Hi Amy,
I would like to touch base with you on this project.
Late last week, I received a signed and notarized copy of the private street maintenance agreement for this division --
which is good because we needed a copy of it for our records-- but the last item before County approval is a draft of
the restrictive covenant for review by our County Attorney's office.
I just wanted to make sure that I correctly communicated that we needed the restrictive covenant(and not the
maintenance agreement)for final approval.
Please let me know if there's any assistance I can provide.

Hi Amy and Ms. Gibson,
The County Attorney's office has approved the Private Street Maintenance Agreement as submitted. Please submit a
signed and notarized version when the plat is submitted for County signature.
Unfortunately,there is one last requirement that I overlooked during my review-- many apologies for the
oversight. Section 14-212(B) actually requires a restrictive convenant to be recorded with the plat and it is subject to
review by the County Attorney's office. It mirrors a note that is already on the plat, but it is listed as a separate
ordinance requirement. I've attached an editable template that can be used to satisfy this requirement.
Amy,just as with the maintenance agreement, if you email me a drafted version,then I will get it to the County
Attorney's office for their review ASAP.

Jessica and Justin Gibson have hired our law firm and Mr.Tucker to assist them with the drafting of the legal documents
(road maintenance agreement, deed of gift, certificate of plat if necessary) involved with their subdivision. I believe I
already have Albemarle County's road maintenance agreement template. Would it be okay if I email you a draft of the
proposed road maintenance agreement for your"okay" before they go ahead and get the final version signed by their
grandparents to submit to you for the subdivision application?

You need to take your documents from our front desk, create a coversheet with a barcode and then record them at the
Circuit Court.
Once recorded, the plat does not come back to Community Development. It only goes to our Real Estate Division (within
the County Assessor's Office) to let them know that a new lot has been created.
If you plan to apply for any building permits,then you will need to provide a copy of the recorded plat with your
application to Community Development.

I'm sorry that the Circuit Court didn't provide more assistance. I called them at 434-972-4083 to get additional
information about the recordation process.

As I understand it, a coversheet with a barcode is required to record the division.The Court is located at 501 East
Jefferson Street in the City. Here is their website link:

You can find instructions on how to create a coversheet with a barcode under the "Deed Calculation" link on their

Unfortunately,this is the limit of information that I can provide. I hope the tutorial and guides on their website are
helpful.
I received all of your documents in my mailbox this morning, but I've placed them back at our front desk so they can be

Are you referring to the recordation process with the Circuit Court? I'm not aware of any process our office handles that
involves a barcode.
