Response to September 24,2015 Initial Site Plan Comments
Dear Mr. Perez,
Response to the comments in the September 24,2015 letter are listed below:
Albemarle County Planning Services
1. A site plan meeting all the requirements of section 32.6 of Chapter 18 of the Code.
The checklist attached to the site plan application has been completed.
We have not included a benchmark for elevation. Because this is Engineering Policy we
request that Engineering waive this policy because of the small scale of the site
improvements proposed. The topo used for the site was taken from the Albemarle
County topo flown in 2013.
2. The location of the stones (possible grave stones) are within relative close proximity
to the proposed construction work. On the final site plan assure these areas are protected by
protective fencing.

3. Currently the initial site plan depicts the proposed entrance to the site traversing a
small portion of the neighboring property's front yard (TMP 04800-00-00-019E0);however
the entrance to the site shall be located completely on the Church property or an easement
shall be granted by/recorded on the neighboring parcel. Prior to final site plan approval an
offsite easement shall be granted by the owners of TMP 04800-00-019EO for the Church's
proposed entrance, OR a Boundary Line Adjustment shall take place between the two
properties to relocate the entire entrance on the Church property while maintaining a
minimum of 130' frontage for TMP 04800-00-019E0 as required in the VR district.
The easement language has been reviewed by the coun y staff; a plat will be submitted
to illustrate the proposed easement.
4. As depicted the aisle widths adjacent to the parking spaces scale out at 19'wide;
however they truly need to be 20'wide at a minimum. Assure this is corrected on the final
site plan.Also, the parking spaces proposed to scale out to be 9'wide;however, for a 20'
aisle with they are required to be 10'wide.
The parking area is dimensioned to provide for a 18' long parking space and a 20'
travelway and measures 38' as required by ordinance standards, the graphic
representation of the parking widths has been revised to illustrate a 10' wide parking
space and dimensions remain as illustrating a typical width for the spaces, total length
of the parking area measures 66'.
5. Zoning. On sheet 3 of the final site plan under the gravel parking waiver note,please
add the following note for the other waiver that was approved:
"18'wide access aisle near the entrance has been permitted for this site pursuant to Section
4.12.2c of the County Code as it has been determined the modification would equally or
better serve the public health, safety or welfare."
This note has been added.
6. On the site plan TMP 48— 19E is listed as AG/forest;however this property is not
located in an AG Forest District. Please remove this labeling, or provide proof it is located
in this district.
The label has been removed.
7. Prior to final site plan approval assure the approval date of SP2015-7 is provided on
the site plan as well as the following conditions of approval:

8. Groundwater Tier I Assessment. Per direction from the County Engineering staff a
Tier I Groundwater Assessment is required prior to approval of final site plan.
This requires drilling a well. Well drilling is scheduled.
9. Virginia Department of Health approval of septic permit is required prior to final site
plan approval. Please submit 3 copies of the soil work to Planning Staff and these will be
forwarded to the Health Department for review with the final site plan.
These are attached.
10. Being this site is located in the Entrance Corridor (EC), approval from the
Architectural Review Board (ARB) is required prior to final site plan approval.
Information requested by the ARB has been submitted to the Design Planner.
11. Entrances.VDOT approval shall be required prior to final site plan approval.
Entrance has been designed to VDOT standards.
12. The following will also be required for final site plan approval:
If any outdoor lighting is proposed—Outdoor lighting information including a photometric
plan and location,description,and photograph or diagram of each type of outdoor
luminaire.
Note added indicating that NO outdoor lighting is proposed.
A complete landscape plan in accordance with (Sec. 7.9)
Landscape plan has been included. Landscaping using existing trees preliminarily
approved by Design Planner.

Architectural Review Board
1. A Certificate of Appropriateness is required prior to final site plan approval.
This is understood.
2. Indicate existing and proposed materials and colors on the elevation drawing. New
materials and colors shall be compatible with those of the historic chapel.
This has been added.
3. Add the standard equipment note to the architectural plan: "Visibility of all
mechanical equipment from the Entrance Corridor shall be eliminated."
Because the mechanical equipment proposed consists of a beat pump located on the
ground behind the building and illustrated on the final plan, with the same note on the
final site plan, this note has not been placed on the architectural plan.
4. If site or exterior building lighting is proposed, show it on the plan and ensure that
all related ordinance requirements are met.
A note has been added to the plan indicating that NO outdoor lighting is proposed.
ARB comments concerning a grading permit
1. Include the signed conservation checklist on the site plan. Check the boxes that
apply.
This has been added.
2. No grading shall begin until all the trees to be saved are marked and protected with
fencing.
This has been checked on the Conservation Checklist.
Engineering Division
1. Is the entrance encroaching another property?Please provide an access easement if it
is on another property.
The deed language has been submitted.
2. The edge of the parking near the stub out is 533.25. Show a 2:1 or 3:1 slope to the
532 contour line. If steeper than 3:1 is used, show low maintenance groundcover (not grass)
on the landscaping plan.
Drawing has been revised to illustrate a 3:1 or greater slope from the parking area.
3. Delineate the limits of disturbance and label to match the 8,085 SF on notes.
The disturbed areas have been delineated. The drainfield area has been relocated. The
disturbed area has increased taking into account the grading required to construct the
parking area. It now measures 9,244 square feet.

4. Show unobstructed sight distance lines at the entrance.
This has been added.
5. Shift handicap parking sign to be behind bumper block so it's in front of parking
space.
Drawing has been revised, sign moved, and note added to plan clarifying location of
handicap sign.
6. Label trees "to be removed"within travelway and parking area.
This information is located on the landscape plan.

I have contacted the County Attorney about his guidance on the deed language and the applicant's suggestion
that he previously weighed in that a deed will suffice in place of a plat. Greg affirms he did not weigh in on
whether or not a plat was required during his review of the deed; rather, he merely reviewed the proposed
easement termination language in the deed and determined it presented no County issues. In an effort to assure
you that an easement plat is required I brought Megan Yaniglos—Principle Planner into the discussion and she
also believes that an easement plat is required for this situation.
Please note that the deed your clients already spent time and money on can be modified to reference the
easement plat and eventually recorded w/the plat. Note the plat will need to be applied for, submitted,
reviewed, and approved by the County before it can be recorded. Once the easement plat is recorded the final
site plan will need to be revised to provide the deed book and page reference number of the recorded easement
plat.

I'm working with the applicants of the above referenced project on submitting their final site plan and they
insist that per your guidance from 9-21-15 (email below) that they do not need to submit an Easement Plat
associated with the portion of their required access which crosses over Dovedale LLC land; rather, they believe
a Deed which provides an exhibit from the site plan will suffice as you previously reviewed their deed and said
'the easement doc is OK as,far as the County is concerned'. Both Megan Yaniglos and I feel that the ordinance
calls for an easement plat(see attached doc for ordinance sections).
After I read your email that they are standing by, it appears that you may have only reviewed the deed language
in relation to what happens after the land is no longer used as a church; rather, it is not clear that you provided
any guidance as to whether an easement plat was required.

The easement document is OK as far as the County is concerned. In particular, the termination provision does
not pose any issues for the County because the proposed special use permit condition that triggers the need for
the easement applies only while the special use (the church use) exists on the property.

Dear Mr. Kamptner:
I am writing in reference to a Special Use Permit submission dated June 1, 2015 (SP 201500007)for an
addition to All Saints Chapel, which is located at Stony Point. The Planning Commission recently approved the
submission, and it will be considered by the Board of Supervisors on September 2. I am an attorney and a
member of Dovedale, LLC, which owns the property that is adjacent to the chapel. My purpose in writing is to
consult with you as to the wording of an easement for an entrance to the chapel.
The Planning Commission has asked that Dovedale, LLC grant an easement so the chapel's entrance
will qualify as a commercial (low-volume)entrance, with 20-foot radii. The easement is necessary because the
chapel's entrance is very close to the boundary line of the LLC's land, and the 20-foot radius on the eastern side
of the entrance will encroach slightly on the LLC's land.
There is an unusual situation with the chapel property that may affect the wording of the easement. The
chapel property was donated to the church in 1922 by my ancestors, who owned the property as part of a family
farm. A few years ago, Dovedale, LLC was created to hold title to the farm.The deed from the Shackelfords to
the church's trustees states: "Should said property cease to be used for the purpose of worship for a longer
period than five years, then the real estate hereby conveyed shall revert to the estate of said W.C. Shackelford."
In the event that someday the chapel property ceases to be used for worship and reverts back to
Dovedale, LLC (whose members are the surviving beneficiaries of W.C. Shackelford's estate), the LLC members
would like to have the easement terminate at that point. That would protect the LLC from having a commercial
entrance on its boundary if the LLC were to later sell the lot to another owner. A new owner would then have to
negotiate for a new easement in case the new owner wanted to use the property for a commercial purpose; i.e.,

something other than a typical residence. Again, that would protect the LLC from being forced to accept some
type of commercial enterprise (other than a church) so close to the LLC's boundary.
Attached is a draft of an easement for your review, along with a copy of the original 1922 deed. I would
be grateful if you could read the draft easement and let me know if it looks OK from your perspective. If you
require any additional information, please let me know. I will be glad to discuss this by phone or in person if that
would be helpful to you. Thank you for your assistance.
