Harvey & Company P.O. box 155 Covesville, VA 22931 RE: OFFICIAL DETERMINATION OF NUMBER OF PARCELS - Section 10.3.1 Tax Map 117, Parcel 8A Dear Mr. Harvey, The County Attorney and I have reviewed the information you have submitted for the above -noted property. It is the County Attorney's advisory opinion and my official determination, that this parcel is entitled to a total of six (6) development rights. This is based on the plat for Owens-Illinois by Berkley, Powell & Associates, P.C., dated revised October 20, 1986. This plat involved several parcels of record as of the date of adoption of the ordinance: parcels 3A, 8, 9 and 12. By this plat, the following development rights were allocated: 1) Parcel 3A - 2 theoretical development rights, based on 4.7 acres; 2) Parcel 8 - 0 development rights. All 5 development rights were left with the residue; 3) Parcel 9 - 2 theoretical development rights. One was previously used in subdivision and 2 were left with the residue; 4) Parcel 12 - (this is also shown as parcel 9 on the plat, but was parcel 12 on the 1980 tax map). Two (2) theoretical development rights were given to this property and two -remained with the residue. A portion of parcel 1 was added to comprise the current parcel 8A, however no development rights were given with this acreage. Ronald W. Harvey & Company May 18, 1995 Page Two Under Virginia Code Section 15.1.496.1, if you disagree with this determination you may appeal this decision within thirty days of the date of this letter by filing with this office a written notice of appeal to the Board of Zoning Appeals.
