The plat appears to be in agreement with the road plans for this phase of Old Trail. However,in an attempt to prevent the need for resubmittal of the road plans,the approval letter for the road plans dated April 14,2014 indicated that the right-of-way for Ashlar Avenue needed to be revised so that the right-of-way is a minimum of 3 feet behind the back of curb rather than the 39' of right-of-way shown. We pared it back to just the lots that are going to be on Lot A plat. We will have another plat for this lot to create the Claremont r-o-w and alley easements. I think the agreements are in acceptable form, as long as we're comfortable that the improvements are or can be adequately bonded. I appreciate that County Code§ 17-414(F) gives the County the right to collect from the owner the difference if the amount of the reasonable cost of the conservation action exceeds the amount of the security held. But I see that as a last resort. It's far better to be adequately bonded in the first place. Unless I'm missing something, I've not yet seen where the County can raise the bond requirement on an existing project.
