Dear Mr. and Mrs. McRaven:
This letter is a confirmation of both the description of development rights noted on the recorded
plat in Deed Book 1373 Page 412 and the decision made by County staff on April 13, 2006
regarding the aforementioned plat. These were decisions that have already been made, have
never been challenged or appealed and that you as property owners have relied upon for
almost twenty years since the recordation of the aforementioned plat. This letter is not an official
determination of development rights only a restatement of previous decisions regarding this
property.

Dear Ms. McRaven:
You have asked for an interpretation of the notes regarding the development rights on the plat
that created the referenced parcel. This letter is based on the plat of record in Deed Book 1370,
page 412. My conclusions are not based on an analysis of prior deeds. The portion of the
property designated as Parcel X, has five theoretical development rights derived from Tax Map
94, Parcel 2.1. These development rights allow the creation of five lots, containing a minimum of
two acres, in this area, provided all other regulations are met. The portion of the property
designated as Parcel Y, derived from Tax Map 94, Parcel 25 contains zero development rights.
The residue of the entire property not used for the creation of development right lots could create
as many as four additional parcels containing a minimum of twenty-one acres each. Therefore,
the parcel has the potential to create a maximum of nine lots. Please be aware that the total
aggregate acreage devoted to lots that are created with development rights shall not exceed 31
acres. The regulations contained In Section 10,3 of the zoning ordinance that govern by right
development in the Rural Area zoning district are enclosed.
The plat contains these notes which are provided here for reference.

10,3 APPLICATION OF REG — AT(, , rS FOR DEVELOPMENT BY RIGS,•_,..% \1'
The following provisions shall apply to any parcel of record at 5:15 p.m,, the tenth day of
December, 1980 (reference 6,5), (Amended 11- 8-89)
10.3.1 CONVENTIONAL DEVELOPMENT (Amended 11-8-89; 6-14-00)
Regulations in section 10,5 governing development by right shall apply to the division of a parcel
into five (5) or fewer lots of less than twenty-one (21) acres in area and to the location of five (5)
or fewer dwelling units on any parcel in existence at the time of adoption of this ordinance
(reference section 13), The aggregate acreage devoted to such lots or development shall not
exceed thirty-one (3 1) acres, except in such case where this aggregate acreage limitation is
precluded by other provisions of this ordinance. The second sentence of this provision shall not be
applicable to land divided between the effective date of this ordinance (reference section 1.3) and
November 8, 1989, (Amended 11.8-89; 9-9-92; 6-14-00)
10.3.2 In addition to the foregoing, there shall be permitted by right any division of land into parcels each
of which shall be twenty-one (21) acres or more in area. No such parcel shall be included in
determining the number of parcels which may be created by right pursuant to section 10,3.1;
provided that (a) no such division shall affect the number of parcels which may be divided
pursuant to section 10.3.1; (b) there may be located not more than one (1) dwelling unit on any
parcel created pursuant to this section; (c) at the time of any such division, the owner of the parcel
so divided shall designate the number of parcels into which each parcel so divided may be further
divided pursuant to section 10.3.1 together with aggregate acreage limitations in accordance with
section 103.1; and (d) no such division shall increase the number of parcels which may b6 created
pursuant to section 10.3, 1, (Amended 94-92)
