I've discussed it with the County Engineer and the Building Official. No mitigation plan will be required in this case and no demolition permit is required when just a portion of an existing building is removed. If any work is required to stabilize the remaining structure,then the contractor may want to double-check with our Inspections Division if any permit is needed. Once the work is complete, please revise the plat to show that the remaining structure meets the 6' side setback for this area. Thanks for your attention on getting this remedied. J.T. The part that encroaches the property line is essentially the "shed" located at the end of the barn structure by way of a lean-to style roof. By all appearances it looks like the quickest way to correct the encroachment is to remove the shed and lean-to. The shed is on concrete or stacked block piers,as you can see in the one picture. In our conversation you raised the concern as to any impact to the stream/stream buffer. I am thinking the contractor will put up silt fence between the barn and stream. Then once they cut or sever any structural ties between the shed and barn,they will use a back hoe to pull or rake the structure down and away from the stream. From there the debris will be hauled off. The concrete piers will likely remain, so as not to have any actual earthwork involved. I approximate the structure to be removed to be a little less than 400 square feet. So I am unsure as to whether or not any sort of demolition permit, or any other permit will be required. One question though -- Lot H17-R is 23.11 acres and has one development right. This enables it to create a max 2.11 acre lot, but not anything larger without another development right for the remainder of H17-R. Under this design, will H17-R become 16.389 acres? If so, can a development right from another lot be allocated for it? There is a section of the Subdivision Ordinance that talks about lot shape. It says: Sec. 14-402 Lot shape. 1 Each lot within a subdivision shall be of 'shape which provides a satisfactory and de arable building site, and shall otherwise be at least the minimum lot width allowed by the applicable provisions of the zoning ordinance. No lot shall contain peculiarly shaped elongations designed solely to provide the required square footage of area or frontage on a street.All portions of each lot shall be contiguous. This section is somewhat subjective so I got feedback from others for a better understanding of how we've administered this section over time. All of the feedback I received was that this design does have a "peculiarly shaped elongations designed solely to provide....frontage on a street." Below is my response to Ed when he originally asked me about this area. Would you ever consider adding the area hatched in the photo below to address Section 14-402? J.T. Campbell' Subject: RE: Bundoran Farm Hey Ed, 3 Apologies for the slow reply. Yes, a two-lot division is the way to go. The only drawback is that staff cannot administratively approve the new 30' private street for this lot--it would have to be approved by the Planning Commission. The new 2+ac. lot needs a private street (as opposed to an access easement)to give it frontage and because it would be connecting to another private street(Hightop Drive) before it reaches the public street, it must be authorized by the Planning Commission. I believe the fee breakdown would be$540 for the two-lot division, $330 for Tier 2 Groundwater Review and $670 for the authorization of the private street. A justification for the private street would need to be included with the application and plat as described in 14-234. Feel free to give me a call if you have any questions. J.T. Campbell [mailto:ECampbelk roudabush.com] Sent: Tuesday, October 28, 2014 9:59 AM To: Johnathan Newberry Subject: Bundoran Farm JT, I have a question, Bundoran just transferred a development right to Lot H17 (the recent BLA plat H3-H4).They are trying to come up with a plan to use that right that would not involve a lot of property line changes.They have two good building sites on H17.The new site which would use the added development right is located in the rear of Lot H17 near the existing airplane hangar. I have advised them that it is my understanding that they could do a front-back division creating a 2+Ac. parcel which would be accessed by a new 30' Access Easement across Lot H17. Before I get too far into this I want to be sure that is a feasible solution. Can you let me know what you think? We would like to take lot Al, (23.10 ac)and create a new lot of approx. 5 ac. We would have to assign development rights because both lots would then be below 21 acres. We need to pick up the 150 of street frontage so that is why we have the long strip connecting to the road. I believe Ed Campbell sent you a variation of this a couple of weeks ago.
