedication to the state for a highway, serves to divide the
property. In this case, the dedication of right-of-way for Route
729 was recorded in July, 1968, prior to the adoption of the Zoning
Ordinance.
The most recent deed of record as of the date of adoption of the
Zoning Ordinance is found in Deed Book 446, Page 402. It is dated
July, 1968 from Continental Can Co., Inc. to State of Virginia.
This deed created the following parcels:
1) (New parcel 11A) of 2.835 acres on the west side of
Route 729. Conveyed to Randy and Pamela Thomas on
March 6, 1989 (DB 1038, Pg. 575). One (1) development
right.

2) (Still parcel 11) of 462.335 acres on the east side of
Route 729. Property of Bear Island Timberlands. Five (5)
development rights.
