Ray 1717 Allied Street Charlottesville, Virginia 22901 RE: OFFICIAL DETERMINATION OF NUMBER OF PARCELS - Section 10.3.1 (Tax Map 14, Parcel 42 - Garrison Estate) Dear Mr. Ray, The County Attorney and I have reviewed the title information you have submitted for the above -noted property. It is the County Attorney's advisory opinion and my official determination, that this property consists of four (4) separate parcels all of which are located on the east side of Route 668. They are comprised of 24.6 acres, 7 acres, 3.5 acres and 86.5 acres. Each of these lawfully separate parcels is entitled to associated development rights. This determination results in three (3) additional parcels than are shown with a parcel number on the County tax maps. This determination considered the descriptive clauses of the deed, which delineate and enumerate the property as consisting of "all of those certain tracts, lots and parcels of land." This consideration is based on the findings of the VA Supreme Court in the case, Faison v. Union Camp 224 VA 54. The most recent deed of record as of the date of adoption of the Zoning Ordinance is found in Deed Book 215, Page 219. It is dated January 18, 1932 from R.L. and Ella F. Wood to Andrew and Cecelia F. Garrison. This deed describes the following parcels: 1. That certain tract or parcel of land, containing 24 6/10 acres, more or less, according to plat made by Hugh F. Simms in DB 165 P 371. There are five (5) potential development rights. February 17, 1993 Roger Ray/Garrison Estate 2. That certain tract or parcel of land, containing 7 acres, more or less, lying adjacent to the west of tract 11 and fronting on Route 668. It was conveyed to Wood by DB 167 P 270. There are three (3) potential development rights. 3. That certain tract or parcel of land, containing 3 1/2 acres, according to plat made by B.T. Parrott in DB 175 P 484. It lies adjacent to the east of the 24 6/10 acre tract. There is only one development right, and therefore no right to division. 4. That certain tract or parcel of land, containing 86 1/2 acres, according to plat of B.T. Parrott in DB 181 P 449. It lies adjacent to the north of the other three tracts, and fronts on Route 668. There are five (5) potential development rights. Anyone aggrieved by this decision may file a written appeal within thirty (30) days of the date of this letter.
