Roger and Brian,
I reviewed the notes from our pre-app discussion with the rest of the Planning Division this afternoon. In considering
whether or not Section 14-404(under current Ordinance language)would apply to a two-lot division on TMP 31-59, I
neglected to consider Section 14-207(E)(5). The map below shows that TMP 31-59 does lie on a "major rural road"
section and I believe a division of this parcel would result in a lot having less than 500 feet of frontage on Buck Mountain
Road. Therefore, I believe Section 404 does apply.
If my estimate on the amount of frontage is correct,then a 404 waiver would be needed to keep the existing entrance
while also creating a new street to serve additional lot(s) on the residue. I confirmed the fee for this waiver would be
$830 under 14-203(H)(1).
I also received some suggestions about the best information to include in the waiver application beyond the
considerations listed in 404(D)(2). In addition to the amount of overall additional impervious surface and fill required,
information about when the dwelling was originally built, as well as the location of the well and drainfields would be
helpful.
It was also suggested that I confirm your contact at VDOT was either Troy Austin or Shelly Plaster.
Finally, Bill gave me more information about the text amendment that will address Section 404. Right now, it is set to go
to public hearing with the Planning Commission on December 16th and then it's tentatively set to go to the Board in
February. The amendment will request that any plats currently under review have a 60 or 90 day approval window
beyond the date of adoption by the Board.
I've attached the latest subdivision submission schedule for the rest of the year and 2015.
