Orr 3986 Keswick Road Keswick, Virginia 22947 Re: Request for Determination of Development Rights Tax Map 79, Parcel 43F Dear Mr. Orr: This parcel of 63.045 acres is part of what was a larger parcel on December 10, 1980 when our Zoning Ordinance was adopted. The parcel today is totally on the south side of Rt. 732 and the west side of Rt. 729. The many deeds and transactions that have occurred involving this parcel since that time have not effected its development rights for lots of less than 21 acres. This parcel still retains the original five development rights that were established with the adoption of that ordinance. At 63.045 acres, this parcel could create a maximum of five lots that would be less than 21 acres each, provided that the total acreage devoted to such lots would not exceed 31 acres. In addition to those small lots, the remaining acreage could be divided into parcels with a minimum of 21 acres each. To gain the maximum development, the five small lots could be a minimum of 2 acres each, totaling 10 acres, and the remaining 53.045 acres could be divided into two parcels with a minimum of 21 acres each. This means the maximum number of lots that would be allowed under our current ordinance would be seven. These rights are strictly hypothetical. To utilize the rights and create the lots, all other ordinance requirements must be met. If you have any other questions, please feel free to call me.
