Request for Waiver of Section 4.12.17-c-2
Minimum travel-way width for one-way access aisles
Dear Ms. Ray,
Section 4.12.17-c-2 requires a twelve(12)foot minimum travelway width for one-way access aisles for all
uses with the exception of bypass traffic and bank teller and ATM canopies and lanes. In accordance with
Section 4.12.2-c-2, the Applicant is hereby requesting a waiver to reduce the one-way drive-through aisle for
the Bojangles SDP 2014-000063 from twelve (12)feet to eleven (11)feet. The particular language in this
paragraph allows that:
"The zoning administrator may modem or waive a design requirement in sections 4.12.15, 4.12.16, 4.12.17,
4.12.18 and 4.12.19 only after consultation with the county engineer, who shall advise the zoning
administrator whether the proposed waiver or modification would equally or better serve the public health,
safety or welfare."
In reviewing this request, please consider the following:
1) One-way traffic circulation is proposed on the site. This eliminates the hazard of having a
northbound traffic lane adjacent to the southbound drive-thru (order) lane and eliminates the hazard
of having a southbound traffic lane adjacent to the northbound drive-thru (pick-up) lane. This is safer
in two ways than a traditional 12' drive-thru lane adjacent to a 24' (two-direction) travelway: first by
eliminating the possibility that a driver in the center aisle will have opposing traffic on both sides of his
or her vehicle, and second by allowing the drive-thru lane traffic to enter the bypass lane without
crossing opposing traffic lanes.
2) Section 4.12.16 allows a 9' parallel parking lane adjacent to a 16'one-way travel aisle (serving
angled parking)without any requirement for a waiver. This type of layout would require backing
movements in the 16'travel aisle to enter the 9' parking spaces, creating a more dangerous condition
than the proposed 11' drive-thru lane which will have slow moving traffic (perhaps 5-10 feet per
second) but would require no backing movements.

3) Civil Guidelines provided for Bojangles Restaurants new store construction permit a minimum drive-
thru lane width of 10'-6" and further stipulate that"by-pass lane shall be wider than 12 feet if part of
drive aisle for parking spaces."
4) And finally, please consider that in the advisory review of the Special Use Permit Application for the
Drive-thru use, the Architectural Review Board provided the following comment:
"The ARB has no objection to the request for the Special Use Permit(SP)based on the
design of the drive-thru window and lane as illustrated in the February 17 and February
20,2014 architectural elevations and the February 20,2014 conceptual site layout. The
ARB also expresses support for the waiver request for the travelway width,maintaining a
10.5' width."

Final Site Development Plan
Dear Ms. Ray,
I have attached 6 copies of the Final Site Development Plan addressing the following comments: Planning comments
dated October 3, 2014; Engineering Comments dated October 2, 2014, ARB comments dated September 19, 2014;
and ACSA comments dated October 14, 2014. The specific changes along with responses to these comments are
outlined below.
Planning(10/3/14):
1. Provide boundary dimensions for the subject parcel.
Boundary dimension and easement information is provided on sheet C3 of 8.
2. Add EC (Entrance Corridor)to the Zoning Information.
This information has been updated.
3. The conditions listed for SP 201400004 are from the PC action letter; provide the conditions from the Board
of Supervisors action letter instead. Please also include the actual date in Condition#4.
This information has been updated.
4. The SP number for First Citizens Bank is SP 02-70, not 02-76 (this was the previous SP for a fast food drive-
in); revise the note to indicate the correct SP.
This information has been corrected.
5. Include the Modifications and Requirements from the BOS action letter for ZMA 98-20 in the Zoning notes.
6. This information has been provided.
7. Provide the name of the owner(s), zoning district, tax map and parcel numbers and present use of abutting
parcels.
This information has been provided on sheet C3.
8. The parking calculation provided is incorrect. The calculation for First Citizens Bank should be one space per
225 sf(instead of per 150 sf; the 25 sf per drive-in aisle"reduction" is calculated in this manner not as a
reduction in square footage of the building), which results in 7 required spaces. This makes the resulting
overall requirement 120 spaces instead of 123; please revise the parking notes.
This information has been corrected and revised. Please note that the parking provided has been
revised with a change in the dumpster location/design and with the elimination of one parking space
in response to Engineering comment#5(below).
9. Show the small area of managed steep slopes on the property.
This information has been provided on sheet C2. Please note that this information is incorrectly
labelled on the County GIS service, which shows 25%slopes crossing both Route 250 and Hansen
Road in this area.
10. One-way access aisles must have a minimum 12'width; a waiver request must be submitted and approved
for the proposed 11' drive-in aisle.
A waiver is requested under separate cover.
11. Verify that the location(s) and dimensions of all existing or proposed utilities and utility easements including
water, sewer, drainage, telephone, cable, electric and gas are shown on the plan. Provide the Deed Book
and Page reference for any existing easements. Any proposed easements should be labeled with the
intended owner.
This information has been provided on sheet C2 and C3.
12. Show the distance to the centerline of the nearest existing street intersection from the proposed ingress and
egress location.
This information has been provided on sheet C3.
13. Dimension the dumpster pad.
This information has been provided on sheet C4.
14. Verify that all utilities and utility easements are shown and labeled on the landscape plan.
This information is provided on sheet C6.
15. One shrub is shown directly on top of the proposed water line connection to the building; please revise.
While we don't have a concern with planting a shrub over a water line, we have shifted the Blue
Prince Holly off the water service line on sheet C6.
16. Existing trees may be preserved in lieu of planting new plant materials in order to satisfy the landscaping and
screening requirements of section 32.7.9 or to meet conditions of approval, subject to the agent's approval. It
seems that some of the Landscape Plan requirements are proposed to be met with existing vegetation. If this
is the case, the landscape plan should show the trees preserved, the limits of clearing, the location and type
of protective fencing, grade changes requiring tree wells or walls, and trenching or tunneling proposed
beyond the limits of clearing. In addition, the applicant shall sign a conservation checklist approved by the
agent to insure that the specified trees will be protected during construction. Except as otherwise expressly
approved by the agent in a particular case, such checklist shall conform to specifications contained in the
Virginia Erosion and Sediment Control Handbook, pp III-284 through III-297, and as hereafter amended.
This checklist must be signed, dated and included on the plans.
In lieu of providing a tree preservation plan and signed checklist, the Applicant has proposed to meet
the requirements of 32.7.9 with new planting materials only.
17. Street trees are required along Route 250. Provide street trees as indicated in the ARB comments. Include a
note documenting the number of street trees required and the number provided.
Five 'Allee'Elm trees are provided on sheet C6 in response to this comment and ARB comment#9
(below).
18. Demonstrate that a minimum area equal to 5%of the paved parking and vehicular circulation area is
landscaped in shrubs and trees by labelling the landscaped areas with their square footage. See section
32.7.9.6(a)for additional information on which areas can be counted toward this requirement.
An area calculation is provided on sheet C6. 1,122 square feet of landscape area is required and
2,313 square feet of area is provided.
19. If 50 parking spaces support the proposed fast food restaurant, then five large or medium shade trees are
required within the landscaped areas mentioned in the comment above. Yellowwood is designated as a
small deciduous tree on the County Plant List, so only three large or medium shade trees have been
provided. Either provide two additional large or medium shade trees or replace the yellowwood with a large
or medium species.

The plan has been updated to show six large shade trees, 3 Sweet Gums and 3 Black Gums. The
Yellowwood is not shown on the updated sheet C6.
20. The dumpster must be adequately screened from the public street; provide a detail on the dumpster
enclosure to demonstrate screening meeting 32.7.9.7 is proposed.
A dumpster screening detail is provided on sheet C8.
21. The landscape plan must be submitted to the Thomas Jefferson Foundation to make sure that the4 plan
provides, to their satisfaction, screening of all buildings and parking areas visible from Monticello. See
requirement#1 in letter dated October 28, 1998 for ZMA 1998-20.
On October 22, 2014;Liz Russell from the Thomas Jefferson Foundation, wrote the following in e-mail
"A tan or grey roof will meet our recommended guideline for muted roof colors and successfully
mitigates any visual impact to the Monticello viewshed. I have no other concerns." The architectural
plans will provide the requested roof color and this condition does not require anything further on
site plan review.
22. It appears that the tree canopy requirement is being met through a combination of both existing and proposed
trees. In order to use existing trees, more specific information must be provided regarding which trees count
toward this portion of the site versus the remainder as it looks like most, if not all, of the existing trees are
outside of the 'project boundary'. Also, since the existing trees are individuals instead of a large wooded
area, species and tree canopy information for each tree must be provided. Additionally, Spiraea x bumalda
does not reach sufficient height to count toward the tree canopy requirement; revise the tree canopy
calculation and all associated notes.
Existing trees are not proposed to meet any requirements of 32.7.9. Sheet C6 has been revised to
show all new planting materials and the Spiraea x bumalda is not included in the tree canopy
calculation.
23. ARB approval of the landscape and lighting plans is required.
ARB comments are addressed below.
24. Architectural plans must be submitted to the Thomas Jefferson Foundation to make sure that the plan
provides, to their satisfaction, minimal visible impact on the Monticello viewshed. See requirement#3 in letter
dated October 28, 1998 for ZMA 1998-20.
See response to Comment#21 above.
25. This amendment cannot be approved until all comments from the Site Review Committee (SRC) have been
addressed. Any comments not available at the time of the SRC meeting will be forwarded once received.
Understood.
ARB (09/19/14):
1. Provide the following note on the architectural drawings: Window glass shall conform to these specs: Visible
light transmittance(VLT) shall not drop below 40% and visible light reflectance (VLR) shall not exceed 30%.
This comment will be addressed in the architectural drawings and is not addressed in the site
development plan.
2. Provide a dumpster screen detail in the site plan. Coordinate all dumpster screen information regarding
material.
In addition to dimensions provided on sheet C4, a dumpster screen details are provided on sheet C8.
3. Confirm that only one menu board is proposed and no other drive-thru related items are proposed, or show
all drive-thru related items on the plan.
The location and sizing of the menu board and speaker post has been revised on sheets C4 and C6.
Additionally, a native grass planting area is provided at the base of the menu board. There is only
one proposed menu board.
4. Add the standard mechanical equipment note to the site and architectural plans: Visibility of all mechanical
equipment from the Entrance Corridor shall be eliminated.
A note is provided on sheet C4 and C6. This comment will be further addressed in the architectural
drawings to be submitted at a later date.
5. Include the wall lights on the lighting plan and revise the photometrics to include the illumination from the wall
lights.
Wall light details and photometrics are included in the revision. In addition, the dumpster location
and adjacent pole mounted fixture have been relocated.
6. Include a note on the lighting plan indicating that the color of the new pole and fixture will be bronze.
Note#3 has been updated on sheet C7 to address this comment.
7. Note that the 20' maximum light pole height includes the height of any bases used.
Note#1 has been updated on sheet C7 to address this comment.
8. Add the standard lighting note to the plan: "Each outdoor luminaire equipped with a lamp that emits 3,000 or
more initial lumens shall be a full cutoff luminaire and shall be arranged or shielded to reflect light away from
adjoining residential districts and away from adjacent roads. The spillover of lighting from luminairies onto
public roads and property in residential or rural areas zoning districts shall not exceed on half footcandle."
Note#4 has been added on sheet C7 to address this comment.
9. Provide a sufficient quantity of large trees, 3 %2"caliper minimum at planting, 35' on center, along the EC
frontage of the site.
The previously approved plan for this site included 5 `Autumn Purple'White Ash trees,planted 35'on
center. Three of these trees are no longer present and the Applicant now proposes to remove the
remaining two trees. The revised sheet C6 proposes to replace all five of these trees with 'Allee'Elm
trees, and a proposed monument sign location for the Bojangles Restaurant has been incorporated in
the tree spacing.
10. Revise the landscape schedule to note the 10 Blue Princess hollies that are drawn on the plan.
The landscape plan and schedule have been revised and the schedule correctly correlates with the
plan.
11. Revise the plan to include a conservation checklist and tree protection fencing.
In lieu of providing a tree preservation plan and signed conservation checklist, the Applicant has
proposed to meet the requirements of 32.7.9 with new planting materials only. Existing plantings on
the Applebee's site are protected by an existing curb, which will remain. Existing plantings between
Route 250 and the site are protected by an existing curb, which will remain. Existing plantings
between Abbey Road and the site are protected by an existing curb, which will remain and protect the
shrubs in this area. The curb between the First Citizens Bank and the site will be relocated
approximately 2'east and the slope will be re-graded behind the new curb. Existing plantings behind
this new curb, if they are damaged or killed by this grading, will be replaced as needed.
12. Sign permits will be required for all wall signs. Note that red acrylic#2283, and its equivalents, are not
approvable shades of red.
Applications for sign permits(wall and monument) will be submitted after the site plan is approved.
Please note that a location is provided on sheet C6 for a monument sign.
Engineering (10102114):
1. Drive-thru lane should be 12' minimum. [18-12.17.c.2] Requires a modification or waiver 18-4.12.2.c for
approval as shown.
A waiver is requested under separate cover.
2. The drive-thru lane should have curbing. [18-12.15.g] Requires a modification or waiver 18-4.12.2.c for
approval as shown. Otherwise a raised island with CG-7 mountable curbing should be installed.

3. Bumper blocks or wheel stops should be installed in angled parking spaces to protect landscaping and
lighting poles.
The angled parking spaces are designed in accordance with the Albemarle County Design Standards
Manual, spaces are sufficiently deep and landscaping is protected by curbing. Wheel stops will
provide additional maintenance concerns and the Owner/Applicant does not wish to include them on
the site plan.
4. VESCP plan may be required if disturbance is 10,000 or larger.
Please refer to the attached exhibit showing a disturbed area of 9,892 square feet.

The last parking space on the northwest corner of the site has been removed to address this

Sheet C4 has been revised to provide stop signs, installed on the back of the "Do Not Enter"signs, as
requested.
ACSA(10/14/14):
1. Update the water meter note to read "Water Meter Vault. Meter to be sized by the ACSA." If fixture counts
are available please submit them to the ACSA so the meter can be sized. Once the meter is sized you can
call out the meter size on the plan. Connection fees can also be calculated once the fixture counts are
provided.
A note has been added, fixture counts have been provided, and a 1"meter size has been provided.
2. Update water meter service line to an 8"x 4"TS&V, threaded plug and copper to the meter vault.
Since the water meter has been sized to be 1", a 1"corp. stop is now shown on the plan.
3. Remove the ACSA typical water lateral detail.
The typical water service lateral detail has been removed from sheet C5.
4. Show a grease interceptor connected to the sanitary sewer lateral on sheet C4.
A precast 1,600 gallon grease interceptor is now shown on the plan with an associated detail on sheet
C5.
5. Call out backflow preventer on the private side of the water meter.
A backflow preventer is now called out on the water service line after the meter.
6. Update the landscaping plan so no landscaping is in the water meter vault location.
Landscaping has been shifted on sheet CX to be off the 1"water meter.
7. Call out a saddle connection to the sanitary sewer.
A saddle connection is not required due to the sanitary sewer lateral already being installed on this
site. The exact location of the lateral is approximated and the contractor shall field verify before
construction.
8. Include ACSA TD-27 detail for sewer service lateral connections.
The standard sanitary sewer later connection detail is not provided due to it already existing on the
site.

Curb and gutter in parking areas and along travelways

Dear Ms. Ray,
Section 4.12.15-g of the Zoning Ordinance requires curbs at the edges of parking areas or access aisles and
Section 4.12.17-c-2 requires a twelve (12)foot minimum travelway width for one-way access aisles for all
uses with the exception of bypass traffic and bank teller and ATM canopies and lanes. In accordance with
Section 4.12.2-c-2, the Applicant is hereby requesting a waiver to reduce the one-way drive-through aisle for
the Bojangles SDP 2014-000063 from twelve(12)feet to eleven (11)feet. The particular language in this
paragraph allows that:

or her vehicle, and second by allowing the drive-thru lane traffic to enter the bypass lane without
crossing opposing traffic lanes.
2) Section 4.12.16 allows a 9' parallel parking lane adjacent to a 16'one-way travel aisle (serving
angled parking)without any requirement for a waiver. This type of layout would require backing
movements in the 16' travel aisle to enter the 9' parking spaces, creating a more dangerous condition

than the proposed 11' drive-thru lane which will have slow moving traffic(perhaps 5-10 feet per
second) but would require no backing movements.
3) Providing curbing between the travelway and drive-through lane would limit the ability for drive-
through by-pass traffic as required in section 18-4.12.17-c-2(a). Furthermore, when vehicles are not
standing in queue in the drive-through lane, a curb separating the drive-through lane from the parking
access aisle will create a driving hazard for vehicles backing out of the parking spaces. These drivers
will have difficulty seeing a 6" high curb as required in section 18-4.12.15-g.
4) Civil Guidelines provided for Bojangles Restaurants new store construction permit a minimum drive-
thru lane width of 10'-6" and further stipulate that"by-pass lane shall be wider than 12 feet if part of
drive aisle for parking spaces."
5) And finally, please consider that in the advisory review of the Special Use Permit Application for the
Drive-thru use, the Architectural Review Board provided the following comment:
"The ARB has no objection to the request for the Special Use Permit(SP)based on the
design of the drive-thru window and lane as illustrated in the February 17 and February
20,2014 architectural elevations and the February 20, 2014 conceptual site layout. The
ARB also expresses support for the waiver request for the travelway width, maintaining a
10.5' width."
