HomeMy WebLinkAboutLOD200400049 Letter of Determination 2004-04-05April 5, 2004 Kathi Barrang 3 Old Farm Road Charlottesville, VA 22903-4725 RE: Tax Map 076CO-00-OB-OOIAO and 076CO-00-OB-OO1B0 Dear Ms. Barrang: The Bellair Owners Association has asked for a clarification of the status of your property located at the entrance of Bellair. This letter is to advise you that the property identified as Parcels I and 1B on Tax Map 76C (B) is one parcel separated by the relocated Canterbury Road. The separate parcel numbers were assigned on the tax map in error. This finding is based on consultations with the County Attorney, the Zoning Administrator, and staff of the Real Estate Department as well as a review of the plat by Roger W. Ray dated January 11, 2001. This property was physically separated when Canterbury Road was relocated. The relocated road and new property boundary are shown on a survey made by Roger W. Ray and Assoc., Inc, dated January 11, 2001 and recorded in Deed Book 2004, page 178. Roger W. Ray's plat is labeled a boundary survey. While the plat shows the acreage of each portion of the property, it identifies each one as Parcel IA. Likewise, the Certificate of Plat recorded with the plat identifies the plat as a boundary survey, not a subdivision plat. This parcel can only be divided into separate legal parcels by a subdivision plat that is approved as such by the County. Please be aware that it appears that it may be possible to subdivide this parcel in accord with the applicable regulations. The property is zoned Residential - R-1 and contains 2.755 acres. The minimum lot size in this district is 45,000 square feet. The property is in the Jurisdictional Area for both public water and public sewer. The property is not in a reservoir watershed with the result that there are no required buffers along the drainage stream on the property.
