Condition #2 states, in part, "No development of residue property or access to adjacent properties is allowed until second access is provided to Orchard Drive." You have asked for a clarification of the meaning of Condition#2, relative to a Boundary Line Adjustment (BLA). I have consulted with zoning staff and the Deputy County Attorney, the minutes of the Planning Commission meeting and the Board of Supervisors' meeting held on this application, and reviewed the approval letter for SP1990-103 of July 1, 1991. The condition is not triggered since the residue is not being developed or providing access to adjacent properties with the BLA. Please note that this approval is subject to the following conditions: 1. The bridge shall not be constructed until the following approvals have been obtained: a. Department of Engineering issuance of an erosion control permit; b. Department of Engineering approval of crossing design to insure compliance with Section 30. 3 ; c. Virginia Department of Transportation approval of crossing and road and drainage plans and calculations. d.
