Subject: SUB 201500189 Travis Liburn Bailey —Two lot
The County of Albemarle Planning Division will grant or recommend approval of the two lot subdivision plat
referenced above once the following comments have been addressed: [Each comment is preceded by the
applicable reference, which is to the Subdivision /Zoning Ordinances unless otherwise specified.]
1. [14 -403] New Lot 1 and the residue of TMP 17 -13 are required to have frontage on an existing or
proposed street. The new 30' private ingress /egress easement can be labeled as a private street to
provide frontage for New Lot 1. Private streets serving 3 or more lots require Planning Commission
approval. Submit a request for authorization of private street in accordance with Section 14 -234.
2. [14 -317] If a private street is proposed provide an instrument evidencing maintenance of the private
street for review by the County Attorney.
3. [14- 302(A)(5)] Free Union Road right -of -way should be labeled "dedicated to public use" on plat.
4. [14- 302(A)(10)] Please explain where New Lot 1 is deriving its development rights. If it is deriving all
three development rights from TMP 17 -13, then the residue of 17 -13 should only have two
development rights. If it is deriving two development rights from TMP 17 -13 and one from TMP 17 -14,
then the portion of TMP 17 -14 that is to be combined with New Lot 1 must be at least 2 acres and
must contain a building site (any future division derived from such a development right would be
required to be within the original boundaries of TMP 17 -14).
5. [14- 302(A)(10)] The sum of development rights derived from TMP 17 -13, when further divided, shall
not total more than 31 acres. Revise note accordingly.
6. [14- 302(B)(8)] Front setback for lots fronting on internal private streets is 25 feet. Revise setback note.
7. [14 -303] Amend consent to division note to match language in ordinance (also on checklist).
8. [14- 303(C)] Provide bearing and distance for boundary line between Area E and TMP 17 -14.
9. [14 -310 & 14 -4161 Current Health Department approval for the proposed subdivision is required.
Provide soils data for all proposed lots except residue of TMP 17 -13.
10. [Comment] The plat has been sent to VDOT for review. VDOT comments, if any, will be forwarded
upon receipt.
