This project is denied. The rationale is given in the comments below. The VSMP application content requirements can be found in County Code section 17 -401. A. Stormwater Pollution Prevention Plan ( SWPPP) The SWPPP content requirements can be found in County Code section 17 -405. A SWPPP must contain (1) a PPP, (2) an ESCP, (3) a SWMP, and (4) any TMDL measures necessary. 1. Appears adequately addressed at this time. B. Pollution Prevention Plan (PPP) The PPP content requirements can be found in County Code section 17 -404. 1. Appears adequately addressed at this time. C. Stormwater Management Plan (SWMP) VSMP Regulation 9VAC25- 870 -108 requires the VSMP authority to approve or disapprove a SWMP. This plan is approved, and the reasons are provided in the comments below. The stormwater management plan content requirements can be found in County Code section 17 -403. 1. Gabion Basket is not approved as replacement for standard outlet structure for basin. Excavation of dam for pipe installation is approximately the same as for gabion basket, however gabion basket after installation will have "piping" along sides of excavated area which could lead to a dam failure. The soil around a pipe can be compacted with less chance of "piping" around structure. A concrete cradle could be installed for better compaction around pipe. Comment appears adequately addressed at this time. 2. VRRM Spread sheet was not found in submittal package. Please submit VRRM Spread sheet for SWM review. Comment appears adequately addressed at this time. 3. The nutrient credit purchase will need to be approved by the County Attorney's Office prior to Engineering Review Comments Page 2 of 3 final plan acceptance. Please have the following information added to the documents: Documentation of Nutrient Credits required by the County of Albemarle 1. Owner of the parcel must provide a copy of the executed Agreement for Purchase and Sale of Nutrient Offset Credits and a copy of the Affidavit of Phosphorus Credit Sale. The following information is required in the affidavit: a. Owner's Name b. Project Description as listed in the plan submitted to the County of Albemarle c. Location/Address of the project d. Tax Map and Parcel e. HUC Code 2. If ownership of the property is in the name of any type of legal entity or organization including, but not limited to the name of corporation, partnership, limited liability company, trust, association, etc., documents acceptable to the County must be submitted certifying that the person that executed the agreement and the affidavit has the authority to do so. D. Erosion and Sediment Control Plan (ESCP) Virginia Code §62.1- 44.15:55 requires the VESCP authority to approve or disapprove an ESCP. This plan is disapproved, and the reasons are provided in the comments below. The erosion control plan content requirements can be found in County Code section 17 -402. 1. Gabion Baskets are not approved for sediment basin outlet. See comment above. Gabion Baskets have been replaced with a riser and barrel pipe. The Calculations for the sediment basin do not match the plan view and details. Please make them congruent. 2. Phase 3 sediment trap will require armoring across filled basin area until area is stabilized. Comment does not appear adequately addressed at this time. The plan should show channel armoring from the new outlet weir to the end of the fill material or to established vegetation as delineated in the VESCH page V -99, (Channel Lining design). Concentrated water should never be discharged overfill material. If discharge must be directed overfill material, then a liner and armoring will be installed to prevent erosion. 3. Silt fence is shown inside proposed grading on the Northeast side of the site and will need to be adjusted to protect all proposed grading. Comment appears adequately addressed at this time. However, silt fence shown down slopes is a diversion and doesn't work as silt fence is intended. The concentration of flow down the length of the silt fence may cause erosion of both the silt fence and the outlet/discharge point of the fence. Silt fence down slopes should be either removed or replaced with a diversion if needed to protect the site work. 4. Inlet 2a will need to be blocked to prevent sediment entering the system and by- passing the protective measures. Culvert inlet protection could be added to the plan per VESCH Std. & Spec. 3.08, (Culvert Inlet Protection). 5. Structures ex4, ex4A, 3, 2, and 5A will need to be blocked to prevent sediment entering the system or Inlet Protection will be shown on the plan sheets. 6. There appears to be an extra inlet protection near ex2A that should be removed from the plans. 7. Please show all inlets with protection on phase III E &SC plan. Additional erosion and sediment control measures will be required due to existing parking and open businesses as part of the site work. The "Operator" shall coordinate with the VSMP inspector to Engineering Review Comments Page 3 of 3 maintain a clean and adequately protected site per Virginia DEQ requirements. Process; After approval, plans will need to be bonded. The bonding process is begun by submitting a bond estimate request form and fee to the Department of Community Development. One of the plan reviewers will prepare estimates and check parcel and easement information based on the approved plans. The County's Management Analyst will prepare bond agreement forms, which will need to be completed by the owner and submitted along with cash, certificates or sureties for the amounts specified. The agreements will need to be approved and signed by the County Attorney and County Engineer. This may take 2 -4 weeks to obtain all the correct signatures and forms. Stormwater Management Facilities Maintenance agreements will also need to be completed and recorded. The County's Management Analyst or other staff will prepare the forms and check for ownership and signature information. The completed forms will need to be submitted along with court recording fees. After bonding and agreements are complete, county staff will need to enter project information in a DEQ database for state application processing. DEQ will review the application information based on local VSMP authority approval. At this time, the DEQ portion of the application fees will need to be paid directly to the state. For fastest processing, this is done electronically with the emails provided on the application. DEQ should notify applicants with instructions on how to pay fees. When DEQ approves the application, they will issue a permit coverage letter. This should be copied to the county. After DEQ coverage is issued, via the coverage letter, the County can hold a pre - construction conference. Applicants will need to complete the request for a pre - construction conference form, and pay the remainder of the application fee. The form identifies the contractor and responsible land disturber, and the fee remaining to be paid. This will be checked by county staff, and upon approval, a pre - construction conference will be scheduled with the County inspector. At the pre - construction conference, should everything proceed satisfactorily, a joint VSMP and grading permit will be issued by the County so that work may begin.
