Dear Ms. Scroggins:
In response to your request for a Letter of Zoning Compliance for the above
referenced Property, please be advised of the following for TMP 06000-00-00-04007; University
Heights Apartments 251-269 Colonnade Drive, Charlottesville, VA Albemarle County
(the "Property")
The Property is zoned R-15, Residential under Chapter 18 of the Albemarle County Code
(the "Zoning Ordinance"), lies within the boundaries of Albemarle County, Virginia (the
"County"), and is located in the Entrance Corridor Overlay District (EC) and the Steep Slope
Overlay District. This is not a Planned Unit Development. The R-15 zoning district permits
the current use of the property for Multiple -family dwellings which may include a clubhouse
as a matter by right.
• The properties surrounding University Heights Apartments are zoned as follows: North: HC,
Highway Commercial; South: R-15, Residential; East: City of Charlottesville; West: R-1,
Residential and PRD, Planned Residential Development.
• There have been multiple determinations that the Property is considered legally
nonconforming. Unfortunately these determinations do not state what the nonconformity is,
they only state that the site was developed prior to there being a Zoning Ordinance in
Albemarle County. That statement is true. The current use of the Property is considered a
conforming use. It is determined that the nonconformity for this Property is the density.
The Property consists of 4.20 acres which would permit 63 dwelling units at 15 dwelling
units per acre (du/ac). The Property appears to have 113 dwelling units, thus 50 more units
than the district permits. The number of units have been reduced from 116 units to 113
units or 27.61 du/ac to 26.90 du/ac.
In the event of casualty or destruction, in whole or in part, the improvements on the
Property may be rebuilt to their current specifications, subject to the building code
requirements.
-• There are no records of an open zoning violation filed on the Property.

• The Property is not subject to an approved site plan. Any change in or expansion of the
use that requires additional parking under Section 4.12 of the Zoning Ordinance; additional
ingress/egress or alteration of existing ingress/egress is required by the Virginia
Department of Transportation based on the intensification of the use; or additional
ingress/egress or the alteration of existing ingress/egress is proposed by the developer will
require approval of a site plan by Albemarle County Community Development according to
Section 32 of the Zoning Ordinance.
