The fourth recital refers to a "new or existing 25 foot-wide easement" but the plat shows a "new 30 foot private street." 2. The deed book and page number references your property as it exists now (11.34 acres) and not how it will exist at the time the Two-lot plat and this agreement are recorded (at that point, it will be two pieces—one five acre piece and one 6.34 acre piece) and there will be an updated DB and Page number to show. For#1,the agreement needs to reflect what the plat shows (a new 30 foot private street). The plat can show a reduction to 25 feet, but it must be labeled a "private street"so that Lot 2 can technically have frontage. For#2,you can leave the space blank(like this: " ") and hand-write in the updated DB and Page number once the Rural Division has been recorded. I can inform the County Attorney's office that this is your plan before they do their review. Please make these edits and I'll transmit the draft agreement for County Attorney approval. Thanks, J.T. This document will be recorded with the Two-lot division where the private street is being created. Please fill it out and send me a copy so that I can get it reviewed by the County Attorney's office. You don't need to submit a signed and notarized copy for this review, but we will need a signed and notarized copy of the final version when the plat is submitted for County signature. Keep in mind that a Two-lot division will require approval from VDOT, VDH, the County Attorney's office for a private street maintenance agreement and possibly the Engineering Division, so it may take a little bit longer than the Rural Division. You can use the attached template to prepare a draft of the private street maintenance agreement.
