(VSB No.48262) EXEMPTED FROM RECORDATION TAXES Woods Rogers PLC UNDER THE VIRGINIA CODE(1950),AS 123 East Main Street, 56 Floor AMENDED,SECTION 58.1-811(C)(3) Charlottesville,Virginia 22902 Albemarle County Portion of TMP#055E0-01-00-000A1 This DEED OF VACATION made this 20th day of November 2014, by and between the COUNTY OF ALBEMARLE, VIRGINIA, Grantor, party of the first part (referred to herein as "Albemarle County"); MARCH MOUNTAIN PROPERTIES, L.L.C., a Virginia limited liability company, a Grantor and Grantee, party of the second part, whose address is 1005 Heathercroft Circle, Suite 100, Crozet, Virginia 22932 (referred to herein as "March Mountain"); and JA-ZAN LLC, a Grantor and Grantee, party of the third part (referred to herein as "Ja- Zan"). WITNESSETH: WHEREAS, March Mountain and Ja-Zan caused to be recorded that certain subdivision plat dated March 20, 2014, last revised November 7, 2014, made by Roudabush, Gale & Associates, Inc., entitled "Subdivision Plat Blocks 1B and 3C Old Trail Village, Tax Map 55E1 Parcels C, E and Al White Hall Magisterial District Albemarle County, Virginia" recorded in the Clerk's Office of the Circuit Court of Albemarle County, Virginia immediately prior hereto (the "Subdivision Plat"); being portions of the same property conveyed to March Mountain by deed dated June 3, 2002, of record in the Clerk's Office of the Circuit Court of Albemarle County, Virginia in Deed Book 2233, page 389, and to Ja-Zan by deed dated September 2, 2009, of record in the aforesaid Clerk's Office in Deed Book 3796, page 405; 04817-5505-9994-1} WHEREAS, the lots in Old Trail are served by public streets, including among others, Ashlar Avenue (formerly Brookley Drive), a forty three foot (43') right of way as more particularly shown on the aforesaid Subdivision Plat; WHEREAS, the streets shown on the Subdivision Plat have not yet been accepted into the Commonwealth of Virginia secondary road system; WHEREAS, March Mountain and Ja-Zan desire that Albemarle County vacate portions of Ashlar Avenue, which portions are depicted as Parcels B, G, F, H, L, and J on the Subdivision Plat; and WHEREAS, Albemarle County has agreed to vacate and release all its right, title and interest in and to Parcel B containing 0.0042 acre, Parcel G containing 0.0066 acre, Parcel F containing 0.0199 acre, Parcel H containing 0.0043 acre, Parcel L containing 0.0066 acre, and Parcel J containing 0.0193 acre, which parcels are more particularly shown on the Subdivision Plat. NOW, THEREFORE, for and in consideration of the sum of TEN DOLLARS ($10.00), cash in hand paid and other good and valuable consideration, Albemarle County does hereby RELEASE, QUITCLAIM, VACATE and ABANDON unto Ja-Zan, all its right, title and interest in and to Parcel B containing 0.0042 acre, Parcel G containing 0.0066 acre, and Parcel F containing 0.0199 acre, which parcels are to be added to and combined with Ja-Zan's existing property as shown on the Subdivision Plat; and Albemarle County does further RELEASE, QUITCLAIM, VACATE and ABANDON unto March Mountain all its right, title and interest in and to Parcel H containing 0.0043 acre, Parcel L containing 0.0066 acre, and Parcel J containing 0.0193 acre, which parcels are to be added to and combined with March Mountain's existing property as shown on the Subdivision Plat. {{4817-5505-9994-1} 2 March Mountain and Ja-Zan, being all the lot owners immediately adjoining Ashlar Avenue as shown on the aforesaid Subdivision Plat,join in this deed for the sole purpose of consenting to the vacation contained herein pursuant to Virginia Code Section 15.2-2272(1).
