The subject redevelopment is proposed to include a 11,945 sq. ft. pharmacy/drugstore with drive-through window and associated parking. Street Tree Variation We request a variation in the street tree requirement per the Albemarle County zoning ordinance AND Entrance Corridor Guidelines due to the unique nature of this project and proposal. A grade separated interchange will be constructed along Route 29 N, affecting the frontage of the CVS site. Additional right- of-way is needed by VDOT for the road project and they will also require a utility easement in the area of the site between the right-of-way and the parking area (what would typically be the planting area). No trees are allowed within the easement, although shrubs can be planted. Because of the relatively small size and depth of this site combined with the substantial grade change, parking and street trees cannot be shifted further into the site. Therefore, some trees have been moved to alternate locations. Below are the Zoning and Entrance Corridor code sections, from which we request relief: ZONING 32.7.9.5 LANDSCAPING ALONG STREETS Location and spacing of street trees.Street trees shall be planted with even spacing in a row within the public street right-of-way or adjacent to the public street right-of-way if not permitted therein by the Virginia Department of Transportation,and within the private street right-of-way. One(1)large street tree shall be required for every fifty (50)feet of street frontage,or portion thereof, if twenty-five(25)feet or more. Where permitted, one(1)medium shade tree shall be required for every forty(40)feet of road frontage,or portion thereof, if twenty(20)feet or more. If required street trees cannot be planted within the parking setback or within ten(10)feet of the street right-of-way due to sight distance, utility easements or other conflicting requirements, then the planting strip shall be enlarged to accommodate the trees. If this requirement creates a hardship by causing the relocation of required parking spaces, then the additional planting area may be counted toward the interior landscaping requirement. ENTRANCE CORRIDOR Landscaping 32. Landscaping along the frontage of Entrance Corridor streets should include the following: a)Large shade trees should be planted parallel to the Entrance Corridor Street.Such trees should be at least 3% inches caliper(measured 6 inches above the ground)and should be of a plant species common to the area.Such trees should be located at least every 35 feet on center. b)Flowering ornamental trees of a species common to the area should be interspersed among the trees required by the preceding paragraph. The ornamental trees need not alternate one for one with the large shade trees. They may be planted among the large shade trees in a less regular spacing pattern. The CVS landscape plan (see attachment—Landscape Plan) demonstrates at least 13 large street trees are proposed for this site, and ample landscape has been provided along the Rio Road frontage of the site in areas that are available for larger trees to be planted. Conclusion We ask for the County's approval to grant a variation to the landscape requirements, allowing for a reduction in the required street trees along Route 29 North. This request is made because of specific impacts to this project in connection with VDOT easements to construct a grade separated interchange directly adjacent to the property.
