1. Encourage coordination with homeowners. Use of drainage/SWM Access easements will cause at least
minimal damage to private driveway and sidewalks. Owners: Beverly D. Harner, Michael L. Layman,

2. Label structures to aid evaluation of storm sewer design computations table, and construction.
3. Contours:
a. 4 line -types are confusing (brown, green, black dashed, solid black). Provide legend for 4 line -
types, or eliminate and show existing/proposed contours, only.
b. 696' (brown) and 694' (green) intersect. Clarify.
c. 698' (brown) ties with 698' black dashed, but there is an additional brown contour between 698'
and 696' that does not tie with anything; it stops between black dashed 696' and 694'.
Check/revise.
d. 696' (brown) ties with black dashed 694' —revise.
4. Label proposed new manhole (MH -A).
5. Provide Notes/Sequence for proposed SWM Access grading, storm line work, stabilization, and mitigation.
6. Clarify/revise reference to "areas of the path between 10% and 20%" as this appears to define SWM
Access as a trail when recorded easement shows this features is a 10' SWM Access easement.
7. Provide TYP details: VDOT pipe end section (ES), ESC measures.
8. Provide ESC measures required to construct drainage improvements. This is necessary given close
proximity to aquatic resources/ potential impact.
9. Provide storm pipe drainage profile. Show existing/proposed grade between MH -A and pond.
10. Acquire temporary easements for proposed grading on Lots 5, 6, 8, and 9. Alternatively, show that legal
right to enter and alter grade on private parcels exists. Task of drainage and mitigation are complicated by
years -long delay addressing construction and mitigation issues. Albemarle County will not negotiate with
homeowners on Applicant's behalf. County View: WP0200400044: complete/bond released.

11. Provide Mitigation Plan schedule. Site Plan Letter of Revision #1 (11-9-11) includes a detailed approved
Mitigation Plan. A revised Mitigation Plan approved 13 Aug 2013 has not been completed. Proposed
further revision was submitted 5 Sep 2013. Despite discussion and assurance, there has been no notable
progress since June 2015. Area once under Applicant's control (13 Aug 2013 plan revision) was sold on
9/12/2014 (TMP #055E0 -01-00-000D). The County recognizes March Mountain Properties LLC
continued willingness to allow Applicant to plant in areas near pond and golf course that will not interfere
with golf play. With loss of areas once available (55E -1-D) and with presence of homes on Baywick
Circle, matter of planting, or identifying areas available for planting, has become difficult. Appeals by
residents for action is reasonable. Approval of Grading & Drainage Plan is contingent upon a Miti ag tion
Plan schedule of completion, 2016. Mitigation plantings slated to occur in Open Space behind homes on
Baywick Circle should be coordinated with 18"HDPE storm line during seasonal period that favors plant
survival. County requires a single coordinated effort to complete drainage required to ensure positive
outfall to the pond and to complete mitigation plantings. Any bond reduction for Old Trail Village block
23 is contingent upon completing both Mitigation and Drainage improvements. Damage to private
driveways, sidewalks, and established landscaping with drainage/mitigation proposals (item #1) is nearly
unavoidable given location of 28' drainage easement, presence of expensive homes, utilities, and
landscaping that in any ordinary sense would have been built only after plantings and storm system were
installed per plan. Access to Open Space without causing damage will be difficult. For this reason, block
23 bond is ineligible for further reduction. (J. Anderson email: 12/17/2015 10:06 AM)
12. Provide Mitigation Plan Milestones for completion: Spring, 2016.
