WALLER, AICP PLANNING COMMISSION: MAY 3, 2005 SDP 05-009 SHIFFLETT, VERNON (ALLTEL) - TIER II PWF PROPOSAL: This proposal is for the installation of a Tier II personal wireless service facility(Attachment A). The facility would consist of an 85-foot tall, wooden, treetop monopole equipped with one array consisting of two approximately 4-foot long by 1-foot wide, flush-mounted panel antennas at its top. Supporting ground equipment would be contained within a 5-1/2 foot tall cabinet and a smaller cabinet on a concrete pad. The lease area for the proposed facility is located on property described as Tax Map 87 - Parcel 7A containing approximately 3.038 acres, zoned Village Residential and Entrance Corridor(Attachment B). This site is located in the Scottsville Magisterial District on Monacan Trail [U.S. Route 29 South], approximately 1 mile north of the intersection with Plank Road State [Route 692]. The Comprehensive Plan designation for this property is Rural Areas 3. This application has been submitted in accordance with Section 10.1.22 of the Zoning Ordinance, which allows for Tier II wireless facilities by right in the Rural Areas. Character of the Area: The 400 square foot lease site of the proposed facility is located near the edge of a wooded area at a ground level elevation of 813 feet ASL at the monopole location. The ridgeline of Tom Mountain, which peaks at approximately 1000 feet ASL is nearly 830 feet north of the facility site. The subject parcel is surrounded by properties of varying sizes that are all similarly zoned as Village Residential or Rural Areas. The nearest dwelling, which is also located on the same parcel, is approximately 210 feet southeast of the facility site; while the nearest dwelling on an adjacent parcel is approximately 380 south on the property identified as Tax Map 87 - Parcel 6. The proposed site of the monopole is located 85 feet from the nearest boundary line, which is shared with the property identified as Tax Map 87 - Parcel 7E. The proposed facility will be accessed by the 9-foot wide gravel service road that extends north to the existing facility from the driveway entrance that serves the residence. STAFF COMMENT: Section 3.1 provides the following definitions that are relevant to this proposal: Tier II personal wireless service facility: A personal wireless service facility that is a treetop facility not located within an avoidance area. Treetop facility: A personal wireless service facility consisting of a self-supporting monopole having a single shaft of wood, metal or concrete no more than ten (10) feet taller than the crown of the tallest tree within twenty-five (25) feet of the monopole, measured above sea level (ASL), and includes associated antennas, mounting structures, an equipment cabinet and other essential personal wireless service equipment. 1 Avoidance area: An area having significant resources where the siting of personal wireless service facilities could result in adverse impacts as follows: (i) any ridge area where a personal wireless service facility would be skylighted; (ii) a parcel within an agricultural and forestal district; (iii) a parcel within a historic district; (iv) any location in which the proposed personal wireless service facility and three (3) or more existing or approved personal wireless service facilities would be within an area comprised of a circle centered anywhere on the ground having a radius of two hundred(200) feet; or(v) any location within two hundred (200) feet of any state scenic highway or by-way. Section 5.1.40(d), entitled Tier II facilities states: "Each Tier II facility may be established upon commission approval of an application satisfying the requirements of subsection 5.1.40(a) and demonstrating that the facility will be installed and operated in compliance with all applicable provisions of this chapter, criteria(1)through(8) below, and satisfying all conditions of the architectural review board. The commission shall act on each application within the time periods established in section 32.4.2.6. The commission shall approve each application, without conditions, once it determines that all of these requirements have been satisfied. If the commission denies an application, it shall identify which requirements were not satisfied and inform the applicant what needs to be done to satisfy each requirement." The applicant has submitted an application that satisfies the requirements set forth in Section 5.1.40(a) and also performed a balloon test at the location of the proposed facility. The Architectural Review Board has reviewed this request for compliance with the County's entrance corridor design guidelines and granted approval with a condition that requires the applicant to obtain a tree conservation easement in order to protect several off-site trees that are important in providing backdrop for the proposed monopole (Attachment C). 1. Section 5.1.40(d)(1): The facility shall comply with subsection 5.1.40(b) and subsection 5.1.40(c)(2) through(9). Staff has determined that the proposed facility's location complies with all of the exemptions of Section 5.1.40(b) and the proposed equipment meets all relevant design, mounting and size criteria that are set forth in Section 5.1.40(c)(2) and (3). The remainder of subsection (c) provides requirements that are subject to enforcement if the facility is approved. 2. Section 5.1.40(d)(2): The site shall provide adequate opportunities for screening and the facility shall be sited to minimize its visibility from adjacentparcels and streets, regardless of their distance from the facility. If the facility would be visible from a state scenic river or a national park or national forest, regardless of whether the site is adjacent thereto, the facility also shall be sited to minimize its visibility from such river,park or forest. If the facility would be located on lands subject to a conservation easement or an open space easement,the facility shall be sited to so that it is not visible from any resources specifically identified for protection in the deed of easement. The proposed facility which includes a monopole that would have height of approximately 898 feet ASL, was originally proposed with a higher top elevation of approximately 903.5 feet above sea level (ASL). Staff notes that test balloons were floated for the proposed monopole for this facility from several nearby vantage points on two separate occasions (Attachment D). In both 2 cases the test balloons were observed to have a significant amount of backdrop from all vantage points. However, the second test was needed because staff expressed concerns with the amount of the proposed monopole that would be visible above the trees in front of the site for a short distance while traveling north on Route 29. The original proposal included a monopole with a height of 90 feet that was approximately 8 feet farther to the east and slightly higher in ground level elevation than the current proposal. In response to staff's recommendations, the location of the proposed monopole has now been shifted to the west and its height has been reduced by five feet. This will allow the facility to take advantage of additional screening that can be provided by an 88.5-foot tall tree (Number 324)that is between the monopole and the road. Staff also notes that this tree, which would shield a larger portion of the currently proposed monopole from Route 29, is nearly the same height ASL as the monopole. Based on the information stated above, it is staff's opinion that the proposed site for this facility satisfies the requirement for providing adequate screening of the facility in order to minimize its visibility from various vantage points on adjacent properties, regardless of their distance. 3. Section 5.1.40(d)(3): The facility shall not adversely impact resources identified in the county's open space plan. This site is located below the Mountain Resource Area for Tom Mountain, which begins at 900 feet ASL. Historic Preservation review comments indicate that there are at least eighteen (18) buildings and sites in the area that have been identified by as historic the Department of Historic Resource,but none of them are currently listed on the National Register of Historic Places (Attachment E). Staff notes that the attached memorandum, which also provides specific recommendations for minimizing the possible visual impacts upon surrounding historic property, was drafted prior to the balloon tests and submittal of the plans showing the revised monopole height and location. The test balloons were not visible from any of the specific historic sites; therefore, is staff's opinion that the proposed facility would not adversely impact any nearby historic resources. 4. Section 5.1.40(d)(4): The facility shall not be located so that it and three (3) or more existing or approved personal wireless service facilities would be within an area comprised of a circle centered anywhere on the ground having a radius of two hundred (200) feet. There is an existing personal wireless service facility located directly to the east of the proposed lease site, and the proposed monopole would be approximately 23 feet away from the monopole serving that facility. 5. Section 5.1.40(d)(5): The maximum base diameter of the monopole shall be thirty(30) inches and the maximum diameter at the top of the monopole shall be eighteen(18) inches. Notes on the construction plans for this facility propose a monopole with dimensions for its base and top widths that are in compliance with the maximum width requirements for treetop monopoles serving Tier II facilities. 3 6. Section 5.1.40(d)(6): The top of the monopole, measured in elevation above mean sea level, shall not exceed the height approved by the commission. The approved height shall not be more than seven(7) feet taller than the tallest tree within twenty-five (25) feet of the monopole, and shall include any base,foundation or grading that raises the pole above the pre-existing natural ground elevation;provided that the height approved by the commission may be up to ten (10) feet taller than the tallest tree if the owner of the facility demonstrates to the satisfaction of the commission that there is not a material difference in the visibility of the monopole at the proposed height, rather than at a height seven(7) feet taller than the tallest tree; and there is not a material difference in adverse impacts to resources identified in the county's open space plan caused by the monopole at the proposed height, rather than at a height seven(7) feet taller than the tallest tree. The applicant may appeal the commissioner's denial of a modification to the board of supervisors as provided in subsection 5.1.40Cd)(12). This proposal is for a facility with a wood monopole that would be 85 feet in total height and have a top elevation of approximately 898 feet Above Mean Sea Level (AMSL). This would result in a monopole that would only be 4 feet AMSL taller than a nearby 81.9-foot tall Poplar tree identified on the applicant's construction plans to be 25 feet east of the proposed pole location. In addition to this reference tree, there is also an 88.5-foot tall Poplar located within 25 feet of the currently proposed monopole location and it has nearly the same height ASL as the proposed monopole. 7. Section 5.1.40(d)(7): Each wood monopole shall be a dark brown natural wood color; each metal or concrete monopole shall be painted a brown wood color to blend into the surrounding trees. The antennas,supporting brackets, and all other equipment attached to the monopole shall be a color that closely matches that of the monopole. The ground equipment, the ground equipment cabinet, and the concrete pad shall also be a color that closely matches that of the monopole,provided that the ground equipment and the concrete pad need not be of such a color if they are enclosed within or behind an approved structure, facade or fencing that: (i) is a color that closely matches that of the monopole; (ii) is consistent with the character of the area; and(iii)makes the ground equipment and concrete pad invisible at any time of year from any other parcel or a public or private street. The applicant is proposing the installation of a facility with a wood monopole. In accordance with Section 5.1.40(a)(4)(d) the applicant has provided a sample paint chip and a note on the construction plans identifying the proposed flat dark brown color of the antennas and ground equipment and pad for this facility as Adirondak-Number SW2020, manufactured by Sherwin Williams Paint Company. 8. Section 5.1.40(d)(8): Each wood monopole shall be constructed so that all cables, wiring and similar attachments that run vertically from the ground equipment to the antennas are placed on the pole to face the interior of the property and away from public view, as determined by the agent. Metal monopoles shall be constructed so that vertical cables, wiring and similar attachments are contained within the monopole's structure. Schematic drawings provided in the construction plan packet indicate that the vertical wires extending from the ground equipment to the antennas would be run up the north side of the monopole, facing away from Route 29. 4 9. Section 704(a)(7)(b)(I)(II) of The Telecommunications Act of 1996: The regulation of the placement, construction and modification of personal wireless facilities by any state or local government or instrumentality thereof shall not prohibit or have the effect of prohibiting the provision of personal wireless services. The Telecommunications Act addresses concerns for environmental effects with the following language, "No state or local government or instrumentality thereof may regulate the placement construction, and modification of personal wireless service facilities on the basis of the environmental effects of radio frequency emissions to the extent that such facilities comply with the Commissions' regulations concerning such emissions." In order to operate the proposed facility, the applicant is required to meet the FCC guidelines for radio frequency emissions. These requirements will adequately protect the public health and safety. This proposal represents the third location on the subject parcel has been explored for this facility by Alltel, within two years. No additional information has been provided to demonstrate the availability, or lack thereof, of any other alternative sites on other properties to serve the areas that would be covered by the proposed facility at the current site. Therefore, it is staff's opinion that the denial of this application would not have the effect of prohibiting the provision of personal wireless communication services. SUMMARY: The applicant is in the process of securing a tree conservation easement on an adjacent property in order to protect several trees that are important in providing backdrop for the facility. The applicant has also worked closely with Current Development and ARB staff in order to address the concerns with the expected visual impacts of the original proposal by adjusting the location of the facility and the height of its monopole. Based on the design of the proposed facility and the observation of the balloon tests, staff has identified no significant, unfavorable visual or environmental impacts that would result from the approval of this request as currently proposed. In the event that the Planning Commission chooses to deny this application staff offers the following comment: In order to comply with Section 5.1.40(d) of the Zoning Ordinance, the Planning Commission is required to provide the applicant with a statement regarding the basis for denial and all items that will have to be addressed to satisfy each requirement. North Garden, VA 22959 (434) 977-7241 Narrative: ALLTEL seeks to construct a 90' "treetop tower" on the parcel owned by Vernon Shiflett and identified as Tax Map and Parcel Number 87-7A. The tower is required to address a lack of wireless coverage to ALLTEL customers along the Route 29 corridor near the proposed site. The proposed facility meets all the requirements for a Tier II tower set forth in Section 5.1.40(d) of the Albemarle County zoning ordinance, as set forth below: 1. The facility shall comply with subsection 5.1.40(b) and subsection 5.1.40(c)(2) through (9). The proposed facility complies with the noted sections. Specifically, there will be no guy wires. There will be no persistent outdoor lighting. The equipment cabinets will be screened from view by existing structures and vegetation. Whip antennas will not be used, but a lightning rod will project above the top of the tower within the allowed height range. Attached to the proposed tower will be three flush-mounted antennas, painted brown to match the tower and blend with the surrounding trees. The flush mounts will allow the antennas to meet the requirement that they do not project more than 12" from the tower. In addition, the antennas are well within the size limitation with each having an area of 530.88 square feet. Sheet C6 of the site plan is the Tree Survey which indicates that no trees will be removed for the proposed project. Nevertheless, ALLTEL recognizes the requirement to submit a tree conservation plan prior to issuance of a building permit and will comply with that requirement and abide by that plan during construction. 7 ATTACHMENT A ALLTEL recognizes the requirement for submission of an annual report and for removal upon discontinuation of use. As indicated by the site plan, the proposed facility will be in compliance with the slope requirements set forth in 5.1.40(c)(8). The proposed facility does not include a security fence. 2. The site shall provide adequate opportunities for screening and the facility shall be sited to minimize its visibility from adjacent parcels and streets. The tower has been carefully sited on the parcel, taking into account previous comments received from the County to an alternate location on the same parcel. The proposed location was chosen to ensure maximum screening in front of the tower and backdrop behind the tower. The proposed facility will be minimally visible from the surrounding area, so minimal that unless specifically looking for the tower, no passersby on Route 29 would ever notice it. Even when specifically looking for it, if a passerby was able to find the tower amid the trees, only the extreme top portion would be visible, and the entire visible portion would be backdropped by thick foliage. 3. The facility shall not adversely impact resources identified in the county's open space plan. There will be no adverse impact on resources identified in the open space plan. 4. The facility shall not be located so that it and three or more existing or approved personal wireless service facilities would be within a 200 foot circle. There will only be one other tower located within 200 feet of the proposed facility, which would be the existing NTelos tower on the same parcel. The proposed tower would be much less visible than the existing tower because its location on the parcel takes better advantage of existing screening. 5. The maximum base diameter of the monopole shall be 30 inches and the maximum diameter at the top of the monopole shall be 18 inches. Sheet C7 of the site plan indicates the diameter at the base of the tower to be 27" and at the top to be 14", satisfying this requirement. 6. The top of the monopole, measured in elevation above mean sea level, shall not exceed the height approved by the commission. The proposed tower is 90' in height (903.5' AMSL). That height is based on the tallest tree within 25', which is indicated as tree #338 on Sheet C6 of the site plan. That tree is 81.9' tall (894.3' AMSL). Therefore, the proposed tower is approximately 9 feet taller than the tallest tree. There is no material difference in visibility or other adverse impacts between a tower seven feet taller than the tree and the proposed nine feet taller than the tree. ALLTEL is confident staff will agree with that assessment upon conducting the balloon test. 7. Each wood monopole shall be a dark brown natural wood color ... The antennas, supporting brackets, and all other equipment attached to the monopole shall be a color that closely matches that of the monopole. B ATTACHMENT A The proposed tower is a wood pole and will be a natural dark brown color. The antennas, supporting brackets and equipment cabinets will be painted a flat brown color to match the tower, as used successfully in Albemarle County before by ALLTEL to blend facilities with the treed surroundings. 8. Each wood monopole shall be constructed so that all cables, wiring and similar attachments that run vertically from the ground equipment to the antennas are placed on the pole to face the interior of the property and away from public view. All wiring and cables to the antennas and lightning rod will be located on the side of the pole which minimizes their visibility. The proposed facility, as indicated above, satisfies all requirements for a Tier II facility and therefore is a by right use on this property. We look forward to the opportunity to conduct the balloon test to confirm compliance with the requirements, and ask that staff inform the Planning Commission of this site's compliance with the Tier II requirements. I realize the agreement is necessary to satisfy the ARB approval conditions, and further understand that no conditions can be placed on a Tier II approval. I don't know whether the ARB condition is sufficient to address this issue from a Tier II perspective. If not, I offer as a proffer to our Tier II application that a document will be executed and recorded in the Albemarle County Circuit Court Clerk's Office which preserves the trees set forth in the attached agreement. I expect that document will be the attached agreement, but in the event the landowner requests modifications it may be slightly modified. SHELTON(collectively "Grantor") and ALLTEL COMMUNICATIONS OF VIRGINIA,INC. d/b/a ALLTEL, a Virginia corporation("Grantee"), recites and provides as follows: WITNESSETH WHEREAS, Grantor is the owner of certain real property located in Albemarle County, Virginia, as more particularly described in a deed recorded in the Clerk's Office of the Circuit Court of Albemarle County,Virginia(the "Clerk's Office"), in Deed Book 1907, Page 1, and as identified in the Albemarle County tax records as Tax Map 87, Parcel 7E (the "Grantor's parcel"); WHEREAS, Grantee holds a leasehold interest in certain real property located in Albemarle County Virginia, as more particularly described in a deed recorded in the Clerk's Office in Deed Book 142,1 Page 123, and as identified in the Albemarle County tax records as Tax Map 87, Parcel 7A (the "Grantee's parcel); 'WHEREAS, Grantee intends to construct a telecommunications tower(the "Tower") on the Grantee's parcel in the area shown on a plat dated March 28, 2005, and entitled "Crossroads Site— Survey" prepared by Timmons (the "Plat") attached hereto as Exhibit A. WHEREAS, Grantee desires to preserve certain trees located on Grantor's property to serve as a backdrop for the Tower, and Grantor has agreed to prohibit the felling and removal of certain trees as described and upon the terms and conditions contained herein. NOW, THEREFORE, for and in consideration of one dollar($1.00) and other good and valuable consideration, Grantor and Grantee hereby agree as follows: 1 (Z ATTACHMENT A 1. The trees on Grantor's parcel labeled numbers 360, 362, 364 and 368 on a plat dated March 28, 2005, and entitled "Crossroads Site—Tree Survey" prepared by Timmons, attached hereto as Exhibit B, shall not be felled or removed so long as the Tower constructed by Grantee remains erected. 2. This Agreement shall be binding upon and enforceable by and against Grantor and Grantee and their respective successors and assigns. 3. This Agreement does not and shall not be construed to create a partnership,joint venture or joint enterprise of any kind or nature between Grantor and Grantee with respect to the matters set forth herein. 4. All notices, requests, demands, and other communications hereunder shall be in writing and shall be delivered by hand, sent prepaid by Federal Express (or a comparable, guaranteed overnight delivery service) or by United States mail, certified,postage prepaid, return receipt requested, to Grantor or Grantee at the following addresses: Grantor: Grantee: ALLTEL Communications of Virginia, Inc. One Allied Drive, Building 2, Floor 2 PO Box 2177 Little Rock, AR 72203-2177 ATTN: Property Management Department Any notice, request, demand or other communication shall be deemed given or made (as the case may be) when actually delivered or sent in the manner aforesaid. Any party hereto may change its address by notifying the other party in a manner described in this paragraph. 5. This Agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia. 6. This Agreement shall not be amended or modified and no waiver of any provisions hereof shall be effective unless set forth in a written instrument authorized and executed by the then current fee-simple owner(s) of the Grantor's parcel and the then current owner of the Tower. ( 3 ATTACHMENT A 7. Notwithstanding anything contained in this Agreement, this Agreement shall automatically terminate upon the removal of the Tower from the Grantee's parcel. Regarding the Special Use Permit,the Board by a vote of 4:0 forwarded the following recommendation to the Planning Commission for the above-noted petition: The ARB expresses no objection to the special use permit, subject to the following conditions: 1. Show that there is sufficient backdrop for the pole on site, or obtain the necessary easements that will provide for an adequate backdrop off site,up to a distance of no more than 200 feet. 2. Revise the proposed grading to ensure the health of trees#340,344, and 346. 3. Revise the plan to show grading held outside the drip line of all trees to remain. 4. Indicate on the plan all proposed lighting. 5. Indicate that proposed lighting is intended for temporary maintenance use only. 6. Include a detail in the plan that clearly shows all exact dimensions of the antennas. 7. Indicate on the plan that the"existing edge of woods"is also a"tree line to remain." The Virginia Department of Historic Resources' (DHR)USGS quadrangle maps have no identified historic (50 years or older)resources located on Tax Map 87, Parcel 7A. Note: The absence of historic resources in DHR records does not necessarily mean that no historic resources are present.It is possible that the area in question has not been systematically surveyed for resources. 2. Surrounding the project area are approximately eighteen(18)buildings and sites identified by DHR as historic. However, none of these resources are currently listed on the National Register of Historic Places. Based upon results of the balloon test conducted on March 16, 2005, the proposed monopole will be visible from the following historic resources located to the southeast of the project area: 1. Dwellings in the area of Loving Road-These buildings have not been surveyed by DHR to determine potential eligibility for listing on the National Register of Historic Places. 2. DHR#002-0963, G. C. Woodson Store south of Woodson Store Road-This building was identified as threatened during the Albemarle County Historic Preservation Committee's 2002-2003 survey of historic country stores. In order to minimize the visual impact of the monopole on the surrounding historic resources,the following recommendations are offered: 1. Locate the structure outside of the viewshed of the historic resources in the area. 2. Reduce the height of the proposed monopole, or 3. Co-locate on the existing monopole to eliminate the need for the additional structure. If you have any questions,please let me know. 34
