Subject: SUB 201500181 Flanagan — Boundary Line Adjustment
The County of Albemarle Planning Division will grant or recommend approval of the Boundary Line Adjustment
Plat referenced above once the following comments have been addressed: [Each comment is preceded by the
applicable reference, which is to the Subdivision /Zoning Ordinances unless otherwise specified.]
1. [14 -403] Each lot within a subdivision shall have frontage on an existing or proposed street. With the
proposed boundary line adjustment, TMP 85 -18A3 appears to lose its street frontage. In this case, the
20' access easement can be upgraded to a 30' private street easement to provide frontage.
2. [4.6.1] For a lot located at the end of an access easement, frontage shall not be less than the full width
of such easement (this would be a minimum of 30' if the above mentioned private street is provided).
3. [14 -317] If a private street is proposed, provide a maintenance agreement for review by the County
Attorney. A private street maintenance agreement template can be found here.
4. [14- 302(A)(10)] State the number of development rights available for each parcel within the
development rights note (see checklist or this section of the ordinance for required language).
5. [14- 302(A)(9)] According to GIS it TMP 85 -18A2 does not appear to contain a building site that
complies with section 4.2.1. If building site exists, please provide an exhibit showing the 30,000 sq. ft.
rectangular building site for staff to review. Boundary line adjustments are permitted on non-
conforming lots (section 6.4); however, it should be noted on the plat that TMP 85 -18A2 does not
currently contain a building site complying with 4.2.1 and that the BLA does not make the
nonconforming lot more nonconforming.
6. [14- 302(B)(7)] Amend note 8 to state that the parcels lie within a water supply watershed.
7. [14- 212.1] BLA plats shall not involve the relocation or alteration of any streets, alleys, or easements
for public passage. If a private street is proposed this will need to be processed as an easement plat.
Please fill out the easement plat application and pay an additional fee to cover the easement plat.
Easement plats carry a fee of $527 ($327 still owed less the $200 already paid for the BLA).
