HomeMy WebLinkAboutLOD200000012 Letter of Determination 2000-09-13September 13, 2000 James and Nadine Shifflett 2216 Old Lynchburg Charlottesville VA 22903 RE: Development Rights on Tax Map 101, Parcel 7F Dear Mr. and Mrs. Shifflett: Several staff members of planning and zoning met today and went through the subdivision files to understand the history of the development rights on your parcel. The result is that we find that your parcel of 27.1 acres has 2 development rights for small lots, plus it may retain one lot that would contain a minimum of 21 acres. Each of those rights also represents the right to one dwelling unit. So the maximum number of lots or houses possible on your 27.1 acres is three. These rights are strictly hypothetical. In order to use them, you must demonstrate that all lots or houses can comply with all other County ordinances and regulations. You may, if you choose, ask for more rights by applying for a special use permit (SP). This requires a legislative action by the Board of Supervisors. The process takes about 3 months to complete and the fee is $175 if the additional rights are for the purpose of "family division" and all the original 1980 development rights have been exhausted under "family division" as defined under section 14-106 of the subdivision ordinance. If the rights were not exhausted under family division, the fee is $990. If you plan to request a SP, you should start by calling Bill Fritz in this department and scheduling a pre -application conference. At that meeting, staff will tell you about the information you need to submit and the process itself. Basically, it is best if you have at least a sketched plat showing any existing development and how the new lots will be arranged. Additionally, you should be able to demonstrate compliance with the zoning ordinance, especially the sewage disposal regulations. For your information, parcels 6A (and the new 6A1) were previously determined to be parcels of record when we adopted the zoning ordinance on December 10, 1980. Therefore, no rights from your parcel were used to create parcel 6A (which has now created 6A1). Each of those has one development right and may have only one dwelling per lot. Likewise, parcel 7131 was a 1980 parent parcel with its own rights. It has since created parcel 71).
