Statement that a special use permit might allow preserved steep slope impacts on lots for home construction appears inaccurate. Ref. 18-30.7.4.b.2, which reads: ?. At'special use permit. The only use permitted by special use permit on preserved slopes arc private facilities such as accessways, utility lines and appurtenances, and stormwater management facilities, not otherwise permitted by right under subsection(b1(1)(e),where the lot does not contain adequate land area outside of the preserved slopes to locate the private facilities. Scott, As follow-up to their visit, referring to Approved Site Plan(SDP2006-00041),please help Planning/Engineering with these items: 1. Engineering comment 21-May: "Please confirm whether Briarwood Subdivision zoning includes critical slopes waiver. County GIS shows that proposed Lots 26-29 include preserved steep slopes. Edge of structures on Lots 26, 27, and 28 are 2'-5' from preserved steep slopes. It is impractical to consider that dwellings can be built 2-5' from preserved steep slopes. Any use or impact to preserved slopes on these lots is governed by 18-30.7.4.b.2, with no by-right preserved steep slope use or impact permissible. A special use permit would be required"—Is Proffer#3 the only critical slopes waiver granted by ZMA2004-014? If waiver to construct roads is the only approved critical slopes waiver, 22-May site visit indicates apparent severe constraint to practical development on Lots 26,27, 28. Also, if waiver to construct roads is the only approved critical slopes waiver, if Jersey Pine Ridge is to extend north in the future, how will lots served bly this road be developed? Construction on(or grading of) lots east of(future extension)Jersey Pine Ridge would appear to impact preserved slopes. Please consider future development of lots that may include preserved slopes. 2 \,,, ',.., .,,,'\., -,,, . . „ ;,‘, : 5 l"a _Arr ;...- w?48 ii, ` t.• 4F, ro-v*kb,w . . li,. ,,,,, 1 .........„.._ , ,..,,, ! `• ,, ,, „ ....„,,. „§.,,_• ' 'R. .„ ai F€4?' ,^t,,x.,{mt.J'»<aAa. Please instruct the applicant to submit 3 sets of utility plans to Jeremy Lynn at the ACSA for review. This is required to determine which water meters must be relocated so that they are properly placed along the frontage of the new lots. In addition, the applicant should be aware that these lots fall within the North Fork Special Rate District North Zone for sanitary sewer service. Let me know if you have any questions. Alexander J.
