If stream-ward edge of private sanitary sewer easement on TMP 56-67 is located 100' or more from Parrott Branch, Engineering has no objections. No (off-site) mitigation is required if there is no off-site stream buffer impact. Please revise site plan and easement plat to show stream buffer and revised location of proposed private sanitary sewer easement. Thank you. We were told a long time ago and I don't have anything to back it up, but I wouldn't have done it if it was wrong, to put the sewer where we have it. It's right on the edge of the 100' buffer. Project proposes on-site and off-site stream buffer impacts. Focus of VSMP review was on-site impacts. Off-site stream buffer is not shown on VSMP plan sheets. All buffer impacts should have been considered during VSMP Application review. It is my fault that they were not. 2. On-site impacts were discussed in two VSMP comment letters. Site considerations, SWM redesign limiting several facilities' stream buffer impact, complete replacement of existing 30" line under Parkview Drive, and design response to SWM#3, taken together, are sufficient response to this comment. Adhere to site landscaping plant schedule and stream buffer mitigation plant schedule, Option 1(A), C6-01." 3. Exemption from duties to "retain, establish, or manage a stream buffer" (17-602.B.): Proposed 20' and Variable-width Private Sanitary Sewer Easement crosses TMP 56-67. Proposed easement is within heavily-wooded stream buffer(image below). GIS data indicates a number of possible alignments appear to exist beyond Parrot Branch stream buffer on TMP 56-67. 4. Argument: only alternative: Necessity of private sanitary sewer in location proposed on TMP 56-67 should rise to level of project-cancelling effect. That is: Owner of TMP 56-67 (Beaver Hill Creek Corp) has denied Applicant request for alternative alignments across TMP 56-67 that avoid 100' buffer, without which connection to existing RWSA system is not possible, without which proposed Emerson Commons development(TMP 56-67A) is not possible. We need corroborating statements. 5. Although a portion of proposed sanitary easement on 56-67 is public, easement within 100' stream buffer appears to be private, and not exempt from duty to retain, establish, or manage a stream buffer. This comment applies to SUB2015-00027; SDP2008-00074. WPO201400038 (VSMP permit) is approved. It is not too late, however,to comment relative to Site Plan and Easement Plat(SDP2008-00074/ SUB2015-00027). 6. GIS photometric data alone raises questions concerning proposed location/alignment of private sanitary sewer easement on TMP 56-67. 7. We recognize Emerson Commons will serve multiple dwellings. Sanitary line on TMP 56-67 is a force main that may more nearly resemble a public system than a private one. Nevertheless, authority to waive stream buffer avoidance and mitigation requirements is severely limited. 8. As response to this email, and Easement Plat review comment, please provide: reason sanitary sewer main between pump station located on TMP 56-67A and MH A2 (begin gravity line) located on TMP 56-67 will not be dedicated to (or accepted by) RWSA(17-602.B.); evidence that, to the extent practical as determined by RWSA, location of the sanitary line (force main) lies outside of all stream buffer areas (questionable); and assurance that disturbance associated with private sanitary sewer proposed to be located within stream buffer(TMP 56-67) is minimized (17-602.B.2.). 9. Please address this requirement: No more land shall be disturbed than is necessary to construct, install and maintain the sewer line. Provide specific details, plan notes, etc. (17-602.B.2.) 10. GIS photometric data indicates alternative alignments may exist. It appears unlikely at this point that proposed private sanitary sewer alignment shown on TMP 56-67, which proposes significant impacts to wooded stream buffer, qualifies for recommendation of approval. Nearly 450 LF of sanitary sewer easement is within 100' of Parrott Branch. If no other alignment exists to make connection with existing RWSA system,please make the case clearly. In any event, mitigation plantings for on-site (TMP 56-67A) buffer impacts are required. Convincing evidence that no alternative force main 2 alignment(transiting TMP 56-67) ecists may help support any request for rf from"duty to retain, establish, or maintain stream buffer"to Parrot Branch on TMP 56-67. Until recently, I did not recognize impacts associated with proposed private sanitary sewer alignment on TMP 56-67. Stream buffer is not shown on VSMP plan sheet C4-02. VSMP approval is not site plan approval. VSMP approval does not ensure easement plat approval. Engineering review comments visible in CityView database system include (Item#4): "Indicate/show stream buffer wherever buffer intersects Parkview Drive (RW), or proposed sanitary or waterline easements. What we need at this point: • A comprehensive, detailed explanation for proposed private sanitary sewer(force main) alignment on TMP 56-67. • A Mitigation Plan for buffer impacts associated with proposed private sanitary sewer alignment. • Revised Easement Plat, revised Site Plan: show off-site stream buffers, Parrott Branch. Engineering recommendation of approval for Easement Plat and Site Plan depends upon it. Mitigation plant schedule included with Approved VSMP lists 187 plants,total canopy=37,167 SF.
