HomeMy WebLinkAboutZTA201500015 Resolution - Board of Supervisors 2015-12-02 (2)RESOLUTION OF INTENT WHEREAS, drive through windows are currently authorized by special use permit in various commercial districts under the Albemarle County Zoning Ordinance; and WHEREAS, applications for special use permits for drive through windows, for the most part, do not raise concerns about their potential adverse impacts from abutting landowners and other members of the public, and the conditions imposed in conjunction with such special use permits are now relatively standard; and WHEREAS, staff researched best practices for drive through windows in conjunction with a recent application for such a special use permit and the conclusions from that research resulted in revised conditions that could serve as performance standards for drive through windows; and WHEREAS, in order to improve efficiency in the development process while ensuring that any potential adverse impacts from drive through windows are addressed through performance standards, it may be desirable to amend the Albemarle County Code § 18 -5 to establish performance standards for drive through windows and to amend the district to allow drive through windows by right, rather than by special use permit, subject to the proposed performance standards. NOW, THEREFORE, BE IT RESOLVED THAT for purposes of public necessity, convenience, general welfare, and good zoning practices, the Albemarle County Board of Supervisors hereby adopts a resolution of intent to consider amending Albemarle County Code §§ 18 -5, 18 -20, 18- 20A, 18 -20B, 18 -22, 18 -23, 18 -24, and any other sections of the Zoning Ordinance deemed to be appropriate to achieve the purposes described herein; and BE IT FURTHER RESOLVED THAT the Planning Commission shall hold a public hearing on the zoning text amendment proposed by this resolution of intent, and make its recommendations to the Board of Supervisors, at the earliest possible date.
