Agenda Item No. 12. Reconsideration: Naming of Jefferson-Monroe Parkway.
VOTED to name Route 53 from its intersection with Route 20 to its inter-
section with Route 795 as Thomas Jefferson Parkway;
VOTED to name Route 795 from its intersection with Route 53 to its inter-
section with Route 627 as James Monroe Parkway;
VOTED to leave the entire length of Route 627 to its intersection with Route
20 as Carter's Mountain Road.
Agenda Item No. 13a. Appointments: Airport Commission. VOTED to reappoint
Mr. Stewart Malone to another term which will expire on December 1, 1994; the
Board also VOTED to appoint Mr. William J. Kehoe as the Joint City/County repre-
sentative for a term which will expire on December 1, 1994. A letter concerning
this action has been forwarded to City Council for its concurrence.
Agenda Item No. 13b. Appointment: Alcohol Safety Action Program. VOTED to
reappoint Chief John Miller for a term which will expire on January 1, 1995.

Agenda Item No. 15. Other Matters Not Listed on the Agenda from the BOARD.
VOTED to reappoint Terry W. Hawkins as a member of the Jail Board with his
new term to expire on December 31 1995.
Concerning a letter from Kevin P. Murphy at J. T. Henley Middle School dated
December 13, 1991, the Board VOTED to waive any requirement for a fence around the
pond. I leave it to you to pass this information on to the correct people.
Concerning an inquiry from Mac Sandridge as to the word "continuous" in the
Retirement Pay policy, the Board asked that the staff make a report at the January
day meeting as to the number of employees who would be effected by deleting the
word "continuous" from, or by waiving the policy for service that is not
continuous. No action was taken at this time on Mr. Sandridge's question.
The Board VOTED to approve the legislative priorities of the Thomas Jefferson
Planning District Commission.
The Board then VOTED to give Mr. Bowie the gavel he had used for the past two
years as Chairman.
Agenda Item No. 16. Adjourned to January 2, 1992, at 4:00 p.m., in Meeting
Room 7 for the Organizational Meeting of the Board. A tentative agenda for that
meeting is attached.

Re: Attachment of Centel Cellular antennas to WCYK Tower on
Little Yellow Mountain
Dear Mr. Ferrence,
This is to confirm in writing my opinion that this proposal is in
compliance with the existing special permit, SP-81-34, McClenahan
Broadcasting Corporation. A separate or amended special permit is
not necessary. Therefore, the site plan may be approved, and
construction commenced according to standard procedure.
This proposed use on an existing tower is consistent with the
County's policy of encouraging co-location, or multi-user towers.
I understand that this approval will closely provide the cellular
coverage proposed with Special Permit 90-102. This was withdrawn
by the applicants, and accepted by the Board of Supervisors on
August 21, 1991.
Your proposal is shown on the site plan by Roudabush, Gale &
Associates revised Dec. 5, 1991. According to the Department of
Planning and Community Development, this plan has been reviewed by
the site review committee, and is ready for approval signature
pending this approval ;letter. The Director of that Department, Mr.
Wayne Cillimberg, is in agreement with my determination of
compliance.
The proposal includes construction of a 12 ft x 24 ft pre-
fabricated fiberglass shelter for the Centel radio equipment. In
addition, four (4) Cellular antennas will be located on the
sidearms of the existing tower. These antennas are straight, or
whip-like, and not rounded dishes. These antennas will not extend
beyond the top of the existing tower. Minimal grading will occur.
The existing tree line will be maintained, and no trees will be
removed.
I
I have reviewed the conditions of the special permit in effect for
the existing WCYK radio tower. In addition, I visited the site
wi th the surveyor from the design company. Each of the five
conditions of this permit will be met by this proposal. Any
further construction will require additional review.
We applaud your company's efforts to follow the County policy to
consolidate tower uses, and to avoid sporadic proliferation. If
you have any questions, please do not hesitate to contact me.
Barring unforeseen obstacles, this department can sign your site
plan on December 19, 1991. A copy of this letter is hereby
forwarded to the Board of supervisors for their information.

RE: OFFICIAL DETERMINATION OF NUMBER OF PARCELS - section 10.3.1
Tax Map 33, Parcel 51 (Westvaco Corporation)
Dear Mr. Compton:
The County Attorney and I have reviewed the chain of title you
have submitted for the above-noted property. It is the County
Attorney's advisory opinion and my official determination, that
this property consists of two (2) separate parcels: 1) one parcel
of 272.43 acres located on the east side of Route 600 and 2) the
other physically separate parcel of 138.25 acres located mostly on
the east side of Route 640. Each of these lawfully separate
parcels is entitled to associated development rights. This
determination results in one additional parcel than is shown with
a parcel number on the County tax maps.
This determination considered the descriptive clauses of the deed,
which delineate and enumerate the property as consisting of two
(2) parcels. This consideration is based on the findings of the
Va. Supreme Court in the case, Faison v. Union Camp 224 VA 54.
The most recent deed of record as of the date of adoption of the
Zoning Ordinance is 'found in Deed Book 381, Page 245. It is dated
August 27, 1962 from J. S. Purcell Lumber corporation to West
Virginia Pulp and Paper Company. This deed describes the
following parcels:
1. Tract #3 containing 272.43 acres, as described under #1
above.

These two parcels are not physically contiguous at any point. It
appears that they were combined by the County Real Estate office
by this property conveyance of 1962.

registration process, as our work program is fully scheduled for the remainder of the year and
we normally limit our preparation of nominations to those properties for which the Department

Petition: Lois Stewart-Wiebe petitions the Board of
Supervisors to issue a special use permit for a bridge in
the Doyles River floodplain to serve a single residence
[30.3.5.2]. Property, described as Tax Map 15, Parcel 16,
is located on the east side of Route 810 approximately one
mile north of Route 668 in the White Hall Magisterial
District. This site is not within a designated growth area
(Rural Area I).
Character of the Area: There is an existing stream crossing
at this location. The Engineering Department conducted a
field study of this bridge in March, 1991. Their comments
and findings are included as Attachment C. A mobile home is
currently on the property. This bridge was constructed in
violation of the Zoning Ordinance and shows signs of
deterioration. The Doyles River runs parallel and adjacent
to Route- 810 in this area.
Applicant's Proposal: The applicant proposes to completely
remove the existing crossing and install a proper crossing.
The existing crossing has started to deteriorate with
tunnelling under the pipes in the stream and slumping of the
roadway being the most obvious signs of deterioration. The
bridge will serve a single parcel only.
SUMMARY AND RECOMMENDATIONS:
Staff has reviewed this request for compliance with Section
31.2.4.1 of the Zoning Ordinance and recommends approval.
Planning and Zoning History: The existing crossing was
built in violation of the Zoning Ordinance. The Zoning
Department is aware of this and has provided a brief summary
of the activities on this site (Attachment D).
Comprehensive Plan: The Comprehensive Plan states a number
of concerns for activity in the floodplain including
"Encroachment into floodplain lands by development and other
inappropriate uses can result in increased danger to life,
health and property; public costs for flood control
measures, rescue and relief efforts; soil erosion,
sedimentation and siltation; pollution of water resources,
and general degradation of the natural and man-made

environment." (1989-2010 Comprehensive Plan, page 61). The
Comprehensive Plan states as a strategy to preserve water
quality "Restrict all clearing, grading and construction
activities to the minimum required for the proposed
development." (page 67).
STAFF COMMENT:
All of Parcel 16 lies on the opposite side of the river from
Route 810. Therefore, no area exists on the parcel which
would allow for development without the use of a stream
crossing. Access to this site is over an unrecorded
easement. The County Attorney has stated that evidence
submitted by the applicant indicates that color of title to
the access exists which is sufficient to allow the applicant
to file this application. No other access to the site
exists. The property to the south (Tax Map 14, Parcel 34)
is served by a stream crossing located approximately 1,400
feet downstream from this bridge. Staff offers the
following general comments:
1. No building site exists on the property which would not
require a stream crossing;
2. No alternative access is available which does not
require a stream crossing to be installed;
3. No adjacent properties will be benefited directly by

4. The Engineering Department has reviewed a hydrologic
study and has stated that the request satisfies the.
engineering criteria of the Zoning Ordinance
(Attachment E).
SUMMARY:
Staff generally discourages stream crossings where they can
be avoided. However, as stated above, no use of this parcel
can be made without the construction of a stream crossing
and no alternatives exist which would alleviate the need for
a stream crossing. No other parcels could benefit from this
crossing. Staff opinion is that with the appropriate
conditions this use will be consistent with the Zoning
Ordinance and Section 31.2.4.1 in particular. Therefore,
staff recommends approval subject to the following
conditions:

RECOMMENDED CONDITIONS OF APPROVAL:
1. Department of Engineering issuance of an erosion
control permit;

2. Compliance with all local, state, and federal permit
requirements pertaining to disturbance of a perennial
stream;
3. Department of Engineering approval of crossing design
to ensure compliance with Section 30.3;
4. Approval by the Water Resource Manager of a water
quality impact assessment under the Water Resource
Protection Areas Ordinance.

processed for review. We have copied all relevant information
from the yiolation file, V-89-64 Curtis W. Burruss into this file.
Based on recent additional information of record granting an
access easement from Rt 810 to this property, it is the ppinion of
Mr. st. John that it is now properly before you.
Ms. stewart-wiebe is the current property owner, and a resident of
Connecticut. She is represented by Tom Muncaster, Engineer and
Jim Cox, Attorney in town. The previous owner, curtis 'Burruss
installed the culverts. He has fled the area, and I have an
outstanding warrant against him on this violation.
This violation dates back to May, 1989. We have sought various
means of compliance, including the "Long-Arm" Statute. The
violation will be abated once a) the special permit is approved
and conditions met; or b) the culverts and fill are removed. Mr.
Robertson, Watershed Management Official has commented that onsite
engineering inspection is necessary to examine evidence of
undermining the culverts due to heavy storms.

This special permit application involves some history.
Curtis Burruss constructed the existing stream crossing by
cutting the ends off of two steamship boilers (approximately 6
feet in diameter) and using them as culverts. This activity
was discovered in May, 1989 and a site visit was made. Fill
was being-placed on top of the culverts and tamped by hand.
The culverts were never anchored to the stream bed nor were
they stabilized from the top with any concrete or grout.
The existing stream crossing has deteriorated over time.
This office has photographs and videotape which illustrate the
problem. Fill dirt has eroded on either side of the crossing
and slumped around the culverts. Water has also undercut 'the
culverts at the base. The existing structure poses problems
for streamflow-because high water does not pass through the
emergency spillway, but flows around the eastern side of the
crossing, causing erosion.
This office continues to be concerned about the
proliferation of poorly designed stream crossings and
activities along the Doyles River. There is currently an
enforcement action by the Army Corps of Engineers for
unauthorized instream work upstream of this site. The
applicant should insure that any proposed crossing is not only
structurally sound, but complies with all applicable state and
federal regulations.

Petition: Mark Wilson petitions the Board of Supervisors to
issue a special use permit for visible Outdoor Storage and
display within the EC, Entrance Corridor Overlay District
(30.6.3.2) on 0.4752 acres zoned PD-SC, Planned Development
Shopping Center. Property, described as Tax Map 78, Parcel
17(D)2, is located within the Pantops Shopping Center
between First Virginia Bank and Taco Bell (see Attachment
A). This site is located in the Rivanna Magisterial
District and in Urban Neighborhood 3.
Character of the Area: This site and Taco Bell share an
entrance onto Riverbend Drive. There is an on-site access
road connecting this site, the bank, and Taco Bell to the
shopping center ring road. This parcel is flat with four
Bradford Pears along Riverbend Drive.
APPLICANT'S PROPOSAL:
The applicant has submitted two descriptions of this request
(see Attachment B). There will be approximately eight
sheds.
PLANNING AND ZONING HISTORY:
This site has extensive history. The following list is a
summary:
ZMA-83-02 - Riverbend Limited Partnership - On June 15,
i983, the Board of Supervisors approved a proposal to rezone
28.735 acres from C-1, Commercial to PD-SC, Planned
Development Shopping Center on Tax Map 78, Parcels 17D,
17(D)2, 17F, 17G, and parts of Parcels 15(C)1 and 17A.
83-029 - Riverbend Shopping Center Site Plan Phases I, II,
and III - On June 7, 1983, the Planning Commission approved
a site plan to locate a 183,600 square foot Shopping Center.
SDP-83-054 - Riverbend Shopping Center Phase I Entrance
Clarification - On November 15, 1983, the Planning
Commission approved a proposal to relocate an access road on
Parcel 17(D)2.

SUMMARY AND RECOMMENDATIONS:
The Architectural Review Board recommends approval of
SP-91-59 on a temporary basis and subject to conditions (see
Attachment C). Given the applicant's written and verbal
statements, staff recommends an eighteen month limit.
The applicant intends staffing this site and has
demonstrated that businesses within the shopping center
agree to his employees using their restroom facilities (see
Attachment D). In a memo dated October 21, 1991, the
Inspections department outlined their position regarding
occupancy of the sheds (see Attachment E). The applicant
has verbally indicated that he does not intend to occupy
any shed.
Section 25A.2.1 of the Zoning Ordinance states:
"Outdoor storage, sales or display shall be permitted
only when enclosed by appropriate visual screening."
Staff opinion is the that concern for aesthetic resources
will be adequately addressed by the Architectural Review
Board.
Section 31.2.4.1 of the Zoning Ordinance states:
"The board of supervisors hereby reserves unto itself
the right to issue all special use permits permitted
hereunder. Special use permits for uses as provided in
this ordinance may be issued upon a finding by the
board of supervisors that such use will not be
substantial detriment to adjacent property, that the
character of the district will not be changed thereby
and that such use will be in harmony with the purpose
and intent of this ordinance, with the uses permitted
by right in the district, with additional regulations
provided in Section 5.0 of this ordinance, and with the
public health, safety and general welfare.
Given the Architectural Review Board issuance of a
Certificate of Appropriateness, staff opinion is this
request will neither be detrimental to adjacent properties
nor change the character of the district. Given potential
development under the present zoning, staff opinion is this
use should be harmonious with the purpose of intent of the
Zoning Ordinance.
Therefore, staff recommends approval subject to conditions:

A sale representative may staff the lot at certain times of

BUildings on the lot may actually be sold in certain

following the Architectural Review Board Meeting this past week. I
have given some thought to their recommendations and would like to
make the following change.
I would like to change the period of occupation from one year
to two years or eighteen months. This would give the business a
more reasonable time to evaluate a long term property commitment.
In addition, I can assure both your office and the A.R.B. that
my site will be clean and orderly. I believe planting perennials in
either tubs or beds may benefit the appearance of the buildings. I
will also keep the grass mowed and would take steps to prevent
erosion or mud developing from pedestrian paths. This could be
done with either river gravel walk areas or landings using pine
bark mulch.

Your Memo of October 16
Mark Wilson's proposal, dated October 8, 1991, is not necessarily
acceptable or unacceptable to this Department. It does not
contain any indications that he intends to occupy any of the
buildings which are on display. If he does not occupy in this
fashion, his operation will not cause any building code
involvement.
However, if a desk, chair, table, file cabinet, etc. are placed in
one of the storage sheds, this Department will interpret such
action as occupancy. Such occupancy will constitute a violation
of the building code.
The building code does not comment on the sharing of bathroom
facilities by various neighbors. It does require that if a
building is constructed it must contain a bathroom, unless a
bathroom is available in another building, under the same
ownership, within 500'.
In summary:
1. If Mr. Wilson does not create an office or other occupied
building on site, then the use of a neighbor's bathroom will
be solely at the discretion of the neighbor.
2. If an office is created at the site it must meet all of the
applicable requirements of the building code; including the
construction of a bathroom.
3. If one of the storage buildings is used as an office" Mr.
Wilson will be charged with violating the building code.

ZMA-89-09 RIO HILL WEST (REVISED STAFF REPORT)
Petition: Rio Hill West petitions the Board of Supervisors
to rezone 9.198 acres from R-6, Residential to R-15,
Residential [Proffered]. Property, described as Tax Map 45,
parcel,29B (part), 91, 92 (part), 93A1, and 109C, is located
on the west side of Berkmar Drive at its intersection with
Woodbrook Drive in the Charlottesville Magisterial District.
This site is located in Neighborhood 1 and is recommended
for High Density Residential (10.01-34 dwelling units per
acre) .
Character of the Area: The site is currently wooded. The
new Agnor-Hurt Elementary school is under construction on
the property immediately to the south. Rio Hill Shopping
Center is located to the southeast of the site. All
adjacent property on the west side of Berkmar Drive is
currently zoned R-6. Property on the west side of Woodburn
Road is zoned RA.
APPLICANT' S PROPOSAL:
This proposal was previously presented to the Planning
commission with no proffers.
Currently, the applicant is proposing to rezone the property
to R-15, Residential with the proffers contained in .
Attachment B. These proffers limit the impact on Woodburn
Road, specify entrance location and grants an easement
allowing a parcel which currently has access only to
Woodburn Road to have access to Berkmar Drive. The
applicant has provided a letter (Attachment C) to address
the concerns of staff (Attachment D). These comments are
provided for information only and do not represent proffers.
PLANNING AND ZONING HISTORY:
May 4, 1988 - The Board Of Supervisors rezoned a portion of
the land currently under review from HC, Highway Commercial
to R-6, Residential as agreed to by the developer of the Rio
Hill Shopping Center during the approval of the Rio Hill
Shopping Center.
October 23, 1990 - Staff administratively approved a
subdivision plat creating the school property. The area
currently under review includes residue acreage from that
subdivision.

November 7, 1991 - The Planning commission recommends denial
of an unproffered request to rezone this property to R-15.
DeveloDment ImDact to Public Facilities
At the request of the Board of supervisors, the Planning
staff reviews rezoning requests for their fiscal impact on
public and transportation facilities. This analysis is
limited to those rezonings that have some effect on
facilities that are identified in our ClP or six Year Road
Plan and have a cost associated with them.
The analysis is. based on a fair share determination of a
particular development's impact to affected facilities. It
must be pointed out that this analysis is cursory, due to
the lack of information on revenues and the amount
attributable to this development. The cost outlined by
staff only indicates the proportionate share of construction
costs from the additional development generated by the
rezoning over by-right development.
The following are those facilities which will be affected by
the rezoning request:
A. Schools
Schools affected by this proposal are the new middle, Burley
Middle, and Albemarle High School. All three are projects
in the elF.

Based on the additional students as estimated by multipliers
currently used by the county, a total of 10 additional
elementary students, 5 middle school students and 5 high
school students are anticipated.
Costs attributable to this development based on this
proportion of students is $212,833 or $1,553.53 per dwelling
unit.
B. Parks and Recreation
Three projects are identified in the CIP that will serve
this site.

Based on service areas and capacities of these facilities,
the cost attributable to this development is $6,730 or
$49.12 per dwelling unit.
C. Libraries
This proposal is considered to be in the service area of the
Northside Library ($300,000). Based on proportionate impact
to library capacity, the proportionate share cost of this
project is $3,765 or $27.48 per dwelling unit.
D. Roads
This project will impact Berkmar Drive ($822,962). Based on
the traffic generated by this development that will impact
Berkmar, the share for this project is $10,616 or $77.49 per
dwelling unit.
Consideration of the fiscal impact of the development needs
to be balanced against considerations of the County's growth
management policy. Excessive development exactions could
have the affect of discouraging utilization of the holding
capacity of area, and thus, lead to accelerated development
in the Rural Areas.
STAFF COMMENT:
staff has identified four main issues regarding this
request:
1. Compliance with the c~mprehensive Plan
2. Traffic Impact
3. Impact on Agnor-Hurt Elementary School

COMPREHENSIVE PLAN:
On page 154 the Comprehensive Plan states
"Woodburn Road is currently inadequate to support
extensive residential development, thus making the
Berkmar Drive Extension now under development important
to opening up the higher density residential area north
of Rio Road. Route 29 is a congested route along the
eastern side of the neighborhood, with limited direct
access allowed to parcels north of Rio Road."
"Continue current land use trends (commercial and
industrial development along Route 29 North and
residential development to the west) with primarily
medium density residential development along Rio Road
and medium and high density along Woodburn Road in
areas presently undeveloped. It is intended that no
commercial development occur west of the proposed
extension of Berkmar Drive."
Access to Woodburn Road is anticipated by the traffic study
to generate 110 vehicle trips per day. No plan has been
submitted which shows how access to Woodburn would be
accomplished. However, the applicant has submitted a
proffer limiting the number of vehicle trips which will
access Woodburn to 110 vehicle trips per day. Staff will be
able to ensure this impact is not exceeded during site
review. with limited access to Woodburn Road, this request
can be considered consistent with the statements of the
Comprehensive Plan. This area is proposed for High Density
Residential on the Land Use Map and, therefore, this
development is considered consistent with the Land Use Map
in the Comprehensive Plan.
This map also states, "Note: Densities shown on this map
may not be realizable with existing facilities." Staff
believes that this statement is important due to the
potential impact of the proposal to Woodburn Road and the
yet to be developed Berkmar Drive connection to Rio Road.
(Construction of this Berkmar connection to Rio Road is
currently scheduled for the spring of 1992.) Should this
rezoning be approved, it is unlikely that the applicant
would submit and have approved a site plan prior to the
start of construction on Berkmar. Therefore, as regards
impact to Berkmar Drive, this rezoning request is not
premature.

Traffic Impact
Under the proposed zoning, 137 dwelling units are
. mathematically possible. Under the current zoning, 55 units
may be constructed. Staff is unable to provide detailed
information about the proposed development as no development
plan has been submitted. A traffic study has been submitted
and reviewed by the Virginia Department of Transportation.
This study indicates that R-15 zoning would generate 1,100
vehicle trips per day. The study indicates that 10% of the
traffic (110 vehicle trips per day) would enter onto
Woodburn Road. The remaining traffic would travel onto
Berkmar Drive (15% or 165 vehicle trips per day) and
Woodbrook Road (75% or 825 vehicle trips per day). The
Department of Transportation has reviewed the traffic study
and has provided comments (Attachment E). After submittal
of proffers by the applicant the Department of
Transportation provided additional comments (Attachment F).
Parcel 91, consisting of 5.391 acres currently
has access only to Woodburn Road. Under the current R-6
zoning, this could result in 32 dwelling units and 224
vehicle trips per day accessing Woodburn Road. The
applicants' proffers grant access to Berkmar Drive for
Parcel 91 and limit impact on Woodburn Road to 110 vehicle
trips per day or approximately 50% of the level currently
permitted. This reduction in traffic on Woodburn is
consistent with statements of the Comprehensive Plan and
comments :made by the Virqinia Department of Transportation
in Attachment F.
The property lies in the path of the Alternative 10 Bypass
(Attachment G). The Department of Transportation does not
recommend approval of this request due to a lack of
information and conflict with the Alternative 10 Bypass.
The Alternative 10 Bypass is not shown in the Comprehensive
Plan. The County has gone on record as stating that the
bypass should not be considered until all other CATS
projects have been constructed. It is the County's belief
that with these projects, Alternative 10 will not be
necessary. However, the County has agreed, by letter dated
November 22, 1991 to Secretary of Transportation Milliken,
with the sequencing of Alternative. 10 as a long-range
project in the Route 29 corridor and agreed to make
developers aware of the bypass right-Of-way in any proposed
land use change (See Attachments H and I).

Impact on Agnor-Hurt Elementarv School and suitabilitv of
the Site for Develocment
Staff is not able to provide an exhaustive review due to the
lack of any development plan. The County has 'attempted in
past rezoning requests to obtain a conceptual plan for
development in order to determine the relationship of the
development to adjacent areas. The applicant has proffered
measures to alleviate traffic impacts. Staff notes that,
during site plan review, staff can ensure that the
development satisfies the requirements of the Zoning
Ordinance. without a plan for development, staff is
otherwise unable to determine what impact, if any,
development of this site would have on the adjacent school
or visual appearance of the site from public roads. The
site is tree covered and the tree line is visible from
adjacent areas. No retention of treecover is proposed by
the applicant to provide buffer from the school or natural
screening of the site's development.
The property is moderately rolling and does not appear to
have any severe restraints to construction. Available fire
flow is approximately 2,107 g.p.m. at 20 p.s.i. Information
from the Albemarle County Service Authority indicates that
adequate sewer capacity is available, however, downstream
improvements may be required. '
Smma~
Staff has identified the following factors which are
favorable to this request:
1. The request is for R-15 zoning which is consistent with
the property's designation for high density residential
land use in the Comprehensive Plan.
2. The applicant's proffers reduce potential traffic
volumes on Woodburn Road.
Staff has identified the following factor which is
potentially unfavorable to this request:
1. This development is within the alignment of the
Alternative 10 Bypass.
Staff has also expressed concern as to lack of a conceptual
development plan for the site, but believes most concerns
can be addressed during site plan review. While extent of
tree clearing is not addressed in this application, tree
canopy provisions in the Zoning Ordinance provide
opportunity for retaining important natural areas.

RECOMMENDATION:
The applicant's proffers have addressed the development's
potential impact on Woodburn Road. While this proposal is
within the Alternative 10 Bypass alignment and approval of
this request may increase right-of-way acquisition costs,
the County's position is that Alternative 10 is not required
and it is not included in the Comprehensive Plan. The
proposal is consistent with the Comprehensive Plan
designation for the area and staff recommends approval of
ZMA-89-09 subject to the acceptance of the applicant's
proffers.

Dear Bill:
In order to proceed to public hearing, I would like to address the items in
your letter of January 17, 1991 as follows:
1. We are aware of the Tree Canopy and how important it is to try and
utilize as many existing mature trees as possible in the development plan. At
this time, we are requesting rezoning and can only impress upon the future
developer the importance of maintaining the trees.
2. Please see the Wilbur Smith 'report dated May 31, 1991.
3. To develop this site would have very little impact on the school
site. A natural buffer in form of a drainage swale exists near the intersection
of Berkmar and Woodbrook Drive. This swale along with a greenway of existing
trees filled in with evergreen should provide a very adequate screen. Since
there will most likely be children who live in this future development attending
the adjacent school, perhaps a walkway to the school could be established on
the site allowing more safety and eliminating busing.
4. As shown on the closing statement dated October 10, 1990, the County
of Albemarle (Grantee) provided for a commercial entrance or site distance
for an entrance from Woodburn (Route 659) to Parcel 91. While for convenience,
the overall area is the subject of one application. These are separately owned
parcels here. The owner of the Route 659 parcel does not have direct access
to another entrance. Although, it is hoped to develop the area as one entity
ultimately. This would have to be addressed at the future date.
5. It is understood that when a traffic signal is installed at Woodbrook
and Berkmar Drive that we may be responsible for the cost of one face.
6. We respect your concern regarding a conceptual plan not being
submitted, but at this time we are only asking for a rezoning of this property.
It is not our intention to develop this site.

7.' The Fiscal Impact is still of concern. Once you have established a
revised analysis, it is something we could discuss further. At this time, we

proportional share of the project cost.
As discussed in prior conversations this area was the site

The Department has reviewed the traffic study for the above rezoning request.
The property in this request is directly involved with Alternative 10 and most of it
would be taken. Therefore, the Department does not support this rezoning request
since it is in conflict with Alternative 10 and most of the property involved would
be needed for this proposed roadway.
This request and resulting development, if approved, could create a change in
the traffic patterns assumed for the Berkmar Drive area. . Past discussions with.the

At the preliminary' field inspection for improving Route 631, there was discussion
about the intersection of Route 631 and 659 and what is needed there. It was
determined that no right turn lane would be shown for Route 659 off of Route 631,
since Route 659 is expected to remain a low volume dead end road. The traffic study
has figures for three parcels (109C, 93 A-1, and 91) while the rezoning request
involves five parcels (the above three with one acre of 92 and 0.152 acres of 29B).
These other two parcels total 1.152 acres and using 15 dwelling units per acre,
would result in approximately 130 VPD based on 7.5 trips per unit. Therefore, the
total traffic generation with a change from R-6 to R-15 could go from 970 VPD shown
in the study to 1,100 VPD, with all parcels being included. Should there be a
connection between Berkmar Drive and Route 659, this additional traffic needs to be
accounted for in some way also.

The original Berkmar Drive study showed the intersection of Berkmar and
Yoodbrook Drive being unsignalized. Yith the approval of the revised traffic study,
due to the Yal-mart/Sam's rezoning, a traffic signal would be needed at the
. Voodbrook/Berkmar Drive intersection. This current rezoning only exacerbates the
traffic situation and complicates the installation and payment for a future signal
by introducing a fourth interested and responsible party.
The Department does not support this rezoning request since it is directly
involved with the alignment of Alternative 10 and most of the property would be
needed for this road. The attached sheet shows the impact of Alternative 10 on the

This is in reference to proposed proffers for the above rezoning from a letter
dated November 12, 1991. The first two proffers limit the traffic generation to
Route 659 to 110 VPD and allow access for parcel 91 to Berkmar Drive Extended.
Therefore, the overall traffic generation to Route 659 with these proffers should be
less than currently allowed since parcel 91 only had access to Route 659. The third
proffer is this developers agreement to participate in the future traffic signal at
the intersection of Berkmar and Voodbrook Drives.' Before Berkmar Drive is added to
the State System, this traffic signal will either have to be installed or have a
posted bond. The Department's previous comments 'from the August 12, 1991 letter
concerning the impact of Alternative 10 on this property, still apply. These
proffers address some of the items previously discussed for this request and should
not result in any changes to the traffic volumes from the revised study.

We have received your letter of November 4 and the Board of ,
Supervisors would like to thank you for your personal efforts in
clarifying issues of grave concern to us. As you know, the coun-
ty's position has always been; and ~till is, that the western
bypass, or in fact any bypass, is not required and that if all of
the CATS improvements are completed, this will become evident. Our
objections heretofore were not so much with the Commonwealth Trans-
portation Board's (CTB) formal resolution of November 15, 1990, but
with "side comments" made by some at the public hearing that
Alternative 10 might be constructed before the CATS Plan is com-
pleted. Your letter and the proposed clarifying resolution goes a
long way in alleviating these concerns.
On October 24, 1991, the three local jurisdictions (Albemarle
County/City of Charlottesville/University of Virginia) reconvened
the Joint Transportation Committee to discuss our positions on the
whole Route 29 North problem. You will be pleased to know that the
.Committee is recommending that we pass a joint resolution similar
to the CTB's position and confirming our desires on the sequencing
of construction. Our resolution will go beyond the CTB's in that
both the County and the City will include cooperative efforts on
the construction of the Meadow Creek Parkway and the University
will include the construction of the connector road from the bypass
to the North Grounds. When approved by the three separate bodies,
this will become part of our CATS Plan.
We do have the following specific comments or suggestions on
your letter and the proposed resolution:
o Letter, Page 1 - Phase I, Short-range Recommendations -
We feel that the design for widening of Route 29 from the
Route 250 bypass to Rio Road should facilitate the later

construction of the grade-separated interchanges at Rio,
Greenbrier and Hydraulic Roads. It would seem far more
economical to design Route 29 in this manner at this time
than to have to redo part of the construction for the
interchanges. The early design of these interchanges
will also aid the County and City in the preservation of
the necessary right-of-way.
o Letter, Page 2 - Phase II, Medium-range Recommendations -
Since the three grade-separated interchanges are to be
built before Alternative 10, it is requested that the
design of the interchanges and acquisition of right-of-way
based on hardship proceed in the same manner as is being
done for Alternative 10.
o Letter, Page 3 -Final paragraph - With the above comments,
the letter does meet the approval of the County. We are
concerned, however, with the comment that the County
should "move forward with the preservation of necessary
right-of-way" since we have no way to do that except
through the purchase of land, for which we have no
resources. The County will participate in making develo-
pers aware of any proposed rights-of-way needs, including.
the bypass in our CATS Plan and working with developers
on any proposed land use change. We trust you are aware
of our legal limitations.
o Resolution, ,Final "WHEREAS" - We suggest the following
wording be substituted: "WHEREAS, the Board strongly
believes that the Route 29 Bypass should be constructed
in concert with the remaining construction projects of
the CATS 'Plan after Phase 1 and Phase 2 recommendations
of the Board's November 15, 1990, resolution have been
completed.
Again, we would like to extend this Board's thanks to you for
your personal efforts in resolving the uncertainties, misunderstand-
ings and concerns which have plagued Albemarle County for decades.
We look forward to receiving the CTB's resolution which hopefully
will put this matter to rest. We believe that the final solution
will be in the best interest of the citizens of the local communi-
ties as well as the Commonwealth in general.

As additional funding becomes available and scheduling
permits, a design will be prepared for three interchanges to be
added to the Base Case. The design of these interchanges is, of
course, subject to public hearings and CTB approval. The
preservation and acquisition of right-of-way for each element of
the Plan was part. of Phase I. If this Plan is to succeed the
county and the city.must do everything possible to preserve the
right-Qf-way required for the construction of the Base Case, the
three interchanges and the Line 10 Corridor approved by the CTB.
The refinement of Alternative 10 is currently underway, and
a preliminary plan (functional plan) will be provided to
Albemarle County and the City of Charlottesville to assist in the
preservation of right-of-way along that corridor.
After the design has been approved and right-of-way plans
are prepa~d,. and subject to availaDle fun~ing, VDOT will
consider'cicquiring,prop:erty which 'meets the Department's
requirements for advanced right-of-way acquisitiori along'
Alternative 10. .
In order to work with the County in the protection of the
watershed, access points on Alternative 10 will b~ limited to
those approved by the CTB when the corridor was designated,
unless additional access is requested by th'e local government.

On November 6, 1991, the Board held a public hearing and included
Glenmore in the service area boundaries of the Albemarle County
Service Authority for water and sewer service. At that time,
staff recommended that all of the Rivanna Village growth area
be included. The Board ordered a public hearing on this matter
for December 18, 1991. The attached letter was sent to all
property owners involved (approximately 95) notifying them of
this public hearing. No new information is forthcoming with

Jurisdictional Area Designation - Village of
Rivanna
Staff has received the attached from a property owner in the
Village of Rivanna requesting jurisdictional area
designation for water and sewer service (Attachment A). On
November 6, 1991, the Board will hold a public hearing for
jurisdictional area designation in the village for the
Glenmore property only. Some 565 additional acres are also
included in the village and public water and sewer is
allowable under the Comprehensive Plan recommendations for
these properties (See Attachment B). It is staff's
recommendation that the Board of Supervisors proceed to a
public hearing to consider full jurisdictional area
designation for all remaining properties in the Village of
Rivanna, including Mr. Bieker's. A list of these parcels
(Attachment C) and a map delineating their location
(Attachment D) is included.

Currently I own a five acre parcel (TM 79, P 25A) near the Glenmore
development. The parcel is located in a designated growth area, and
within the Village of Glenmore. I would like to initiate a request
that the jurisdictional area be amended (if this is the correct procedure)
to include this property in sewer and water rights when these utilities
become available.

Crozet Recycling
The following information is provided as background to your discussion on the Crozet Drop-off
Recycling program.
Background:
The Crozet Recycling Program is a local initiative sponsored by the County and a group of
communi ty volunteers called the Crozet Recyclers. They started their program around
February, 1991 and as the program grew, they requested financial assistance from the County
to offset collection and transportation costs. This program is run once a month from 8:30
to 11:00 on a Saturday morning. You approved financial assistance initially at $40/month and
increased it to $250/month when the private hauler's costs increased to accommodate the
higher tonnage collected. The program funding expired in December. Collections and cost
data are as follows:

The average cost per ton of $63 compares favorably to the estimate of $60-$70 for our
voluntary curbside recycling program assuming collection costs for the drop-off program do
not increase above the $250/event.

Discussion:
Information from the private haulers providing these collection services indicate their costs
have increased as a result of higher volumes as well as a weakening of the market for
recyclables. Preliminary estimates of $500 to $1,000 per event would be required to continue
the Crozet drop-off program in its current form. Based on the peak collection of 5 tons in
December, this would equate to $100-$200 per ton. This does not compare favorably to the
$60-$70/ton for the curbside program.
If the Crozet drop-off program does not continue, residents will still have two options for
recycling: first, the voluntary curbside program is being offered to all private haulers in
the County starting January 1, 1992; and second, the McIntire drop-off center is available
for newsprint, glass, and aluminum. Alternatives to curbside collection may still be
necessary to provide services to unique residential areas. The need for these will be
addressed in our development of a comprehensive solid waste program that will be presented
to you in February for consideration with the budget for FY 92-93.
Alternatives:
(1) Continue the Crozet program for January at an estimated cost of $500. This would be a
short-term extension and would probably require continued extensions or termination.
(2) Continue the Crozet program through the fiscal year at an estimated cost of $1,000 per
event or $6,000 for the remainder of the year. Collection services should be bid and a
review of the program conducted to identify if any changes would provide a more cost
effective operation. Continuing this program would require significant commitments to
coordinate the volunteer staffing of each event. Offering these services in Crozet for six
more months may create demand for similar services in other areas of the County which have
not been studied nor have funds been identified.
(3) Provide a similar service at the Ivy Landfill. Rivanna Solid Waste Authority and County
staff are looking at this option and will include it in the comprehensive program evaluation
for February.
(4) Provide no further funding at this time. Alternative recycling services are available
that are more cost effective. The new voluntary curbside program has not been in place long
enough to evaluate but conducting duel recycling efforts is considered counter-productive.
Recommendation:
Staff recognizes the tremendous efforts of the Crozet volunteers and the significant
educational benefit of their program and if the Board feels it is important to maintain the
current recycling program in Crozet until volunteers can be better coordinated, then
Alternative 1 should be followed. However, staff recommends that the Board look closely at
Alternatives 3 and 4 as they appear to be the most cost effective.

Poll Concerning the Naming of the James Monroe Parkway
The assumption is made that the recommendation of the
Department of Planning and Community Development dated December 3,
1991 is accepted by The Board with the possible exception that that
portion of SR 627 from SR 795 to SR 20 at Cater's Bridge currently
named Carter's Mountain Road may also be changed to the James
Monroe Parkway. Property owners (or persons speaking for them)
along that portion of SR 627 in question were for the most part
contacted by telephone. Approximately four owners were not
contacted, but nineteen were represented. Of the nineteen four were
for SR 627 being named James Monroe Parkway, fourteen opposed, and
one expressing no preference but "he would support the majority".

PREPARED REMARKS
We appreciate the opportunity the Board has given us to appear
together for the first time in the road-naming saga.
Our position is straightforward: both Jefferson and Monroe are
great Americans, and each deserves the highest possible
recognition.
Accordingly, we support the staff recommendation that you consider
naming one roadway for each man -- specifically a roadway in front
of and on the immediate access route to each home.
In addition, we support the extension of the Monroe Parkway along
Route 627 to the point where it intersects with Route 727 (Blenheim
Road). Mrs. Holmes has a petition from a majority of landowners
along that stretch to submit in support of that designation.
We also request your support for placing signs reading liTo James
Monroe Parkway" at the intersection of Routes 20 and 53 as well as
the intersection of Routes 20 and 627.
We believe this proposal will also make clearer the location of any
calls coming into the County's 911 system which was, after all, the
goal of the road-naming project.
We recognize and commend the herculean efforts of the E911 Road
Naming Committee to propose names for each of Albemarle County's
eight hundred roads.

Dear Mr.Bowie;
I am writing to you in reference to the proposed changing
of Routes 795 and 627 to the James Monroe Parkway. I am the
third generation to live on Keelona Farm on Rt. 627. With all due
respect to President Monroe I feel that the name Parkway carries
with it visions of fast food restaurants, public bathrooms, and a
thoroughfare in New Jersey. Routes 795 and 627 are country
roads winding over Carter's Mountain and if they are to be
renamed they should be named appropriately.
Because of the long history of the Carter family in the region
and because it is indeed a mountain road I feel that the name
Carter Mountain Road is a much more desirable name.
This issue is of much concern to our famiy and I hope that you
will give it much consideration.

I am here to request the establishment of the James Monroe
Parkway from the intersection of State Route 53 and County Route
795 to the intersection of State Route 20 and County Route 627 at
Carter's Bridge. My reasons for this request are historic,
economic, and logistical, as outlined in my letter to Planning
Director Wayne Cilimberg on November 22.
In addition, I have now surveyed all of the owners whose
properties front on these roads, and their support of the James
Monroe Parkway is overwhelming. I have attached a list of the
owners with their comments.
ALONG 795
27 parcels, 17 owners, all in favor excepting one neutral.
ALONG 627
28 parcels, 15 owners, 8 in favor, 1 neutral, 3 opposed, 3
could not be reached by telephone.
I submit that these statistics more than support the creation

I am writing 'in regard to our recent telephone conversations
and my request for establishment of the James Monroe Parkway in
lieu i:>f--theproposed Carter's Mountain Road. My reasons for this
request are historic, economic, and logistical.
Background
.
~
Following the announcement of the county road names and the
designation of the Tnomas Jefferson Parkway, Dan Jordan, Director
of Monticello, and I met to explore how President James Monroe
could be equally represented. We agreed to request that the Thomas
Jefferson Parkway commence at the intersection of Routes 20 and 53
and continue along Route 53 either to Simeon or to the intersection
of Routes 53 and 795. I fully support this designation. At the
termination of the Jefferson Parkway, the James Monroe Parkway
would begin. (Neither Mr. Jordan nor I have any recommendations
for the portion of Route 53 from the Parkway intersection to the
county line.)
The James Monroe Parkway would proceed south along 795 for 2.5
miles to the intersection with 627, and would continue straight
ahead 5.5 miles along Route 627 to its terminus at Carter's Bridge
on Route 20. This route is the north to south route on the east
side of Carter's Mountain and comparable to Route 20 along the west
side of the mountain. Although the James Monroe Parkway would be
longer than the Thomas Jefferson Parkway, this Course would provide
an entrance onto Route 20, which lessens the disparity of its lack
of immediate access from Interstate 64.

Much of this roadway has been upgraded significantly during
the past five years--paving of several miles of 627, refencing and
landscaping along more than four miles of right-of-way (sometimes
on one side, sometimes on both sides) by John Kluge, and litter
removal by the Monticello Ruri tan Club. As a result of these
improvements, more than half of the eight-mile James Monroe Parkway
already presents a parkway appearance. Designation of the Parkway
would help continue the conservation of the natural and historic
resources along this route.
Historic Justification
According to architectural historian and historic roads
scholar Ed Lay of the University of Virginia's School of
ArChitecture, the proposed James Monroe Parkway is composed of
routes which existed in the early 19th century and were frequently
travelled by Jefferson and Monroe as they visited such neighbors as
William Short at Indian Camp (now Morven), Champe and Maria Carter
at Blenheim, and Robert Carter at Redlands. To identify this
section ,of ,roadway with James Monroe's name seems historically
approprlate.
Economic Justification
While acknowledging that some individuals may have a
preference for a name other than James Monroe Parkway, I submit
that the disappointment wili be brief. Indeed, all but one of the
neighbors with whom I have spoken either preferred the James Monroe
Parkway designation or had no preference. On the other hand, we at
Ash Lawn-Highland have both an immediate and a permanent need for
the full James Monroe Parkway. This designation will provide equal
visibility for Monroe and Jefferson on Route 20, thereby increasing
awareness of Albemarle's rich history with residents and visitors
alike. Even if only ten more people visit Ash Lawn-Highland during
the next year because of the Parkway signage, those visits will
generate additional revenue to restore and maintain our self-
supporting museum property and more revenue for the county and
state coffers.
Logistical Justification
In terms of logistics, the James Monroe Parkway is an 8-mile,
geographically defined, straight-ahead road. As such, the James
Monroe Parkway is a logical extension of the Thomas Jefferson
Parkway. Both can be readily serviced by emergency vehicles.

You may wonder what Ash Lawn-Highland can offer in support of
its request beyond historic and economic concerns. The answer is
improved maintenance of our own almost one mile of frontage on each
side and the commitment to work with our neighbors and the
Department of Transportation to improve maintenance and to beautify
this already handsome eight-mile stretch of roadway.
In conclusion, let me point out that in almost 17 years of
ownership by the College of William and Mary, Ash Lawn-Highland
has made no request to the Board of Supervisors either for
financial support or for other considerations. At this time I do
earnestly request your endorsement of the James Monroe Parkway.

Dear Bob:
It is my understanding that the Board of Supervisors may be
deciding the fate of a proposal to name a road in honor of
President James Monroe. Having served as chairman of the E911
Road Naming Committee, I wish to express to you some of my
thoughts on the matter.
The issue of designating roads with names honoring Jefferson
and Monroe dominated two meetings of the committee. At the
conclusion it was the consensus that the committee was there not
to create names when pre-existing road names existed. It was also
the conclusion of the committee that the best way to honor both
presidents was to use names that they might have used, thus
perpetuating more of Albemarle County's diverse history.
Additionally, I believe we all felt that all road names
belong to the entire community of Albemarle and not just those
who presently reside along the various roads in the county. This
project was extremely time consuming as I have spent an average
of 20 hours a week driving the roads, talking with people and
doing intensive research so that I might present to the Board of
Supervisors the most accurate list of road names that I could. I
did not want to create names, but rather I wanted to officially
assign those names that had been used by those that preceded us.
I was disappointed with the designation of the Thomas
Jefferson Parkway, because it was not a historically used road
name and it is not a parkway. The committee never saw Dan
Jordan's letter and thus was not able to respond. Had I been
notified of the date on which the Board was scheduled to vote on
the road name list, I would have attended. I am not in favor of
changing additional road names just for the sake of having one
named after James Monroe. I believe the Board should either re-
adopt the committee's original recommendation or name the Rt. 53
to 795 to Ash Lawn-Highland the Jefferson/Monroe Parkway.
It was a pleasure serving on the E911 Road Naming Committee.

you will concerning the changing of adopted road names, It is my
understanding that changes, if any, will come straight from your
office and not from the Board of Supervisors.
Having received numerous calls on various road names and
their origins, I know of a few names for which you may have
received petitions. As I have not seen a listing of these
petitions I can not reflect on any particular proposed change,
However, I would like to emphasize that the names recommended by
the committee were done so with a lot of thought and effort. I
believe the committee felt that all road names belong to the
entire community of Albemarle and not just those who presently
reside along the various roads in the county and that we should
try and preserve as many of the old names as possible. We did not
want to create names, but rather we wanted to officially assign
those names that had been used by those that preceded us. Thus, I
strongly urge you to think long and hard about changing any name
just for the sake of changing it. In some cases I am sure the
petitions might contain a more historically accurate name and in
other cases the proposed new name may be based entirely on
falsehood.

RE: Road Naming Status Report
In response to your request for a status report on road naming, the
Planning Department has received ten requests for road name changes
submi tted by the November deadline. These requests are being
processed to verify the 50% or more signatures and to ensure the
proposed names are acceptable. Upon completion of this review,
staff will be able to administratively approve these requests
except there are two proposals requiring further action as follows:
(I) A petition proposes a name that is already in use. This
will need to be revised;
(2) Two petitions have been received for the same road, one
petition wants to retain the name, Broadaxe Road, the other
proposes a change to Payne Mountain Road. Verification is in
progress.
The only other road name issue is a request by the Board to review
options for recognizing President James Monroe. Staff's
recommendation is to add a James Monroe Parkway as reflected in the
attached report.
In summary, reviewing our past road naming practices and the new
policy, staff feels they need no further revisions. The process
uses reasonable criteria in making decisions on road names that are
considered fair and equitable for the citizens of the County while
meeting the needs of providing emergency services. While the
changes for the Thomas Jefferson Parkway and the James Monroe
Parkway were considered unique and did not follow established
procedure, staff emphasizes the need to allow no further exceptions
to your policy.

At the request of the Board of Supervisors, staff has
reviewed options for providing a road name designation for
President Monroe. While staff recognizes that this is an
exception to the procedures for road name changes adopted by
the Board of Supervisors on September 11, 1991 (see
Attachment A), staff recommends that no future exceptions to
the adopted procedures be made. Any and all future requests
for road name changes should adhere to the adopted
procedures and, therefore, be accompanied by a petition
signed by a majority of the landowners along such road.
staff has consulted with Carolyn Holmes, Executive Director
of Ash Lawn-Highland, Dan Jordan, Director of Monticello,
and George Howard, E911 Road Naming Committee Member
representing the scottsville Magisterial District regarding
the potential road name change.
Outlined below are the requests/suggestions submitted by the
individuals mentioned above followed by staff recommendations:
1. Attachment B outlines a request for the designation of
James Monroe Parkway submitted by Carolyn Holmes. The
James Monroe Parkway would begin at the intersection of
StHwy 53 and StHwy 795 (at Simeon), and continue south
on StHwy 795 and StHwy 627 to its intersection with
StHwy 20 (at Carters Bridge).

Carolyn Holmes agreed to limit the extent of the James
Monroe Parkway request to StHwy 795 from StHwy 53 (at
Simeon) to StHwy 627 provided that the Thomas Jefferson
Parkway stopped at StHwy 795. In her letter
(Attachment B), Carolyn Holmes stated, "Neither Mr.
Jordan nor I have any recommendations for the portion
of Route 53 from the Parkway intersection (at Simeon)
to the County line."
2. The request made by Dan Jordan was adopted by the Board
of Supervisors on September 11, 1991. The request was
for the designation of the Thomas Jefferson Parkway to
begin at the intersection of StHwy 53 and StHwy 20,
continuing east on StHwy 53 to its intersection with
StHwy 795 (at Simeon) at a minimum. When the road
names were adopted by the Board of Supervisors in
September, StHwy 53 was adopted as Thomas Jefferson
Parkway from StHwy 20 to the County line.
Dan Jordan was opposed to the Jefferson - Monroe
Parkway designation as is suggested below.
3. Attachment C outlines the suggestions made by George
Howard in an effort to provide a road name designation
for President Monroe. The suggestions include the
following:
A. Designating a Jefferson - Monroe Parkway to begin
at the intersection of StHwy 53 and StHwy 20,
continuing east on StHwy 53 to its intersection
with StHwy 795 ~t >imQQRt, then south on StHwy
795 to its intersection with StHwy 627.
Some residents on StHwy 627, including George
Howard, would prefer to retain the adopted Carters
Mountain Road designation rather than changing to
James Monroe Parkway.
B. Re-naming StHwy 53 from its intersection with 795
(at Simeon) to the County line from Thomas
Jefferson Parkway to Buck Island Road.
The E911 Road Naming Committee received five (5)
individual requests from residents to name StHwy
53 from StHwy 795 to the County line Buck Island
Road.
C. Re-naming StHwy 729 from its intersection with
StHwy 53 to its intersection with StHwy 618 from
Buck Island Road to Milton Road. This would
result in the continuation of Milton Road south of
StHwy 53. StHwy 729 north of StHwy 53 was
previously adopted by the Board of Supervisors in
September as Milton Road.
4. Staff recommends the following changes based on the
requests/suggestions received (see Attachment D for
existing road names and Attachment E for proposed road
name changes):
A. Thomas Jefferson Parkway - StHwy 53 from StHwy 20
to StHwy 795 (at Simeon);
B. James Monroe Parkway - StHwy 795 from StHwy 53 (at
Simeon) to StHwy 627;
C. Buck Island Road - StHwy 53 from StHwy 795 (at
Simeon) to the County line; and
D. Milton Road - StHwy 729 from StHwy 53 to StHwy 618.

I thought it prudent to update the Board on the progress of
the pond proposal at Henley Middle School.
Following the proposal letter sent to the Rivanna Water and
Sewage Authority, Mr. Eugene Potter, Director of Operations
contacted me by phone to inform me that his department was in
favor of the modified closure and is willing to participate
financially to accomplish the necessary work so long as two
requirements are met. The requirements are as follows:
1) The modified closure plan must be approv~d by
appropriate authorities within the county. The Rivanna
Water and Sewage Authority should be released from
liability after the modified closure is completed.
2) The modified closure plan should be submitted to The
State Department of Health and The Water Control Board
for approval.
I contacted Mr. Ed Bain concerning County approval and he
informed me that after discussion, the Board of Supervisors
verbally supported the pond idea.
Releasing Rivanna Sewer Authority from liability is not an
issue I have addressed. I assume that release will be granted
when the plan is formally approved, and the pond falls under
Board of Supervisor control.
Mr. Potter has agreed to submit a modified closure plan to
the proper state authorities. A copy of his letter to me is
attached. I personally contacted Mr. Jim Moore of The State
Department of Health and he is operating fully to push the
modified plan through the state bureaucracies.
I contacted Mr. Jim Bowling of the County Attorneys Office
in late November and inquired into any liability problems that
the bounty may have with the pond. I was told that liability
should not be an issue due to the fact that the county presently
has jurisdiction over several ponds as well as larger bodies of
water, and that because of the secluded location, the pond would
not be considered an "attractive nuisance".

Presently I have run into the first stumbling block in what
so far has been a very smooth process. On December 11, I spoke
with Mr. Al Reaser, and he informed me that he will support a
recommendation from The County Engineering Department that the
pond, when finished, be secured with a chain link fence. If this
requirement is followed it will destroy the purpose of having a
natural pond accessible to wildlife and students. A fence will
also intrude into the extensive Natural Area that has been
developed by Henley students and members of the Henley Outdoor
Club.
After speaking with Mr. Reaser, I again contacted Jim
Bowling and he informed me that the pond does not need to be
fenced, because it was not designed as a holding basin for run-
off and erosion control. I then contacted Ms. Jo Higgins
of the Engineering Department and was told that their
recommendation for fencing is to protect the department from
liability. The fence has now become a political issue and a
waiver must come from the Board of Supervisors. It is felt by me
and Mr. Bowling that the pond will pose no more of a liability
than it has for the last 20 years~ If a waiver can be granted,
Ms. Higgins will need a copy for her file and the matter will not
be pursued further. She was most cooperative. If'a waiver for
the fencing cannot be achieved then the project w~ll, have to be
abandoned due to costs, both financial and aesthetic.
I appreciate your cooperation and hope all issues can be
resolved in favor of this most worthwhile project.

This letter is in response to your November 11 letter concerning
the effluent polishing pond behind Henley Middle School. As
discussed with you on the telephone, the Authority has prepared and
had approved a closure plan for the abandoned wastewater treatment
facility. A copy of this is enclosed for your information.
I have discussed this matter with Jim Moore, District Engineer for
the Lexington Field Office of the Department of Health and he is
not aware of a statutory requirement that the pond be filled in,
al though he has determined that two regions of the State Water
Control Board have dealt with this matter differently. Mr. Moore
suggested that if a decision is made to do something other than
what was approved, that a modified closure plan be prepared and
submitted. I am agreeable to doing this at the appropriate time.
Rivanna does not have an interest in how the site is ultimately
used other than to be released from liability for closure. To that
end, Rivanna is willing to participate financially in a modified
closure plan, but will require a written release from the property
owner for any further liability.
Please let me know how you wish to proceed with this. I will be
happy to work with you towards our common objectives, but would
suggest setting some time frame within which to bring closure to
this matter.

Please amend the February 5, 1991 Brownsville closure plan to
include the following:
1. Any liquid removed from the polishing pond will be pumped into
the Crozet IS for transport and treatment at the Moores Creek
WWTP.
2. The polishing pond will be filled in with existing berm material
and graded to preclude any ponding.
3. The polishing pond received treated effluent from the
Brownsville WWTP prior to chlorination and discharge to Lickinghole
Creek. The Brownsville WWTP served Brownsville Elementary, Henley
Middle and Western Albemarle High schools plus approximately five
single family cottages in the Meadows retirement village.
Based on my knowledge of the flow sources and treatment operations
I do not believe the polishing pond contains any hazardous wastes.
The School Division has expressed a desire to have this site closed
out prior to the fall school session. Please call if any further
information is required.

The Authority wishes to assist Albemarle County Service Authority
in closing out the wastewater treatment facilities located at
Brownsville in Albemarle County.
The 0.06 MGD package treatment plant and effluent pplishing pond
were abandoned in 1986 when connection was made to the Crozet
Interceptor. The plant and pond were dewat~red into the
interceptor at that time. The proposed closure plan is as follows:
1. Remove from the site fo~ scrap, the inlet piping between the
comminutor box and steel structure, as well as the steel
structure and fencing.
2. Demolish and bury in place the concrete comminutor box,
effluent weir and concrete and block control building.
3. Regrade the effluent pond area to eliminate ponding.
All soil disturbing activity will be performed in accordance with
an approved soil erosion plan issued by the office of the Engineer,
Albemarle County.
The property on which these facilities are located belongs to the
Albemarle County School Board and is being used as a nature study
area. Please call if any further information is needed.

POLICY STATEMENT
The Planning District and member governments recognize the importance of a mix of vibrant
growing cities and preservation of rural areas. In order to maintain this balance, we support
expanded authority through enabling legislation to give local governments the tools to manage
growth. We support legislation which would encourage localities to work together on a regional

FINANCES
POLICY STATEMENT
The Planning District and its members recognize that financing government projects should be a
partnership between the state and localities. But we are aIanned at the decreasing level of support
from the state, while demands for services increase. Wzth our limited ability to raise funds, we are
unable to meet services required by our residents and those mandated by the state.
RECOMMENDATIONS
):{ Restore local funds committed through the state's portion of the recordation tax.
):{ Fund state mandates, starting with solid waste management and education.
):{ Provide equal taxing and borrowing power for counties similar to that of cities.
):{ Provide local governments with funds and/or taxing power for their infrastructure.
):{ Oppose any efforts to restrict the use of current local revenue sources.
n Expand local authority to generate additional revenue resources.

EDUCATION
POLICY STATEMENT
The Planning District and its members share the state S interest in educational excellence. Yet local
resources for funding education are limited and shrinking. Adequate state funding and equity needs
to be acheived for education in a way that does not diminish present funding levels.
RECOMMENDATIONS
):( Restore and increase state funding for standards of quality and all other
educational categorical mandates without reduction to other components of the
state budget.
):( Provide localities with funds and/or revenue sources for school construction and
equipment, and ensure literary funds are used solely for local school construction
and equipment.
):( Limit child care licensing to services for children under five years of age.
):( Oppose binding arbitration in grievance procedures for school board employees
mandates.

WASTE MANAGEMENT
POLICY STATEMENT
The Planning District and its member localities recognize the importance of reducing solid waste
through an integrated management program that stresses source reduction, reuse and recycling. But
the reality of implementing a program and meeting state mandates on landfills is costly. Therefore,
the state must do its share to help localities meet these mandates.
RECOMMENDATIONS
):{ Reevaluate Solid Waste guidelines and regulations for closure of existing landfills.
):{ Have state assume lead role in the development of markets for recyclables,
increased source reduction and reuse of materials.
):{ Fund state mandated laws and regulations regarding solid waste, particularly the
upgrading of landfills to standards.
):{ Prohibit the use of nonbiodegradable containers whenever safe, degradable
alternatives are available.
):{ Encourage development of recycling industries through financial incentives.
):{ Institute financial incentives for regional waste mangement solutions.
):{ Support legislation establishing a container deposit on bottles.
):{ Require state agencies and institutions to contribute their recyclables to the local
and regional waste stream.
):{ Expand authority granted to James City County to control the flow of solid waste to all
interested localities.

LOCAL GOVERNMENT STRUCTURE AND LAWS
POLICY STATEMENT
Since so many governmental actions need to take place at the localleve1, a strong local government
system is essentiaL To ensure these needs are being met, local governments must have the freedom
and tools to carry out their responsibilities.
RECOMMENDATIONS
):l Support relaxation of the Dillon rule, particularly in areas of finance and growth
management.
):l Strengthen sovereign immunity doctrine so that protection applies equally to all forms
of local government - counties, cities and school boards.
HOUSING
POllCY STATEMENT
The Planning District and its members believe all Vuginians, particularly those of low and moderate
income, should live in safe, decent, affordable housing.
RECOMMENDATIONS
):l Support low income housing initiatives by continuing state funding of the Housing
Partnership Fund.
):l Support efforts to maintain home ownership for at-risk population.
