Chris,
Quick question concerning the easement acquisition for this site plan. As you know, it appears that we will
need to obtain easements from Rivanna Village and from the County of Albemarle/East Rivanna. Do these
easements need to be obtained prior to this being presented to the Board of Supervisors? No,the easements do
not need to be obtained prior to BOS approval or review of the Special Exceptions. The BOS will review the
special exceptions (we're thinking in December) and if the BOS is to approve them, staff will have
recommended as a condition of approval that the offsite 20' landscape easement be a condition of approval.
I understand that final site plan approval cannot be issued, but we would like assurances from the County about
approval prior to obtaining the easements from the County. Per discussions with senior planning staff we feels
its best that the PC make a finding on the CCP review before the Special Exceptions are taken to the BOS.
One of our contingencies in our agreement with the County is Approval of the proposed Improvements by the
County of Albemarle. Therefore, the ACSA isn't committed to securing the easements until the County has
approved the proposed improvements.

We are sending you the plats to arrive tomorrow(by Fedex). Is one copy of he plats adequate for your review?
I will need 3 copies of each plat. Please be aware that our office is closed t'morrow(Friday) and Monday...we will
reopen on Tuesday.
Since comments regarding the plats also include modifications to callo. s on the site plan, I was going to provide a
courtesy copy of the modified site plan sheets showing the revised easement callouts so you can see how the whole
package is being modified. I wasn't going to submit a formal revised site plan until we can include the deed book and
page numbers for the plats. Ok,that sounds fine, please provide 3 copies of the revised site plan pages, (one for my
review and one for engineering's review, and another incase the changes are relevant to some other agency that way I
have it and I can send it to them (if needed)).
I wanted to ask for clarification on one of your site plan comments(No. 2 of the attached) regarding the modification
you are requesting for the cover page setback note. Do we simply change our cover sheet note to state:
SETBACKS WAS APPROVED ON DEC, 3, 4."
Or are you requesting that we include the detail you provided in the comment regarding the conditions? No, I am
requesting the entire item in quotes,to include all the conditions.See below.
"Setbacks for the Water Tank are 1 to 1 based on tank height.The tank is 35' tall.
Special Exception was approved on Dec 3, 2014 by the BUS to allow a 32 foot side setback and a
20 foot rear setback subject to the following conditions:
•
1. The Albemarle County Service Authority(the "Authority")shall obtain a landscaping
easement(the"Landscaping Easement")on Tax Map and Parcel Number 093A1-00-00-
00400 in the Iocation shown for the"Prop. 20' Landscaping Easement"on the Site Plan—
Grading Plan and Landscaping Plan(the"Plan"),last revised November 4,2014,
attached hereto, subject to the following:
•
A. Any tree shown on the Plan whose trunk is located within.the Landscaping

Easement shall be preserved and maintained by the Authority;
B. If any tree within the Landscaping Easement dies,is removed,or is otherwise cut
so as to no longer provide the screening intended by this condition as determined
by the Director of Community Development,the Authority shall promptly submit
a landscape plan that complies with Albemarle County Code§ 18-32.7.9 and
which will provide screening as provided by Albemarle County Code§ 18-
32.7.9.7;
C. After the landscape plan is approved by the County,the Authority shall install
and thereafter maintain any landscaping shown on the approved landscape plan;
D. The Zoning Administrator may allow minor variations in the location of the
Landscaping Easement provided that the screening purpose of the Landscaping

E. The deed of easement and easement plat for the Landscaping Easement shall be
subject to review and approval by the County before they are recorded in the
Clerk's Office of the Circuit Court of Albemarle County,Virginia.
2. If the Authority does not obtain the Landscaping Easement as provided in Condition 1,it
shall:
A. Submit a landscape plat that complies with Albemarle County Code§ 18-32.7.9
and which will provide screening as provided by Albemarle County Code§ 18-
32.7.9.7 to the equivalent extent practicable that would have been provided under
Condition 1,as determined by the Director of Community Development;and
B. After the landscape plan is approved by the County,the Authority shall install
and thereafter maintain any landscaping shown on the approved landscape plan."

Site Plan Review
SDP201400054—A portion of the site plan(pgs 5-11) were revised/submitted for staff to assure the plats match
the site plan. County staff has no objections to the revised site plan pages,they appear to match the plats.
Engineering offers the following comment on the site plan: "Prior engineering comments addressed.
WP0201400084 approved 16-Dec-14. "
Please note that VDOT approval has not been obtained for the final site plan,they have one comment which
still needs to be addressed(see the 12-11-14 comment letter). Also, planning staff has a couple minor items
which need to be addressed prior to approval of the final site plan (see the 12-11-14 comment letter). Planning
staff understands that once the plats are approved and set to record in the clerk's office the official final site plan
will be submitted for review/approval.

Ok, thanks for the note.
To answer your question about what else is needed prior to the site plan being approved, see the following:
1) All onsite and off-site easement plats/deed of easements shall be signed and notarized by all owners
2) Once those documents are executed by the applicant, then the Subdivision Agent can approve the plats (once
submitted).
3) Then the approved plats and deed of easements need to be recorded in the clerks office.
4) Then the Site Plan needs to be revised to include all the Deed Book Page reference numbers of these newly
recorded easements.
(4a) The Site Plan should also be revised to address all remaining County and Agency comments which are
pending on the site plan (VDOT approval still pending minor change, and Planning approval pending
modifications of a couple notes on plan).Also the engineer needs to sign/seal all pages of the site plan.
5) Once all the above has been completed I believe we're a go for approval of the site plan.

Site Plan Review
SDP201400054—A portion of the site plan (pgs 5-11) were revised/submitted for staff to assure the plats match
the site plan. County staff has no objections to the revised site plan pages, they appear to match the plats.
Engineering offers the following comment on the site plan: "Prior engineering comments addressed.
WPO201400084 approved 16-Dec-14. "
Please note that VDOT approval has not been obtained for the final site plan, they have one comment which
still needs to be addressed (see the 12-11-14 comment letter). Also,planning staff has a couple minor items
which need to be addressed prior to approval of the final site plan(see the 12-11-14 comment letter). Planning
staff understands that once the plats are approved and set to record in the clerk's office the official final site plan
will be submitted for review/approval.
