Neher, Clerk, CMC ~~ ~~/ December 26, 1991 Agenda for Annual (Organizational) Meeting on January 2, 1992 Agenda Item No.6. The Code of Virginia, in Section 15.1-531, states that lithe books, records and accounts of the board of supervisors shall be deposited with their clerk and shall be open, without any charge, to the examination of all persons." Lettie E. Neher expresses a desire to be reappointed as Clerk with Ella W. Carey being re- appointed as Deputy Clerk. Of all employees and officers of Albemarle County, only the Clerk and Deputy Clerk are reappointed each year. Agenda Item No.7. Section 15.1-536 of the Code states that lithe first meeting held after the newly elected members of the governing body shall have qualified ... shall be known as the annual meeting, .... The days, times and places of regular meetings to be held during the ensuing twelve months shall be established at the annual meet- ing. Provided, however, that if the governing body subsequently shall prescribe any .... day or time other than that initially established, as the meeting day, place or time. the governing body shall pass a resolution as to such future meeting day, place or time and shall cause a copy of such resolution to be posted on the door of the courthouse and inserted in a newspaper having a general circulation in the county once a week for two successive weeks prior to the first such meeting at such other day, place or time. II The Board voted earlier in the year to change the January, 1992 meeting schedule to be January 2 (annual meeting), January 8 (public hearing on School Board members), January 15 (all day meeting) and January 22. Because of advertising requirements, no additional change can be made in the meeting schedule until February 1. Agenda Item No.8. Section 33.10 of the Zoning Ordinance states that the Board of Supervisors shall consider zoning text amendment petitions by property owners at specified intervals of six months. The dates set for these hearings have normally been in June and December. A motion is required to set these dates which are then advertised in the newspaper. Agenda Item No.9. Election of Chairman. The Board ELECTED David P. Bowerman as Chairman. Agenda Item No.5. Election of Vice-Chairman. The Board ELECTED Edward H. Bain, Jr., as Vice-Chairman. Agenda Item No.6. Appointment of Clerk and Deputy Clerk. The Board REAPPOINTED Lettie E. Neher as Clerk and Ella W. Carey as Deputy Clerk for calendar year 1992. Agenda Item No.7. Set Meeting Times, Dates and Places for Calendar Year 1992. The Board set the meeting times and dates as follows: first Wednesday of the month - 9:00 a.m., second Wednesday of the month - 7:00 p.m. and third Wednesday of the month - 7:00 p.m. The Clerk will advertise this change, as required by the Code. The Board specified June 10 and December 9, 1992, to hear zoning text amendment petitions from property owners. The Clerk will advertise this schedule, as required by Section 33.10.2 of the Zoning Ordinance. Agen~a Item No.9. Rules of Procedure, Adoption of. The Board READOPTED the Rules of Procedure. The Board ADOPTED a policy to continue the method of voting alphabetically, but beginning in January, 1992, to rotate down the list of names monthly so that each month the next person in alphabetic order will begin the voting. Agenda Item No. 10. Appointments. The Board will interview candidates for the at-large position on the Planning Commission on January 8, 1992, beginning at 4:00 p.m. The Board will interview candidates for the at-large position on the School Board on January 15, 1992. REAPPOINTED David Bowerman and APPOINTED Charles Martin to the Rivanna Park Committee REAPPOINTED Ed Bain and APPOINTED Forrest Marshall to the Scottsville Annexation Committee. REAPPOINTED Charlotte Humphris and David Bowerman to the Whitewood Road Park Committee. REAPPOINTED Theodore N. Gardner from the Scottsville District and Doris Davis from the White Hall District to the Board of Social Services, for a term to expire December 31, 1992. Requested the Clerk to find out if the Commonwealth's Attorney is interested in serving on the Community Corrections Resources Board and asked for a description of the function of this Board. Indicated that it would not consider applications received after the December 2, 1991, deadline for the vacancies on the School Board or Planning Commission. Agenda Item No. 11. It was the consensus of the Board that a representative of the unidentified Fortune 500 Company or the owner of the property make a presentation to the Board concerning the property on Route 29 North being considered for use by this company, at which time the Board may consider providing further directions to the staff. Bowerman was elected Chairman of the Board for calendar year 1992 and should receive the salary stipend reflective of this position (150/per month). Mr. Edward. H. Bain, Jr., was elected Vice-Chairman of the Board for calendar year 1992; however, that stipend is paid on a daily basis when he substitutes for the Chair. Appropriate forms will be sent to Personnel when such a payment is due. Mr. Forrest R. Marshall, Jr., is the new representative of the Scottsville District. His address is Route 6, Box 305-A, Charlottes- ville, VA, 22901. Social Security No. 226-44-0304. Birthdate: 04-02-36. It is my understanding that Personnel will contact him for orientation and to fill out appropriate personnel forms. Salary is $8820 per year beginning January 1, 1992. Mr. Charles S. Martin is the new representative of the Rivanna District. Mr. Martin, who was a member of the School Board during 1991, indicates that he does not want to change the current status on any of his personnel forms, therefore, please transfer his personnel information from the School Board to the Board of Super- visors as of January 1, 1992. His salary as a Board member will be $8820 per year. (Yes) (No) Form. 2 7/29/86 t RULES OF PROCEDURE ALBEMARLE COUNTY BOARD OF SUPERVISORS A. Officers 1. Chairman. The Board shall, at its first meeting after election, elect one of its number as Chairman, who, if present, shall preside at such meeting and at all other meetings during the term for which so elected. (Virginia Code Section 15.1-528) 2. Vice-Chairman. The Board shall, at its first meeting after election, also elect one of its number as Vice- Chairman, who shall preside at meetings in the absence of the Chairman and shall discharge any other duties of the Chairman during his absence or disability. (Virginia Code Section 15.1-528) 3. Term of Office. The Chairman and Vice-Chairman shall be elected for one-year terms; but either or both may be re-elected for one or more additional terms. B. Clerk and Deputy Clerks The Board shall, at its first meeting after election, desig- nate a Clerk and one or more Deputy Clerks, who shall serve at the pleasure of the Board and whose duties shall be those set forth by Virginia Code Sections 15.1-531 and 15.1-532 and resolution of the Board as adopted from time to time. C. Meetings 1. Annual Meeting. The first meeting held after the newly elected members of the Board shall have qualified, and the first meeting held in the corresponding month of each succeeding year shall be known as the annual meeting. At such annual meeting, the Board shall establish the days, times, and places for regular meetings of the Board for the ensuing twelve months. (Virginia Code Section 15.1-536) 2. Regular Meetings. Except?-s otherwise provided by law, the Board shall meet in regular session not less often than once each month upon such day or days as has been established. Provided, however, that the Board may subsequently establish different days, times, or places for such regular meetings by passing a resolution to that effect in accord with Virginia Code Section 15.1-536. Provided, also, that when the day established as a regular meeting day falls on a legal holiday, the meeting shall be held on the next following regular business day, without action of any kind by the Board. (Virginia Code Section 15.1-536) -1- , 3. Special Meetings. A special meeting of the Board shall be held when requested by two or more members thereof, such request to be made in writing, addressed to the Clerk of the Board, specifying the time and place of the meeting and the matters to be considered thereat. Upon receipt of such request, the Clerk shall transmit this information in writing to each member of the Board and to the County Attorney, by registered mail, not less than five days before the day of such meeting. Provided, that in lieu of registered mail, such notice may be served by the Sheriff of the County. Provided, further, that no matter not specified in the notice shall be considered at such meeting unless all members of the Board are present and agree to such action by a majority vote. (Virginia Code Section 15.1-538; Virginia Code Section 15.1-9.1:1) The Clerk shall also notify the general news media of the time and place of such meeting and the matters to be considered. D. Order of Business The agenda for all meetings shall be established by the Clerk of the Board in consultation with the Chairman, with the first two items on the agenda for each regular meeting of the Board being the pledge of allegiance and a moment for silent meditation. E. Quorum A majority of the members of the Board present at the time and place established for any regular or special meeting shall constitute a quorum for the purpose of adjourning such meeting from day to day or from time to time, but not beyond the time fixed for the next regular meeting. Nonetheless, you had the foresight, investment in, and love for Albemarle County and its approaches to areas of historical significance to support formation of the ARB. An initial and primary responsibility of the ARB was the development of Interim Guidelines. Those guidelines have helped to increase understanding of how the visual landscape of the entrance corridors impacts on tourists and potential investors, as well as on those of us who live here. The guidelines have also been of value to architects and planners in formulating designs that will enhance, rather than diminish the appearance of this locale. As a result of the guidelines, important aesthetic improvements have been made in projects such as "Toys R Us" and Virginia Oil Compay, and corridors such as Route 20 are being protected from unconstrained development. It has been an honor and priviledge to serve on the ARB, and, with particular thanks to Harry Porter, I have learned as much, if not more, than the applicants who have come before us. Therefore, I deeply regret that I must now resign from that position. After I read the 1992 schedule handed out at Monday's ARB meeting and conferred with my partner in New York, I realized my prior commitment to a grant project will obligate me to meetings and deadlines that preclude my attendance at the next three ARB sessions, and I see no respite until early May. Thank you for your belief in my artistic judgement and for the opportunity to contribute my ideas and evaluations.
