Subject: SUB201500163— Birckhead - Family Division
The County of Albemarle Division of Current Development will grant or recommend approval of the
Family Subdivision plat referenced above once the following comments have been addressed: [Each
comment is preceded by the applicable reference, which is to the Subdivision/Zoning Ordinances unless
otherwise specified.]
1. [Comment] Tier 2 Groundwater Study. All plats showing lots less than 21 acres require this study be
completed. Please submit the required $330 fee.
2. [14- 303(E), 14 -412] It appears Lot 1 is attempting to gain its frontage from the proposed 30' access
easement; however, in order for this easement to provide the required frontage the easement must be
for a Private Street. Thus the proposed 30' access easement shall be relabeled to "New 30' Private
Street Easement". Also, the easement holder(s) shall be identified on the plat.
3. [14- 302(B)8, 18 -10.4] Setbacks. The setbacks listed on sheet 2 are incorrect and shall be revised.
Rural Area (RA) setbacks are as follows:
Front (existing public roads) — 75'
Front (internal private roads) — 25'
Side — 25'
Rear — 35'
4. [14- 412(A)4] Streets serving family subdivisions. Each private street authorized to serve a family
subdivision under section 14- 232(B)(1) shall satisfy the following: ... (ii) the surveyor shall include
the following wording on the plat: "The existing and /or proposed right -of -way is of adequate width
and horizontal and vertical alignment to accommodate a travelway passable by ordinary passenger
vehicles in all but temporary extreme weather conditions, together with area adequate for
maintenance of the travelway, as required by section 14 -412 of the Albemarle County Code. " Revise
plat to include the above note.
[14- 302(A)(10)] Right offurther division. Per my research on the division rights for the property, it
appears there are 3 development rights associated with this parcel. As the applicant has chosen to
divide the land, one of the three development rights are being lost based on the proposed acreages of
each lot. The applicant can either leave it as is and loose a development right, or the lots can be
revised so that one of them is a minimum of 4 acres at which point it can retain the would be lost
development right.
For example, if the lots were revised so that the parcel with the existing house on it was 4 acres the
dev right note would be: "Lot I is assigned I development right and may not be further divided. The
residue of Tax Map /Parcel 89 -23B8 is retaining 2 development right and may be further divided".
6. [Comment] When the plat is revised assure the notary statement is accompanied by either the
notary's designated number or their seal.
7. [14- 302(B)(1)] General Information. When the plat is revised, please provide the date of the last
revision on the plat.
8. [14 -309 & 14 -310] Soil evaluations; Health Director Approval of wells and septic systems.
Approval by the Health Dept is required before the plat can be approved. Soil work was sent to the
HD on 10 -5 -15. Pending results.
9. [14 -212 and 14- 212(B)]] Affidavit & conditions of approval. The County has received the required
Affidavit and Declaration from the applicant. These documents have been provided to the County
Attorney for his review on 10 -5 -15. Approval by the County Attorney is required before the plat can
be approved. Pending his review/ approval.
