meeting with the Planning Commission and another with the BOS. Those are the only three I was aware of when we last
met.
Elaine, do you recall the purpose of the meeting? You mentioned it was in response to the backlash from the firing range
project that is requiring additional meetings.

Yes, the fees can all be paid in one check. See below for a list of what is needed for submittal.
1) For the site plan you will need to submit the completed application (obtain application at the
link below), the application fee of$1500 shall be paid, and 16 copies of site plan shall be
provided.

2) For the Special Exception it is a $425 fee and you need to submit the request for the special
exception request of Section 4.10.3.1(b) and (c) please try and make the finding in item C (see
below for the section of the ordinance in red)
3) For the public notification fees, these fee are not required for submittal of the site plan. The
front desk won't take them with the application. Rather staff calculates these fees after the plan
has been deemed complete and review can commence. The fee must be paid prior to Site
Review Committee (SRC) meeting, staff will contact you once this fee has been calculated.
The fee is calculated through the formula provided below in blue.
4) If you are also planning on submitting the 20' landscape easement that we previously
discussed to be located on the adjoining neighbors property, then you will need to submit an
easement plat for County review/ approval. To obtain application see link below. The review
fee is $200. You'll also need to submit the plat and any deed work associated with it.

4.10.3.1 EXCEPTIONS--EXCLUDED FROM APPLICATION
The structures identified below shall be subject to height limitations as follows:
a. The height limitations of this chapter shall not apply to barns, silos, farm buildings,
agricultural museums designed to appear as traditional farm buildings, residential chimneys,
spires, flag poles, monuments, transmission towers and cables, smokestacks, water tanks, or
radio or television antennas or towers.
b. Any structure identified in subsection (a), other than one now or hereafter located on an
existing public utility easement, shall not: (1) be located closer in distance to any lot line than
the height of the structure; and (2) within a residential district, exceed one hundred (100) feet in
height, except for telecommunications facilities owned or operated in whole or in part by the
county, which shall not exceed one hundred fifteen (115) feet in height.
c. The commission may modify or waive either requirement of subsection (b) in an individual
case if it determines that the public health, safety or welfare would be equally or better served
by the modification or waiver. In granting such modification or waiver, the commission may
impose such conditions as it deems necessary to protect the public health, safety or welfare.
d. The board of supervisors shall consider a modification or waiver of this subsection only as
follows:
1. The denial of a modification or waiver, or the approval of a modification or waiver with
conditions objectionable to the developer may be appealed to the board of supervisors as an
appeal of a denial of the plat, as provided in section 14-226 of the Code, or the site plan, as
provided in sections 32.4.2.7 or 32.4.3.9, to which the modification or waiver pertains. A
modification or waiver considered by the commission in conjunction with an application for a
special use permit shall be subject to review by the board of supervisors.
2. In considering a modification or waiver, the board may grant or deny the modification or
waiver based upon the finding set forth in subsection (c), amend any condition imposed by the
commission, and impose any conditions it deems necessary for the reasons set forth in
subsection (c).

There would be significant challenges in moving the tank. It would have an impact on our grading plan and significantly
impact the fire departments parking lot. This would also likely require retaining walls.

Elaine,
I will be out of the office until at least Wednesday, July 9th and may not actually return until Monday, July 14th. Can you
meet this week or does that not provide you with enough time to discuss the items internally?
1. The 32.5 feet includes the room to the right-of-way. Specifically, here is the breakdown:
• 19.5 feet from the tank to the screening plant
• 5 feet from the screening plant to the sidewalk
• 5 feet of sidewalk
• 3 feet from the sidewalk to the property line (the tree was moved to the property line, which is also the
ROW)
• In addition, please note 3 feet from property line to the face of curb.
2. There is an email history regarding the 20' from the south property line with the County (see attached). Andrew
Boninti and Alan Franklin are aware of the setback issue. Andrew signed off on waiving the buffer requirement as
part of our contract with the County and their rezoning shows the location of the tank being close to that property
line.

Hi Jeremy,
You, Chris,and I probably need to talk again, but, I don't think it is necessary for Chip to come from VA Beach to talk
with us. A few things have come up since Chris and I began discussing the answers we need to provide you.
First, I realize that I need to be clear on what is being proposed along the street frontage as well as between the tank
and the adjoining residential lots to the south. I don't know what was finally decided on or what you are proposing.
Does the 30'from the property line include room for additional street r.o.w that includes street trees and a sidewalk, in
addition to buffering vegetation? This is what I thought had been worked out, but, I really don't know.
In addition, I don't know that you and I have ever really talked about the setback to the lots to the south. One of the
early drawings showed about 32' between the tank and the southern lot line, but,with only 20', I worry that the future
residents may feel like the tank is right in their back yard. Has this situation been discussed with Andrew Boninti?
I also just found out when telling David Benish about this project,that on July 2 the Board will be reviewing a new
development review schedule for public projects for compliance with the comprehensive plan. The review period is
much longer than what I provided to you today. I need to talk to David and Wayne about how this might affect your
review schedule.
Chris and I will be back with you later this week with answers about schedules and whether this will qualify as a major or
minor amendment. Please let me know what you can about the expected street frontage components and anything
more you can share about the setback to the residential units.

1. [Comment] The project requires a Comprehensive Plan Compliance review(CCP)by the Planning
Commission prior to final site plan approval.The revised Site Plan is anticipated to be used for this review
and taken to the Planning Commission as an exhibit. Prior to scheduling the CCP please revise the plan to
meet the following comments.

2. [32.5.2(a)]Setbacks. On the cover sheet of the plan assure that the setbacks for the water tank are listed as 1
to 1 based on the height of the tower.As proposed the site requires two special exceptions both to reduce the
required setbacks to property lines(rear and side). A request has been submitted and is being processed.
Prior to final site plan approval the special exceptions should be listed on the cover sheet of the site plan to
date.

please gray them out and subdue them,assure they are still legible. Also assure a note is provided on the
previously approved items which states: "Existing items previously approved on SDP1992-4 and

8. [32.5.2(a)] General Information. On sheet 1,under Existing Use, Water Storage Tank and Pump Station is
listed;however the Fire Station is also on the property. Add 'Fire Station' use to existing uses.

9. [32.5.2(01 General Information. On the plan provide the zoning districts and the uses of abutting properties.
Response: As requested the zoning districts and uses of properties abutting the site are listed on
sheets 3 and 4 as well as on sheet 5.
10. [32.5.2(a)] On the plan provide the parcel size(acreage).
Response: Parcel size for the existing property is 6.0 acres and has been shown on sheets 3 and 5.
11. [32.5.2(a)] Zoning.This property is zoned Neighborhood Model District (NMD). Also, the property is

13. [32.5.2(i)] Dimension all travelways being used by the proposed use and provide directional arrows to
signify traffic flow throughout the site.Also, on page 8 the proposed 20' ingress and egress easement is in
an area where the approved travelway was 24' wide. Is the travelway still 24' wide?
Response: The travelway widths and traffic flow arrows have been shown on sheet 5. ACSA's standard
ingress/egress easement requirement is a width of 20'. A travelway of 24' is available; however,the
ingress/egress casement has remained at 20'.
14. [32,5.2(b)]Provide the maximum amount of impervious cover proposed on the site.
Response: The existing impervious area is 88,701 SF.The proposed impervious will be an additional
4,201 SF for a total impervious area of 92,902 SF. The following information has been included on
sheet 5:

15. [32.5.2(b)] Provide the maximum acreage occupied by each use.
Response: The existing and proposed acreage of the site occupied by each use has been provided on

the site.
Response: As requested,the square footage for existing fire department building and the proposed
pump station,water tank and generator slab have been shown on sheet 5.
17. [32.6.2(h)] Signature panel. Provide a signature panel for all SRC reviewers to sign the site plan.
Response:A signature panel has been provided for all SRC reviewers as requested on Sheet 1.
18. [Comment] On the site plan provide the information as to whether the site is served by public water and
sewer.
Response: As requested. a note has been added to the site plan(sheet 5)that the site is not served by
public water or sewer.
19. [32.5.2(b)] Information regarding proposed use. Provide the maximum height of all proposed structures.
Response: The maximum heights of the proposed water tank and pump station have been provided
on sheet 5 as requested.
20. [32.5.2(a)] On sheet 1 under tax map parcel information assure all parcels involved in the proposal
are listed.
Response: Tax map parcel information for all parcels involved with the proposed project has been
listed on sheet 1.
21. [32.5.2(a), 32.5.2(d)] Provide the source of topography.
Response: As provided by note 1 on Sheet 2,topography was provided by Rinker Design Associates,
P.C.using conventional survey methods.
22. [32.5.2(b), 4.12.7]Parking. Provide information regarding parking for the proposed use, including how
much is required for the proposed use.If shared parking is to be utilized, a shared parking agreement shall be
furnished and an explanation as to how the two uses would overlap to accommodate the parking agreement.

23. [32.5.2(b)] Provide the maximum amount of impervious cover on the site.
Response: See response to number 14 above.
24. [32 5.2(d)] Show/label areas of the site with managed and/or preserved steep slopes.
Response: As requested,Areas of managed and/or steep slopes have been shown on sheets 5,7,8,9,
and 10. Refer to the legend on Sheet 2 to identify the symbology.
25. [32.5.2(n)] Label blank areas around the water tank with the intended ground cover/surface
treatment.
Response: Ground areas around the proposed water tank and pump station will have a grass cover.
Sheets 5 and 6 have been revised to clarify this requirement.
26. [32.5.2(j,k,l)] Verify that the location(s) of all existing or proposed utilities and utility easements including
water, sewer, drainage, telephone, cable, electric and gas are shown on the plan. Label any existing
easements with the Deed Book and Page Number.

29. [Comment] As proposed off-site easements are required, easement plats must be submitted,reviewed,
approved and recorded prior to Site Plan approval. Deed Book and Page reference information of each
recorded easement shall be listed on the site plan. Specifically for: "Proposed 20'Permanent
Easement", "Proposed Variable Width Permanent Easement", "Proposed 10' Tempora:y Easement",
and "Proposed 20'Landscaping Easement"on TMP 093A1-00-00-00400. Please submit easement
plat(s) to the County to facilitate these items. Also, for the landscape easement provide a maintenance

materials in order to satisfy the landscaping and screening requirements of section 32.7.9 subject to the
agent's approval. Specifically some of the existing trees within the proposed 20' landscaping easement
are between 20' -6U' tall and nave a mix of deciduous and evergreen trees present. Please verify die above
on the site plan on the existing conditions page and landscape plan. Upon verification, it may be
appropriate for the existing trees to be preserved as undisturbed buffer area, as mature trees will provide
superior screening of the tower from day one. If the existing mature trees within the 20' landscape
easement are determined by the Agent to be adequate to screen the facility the following shall be

conditions sheet and the landscaping plan Sheets 3 and 6.
The landscape plan should show the trees to be preserved, the limits of clearing, the location and type of

e Within the side yard,replace all the 'Nellie Stevens Holly' with evergreen trees, it may be appropriate
to continue utilizing 'Leyland cypress' in place of the 'Nellie Stevens Holly' or the applicant may
choose to utilize some other approved evergreen tree. Revise to assure double staggered row of
evergreen trees planted 15' on center. Also, assure that this planting strip is a minimum of 20'deep,
currently its only 14' deep. Also continue the planting strip another 25 feet to the other side of the
'Altitude and Pressure Sustaining Valve Vault Assembly' to completely screen the tower from the
road. Revise.
Response: The plan has a 20-foot wide planting strip along the property line. The landscaping
has been revised to provide two rows of Leyland Cypress at 15' on center. The rows of tress
have been extended as requested to provide further screening of the tank. No trees are planted
over the water main.
• Within the proposed 20' landscape easement, if the existing trees are determined not to be adequate or
the applicant is unable to preserve them and instead goes with new plantings assure the following is
met. Provide another row of evergreen tree in addition to the row depicted to meet the minimum
screening, it may be appropriate to continue utilizing 'Leyland cypress' in the second row or the
applicant may choose to utilize some other approved evergreen tree. Revise to assure double staggered
row of evergreen trees planted 15' on center.
Response: The landscape plan(sheet 6) has been revised describe the existing trees and provide a
tree save area to provide a natural buffer.
36. [32.6.2(j) & 32.7.9.4(b), 32.7.9.7(d)] Screening. The proposal includes a detention pond towards the
southernmost boundary of the property. This feature is required to be screened from residentially zoned
parcels per 32.7.9(a)3. Also, with the proposal, clearing is taking place to the property line adjaeent LO
residentially zoned land, this clearing causes the parking lot to be visible from the residentially zoned land.
For both of these items provide screening which meets the requirements of32.7.9.7.
Response: As discussed with Mr.Perez,the alignment of the water main on sheet 10 has been
revised to provide a natural wooded buffer to screen the biodetention facility.
37. [32.5.2(n),32.6.2(k)& 4.17] Lighting. Is any outdoor lighting proposed with the site plan?If so, all

materials in order to satisfy the landscaping and screening requirements of section 32.7.9 subject to the
agent's approval. Specifically some of the existing trees within the proposed 20' landscaping easement
are between 20' -80' tall and have a mix of deciduous and evergreen trees present. Please verify the above
on the site plan on the existing conditions page and landscape plan. Upon verification, it may be
appropriate for the existing trees to be preserved as undisturbed buffer area, as mature trees will provide
superior screening of the tower from day one. If the existing mature trees within the 20' landscape

Response: The plan has a 20-foot wide planting strip along the property line. The landscaping has
been revised to provide two rows of Leyland Cypress at 15' on center. The rows of tress have been
extended as requested to provide further screening of the tank. No trees are planted over the water
main.
Rev 1. Comment addressed, staff can approve the Leyland Cypress plantings as depicted;however,per
discussions with Elaine Echols and Ellie Ray(Landscape Architect)they recommend that the double
staggered row of Leyland Cypress be replaced with a mix of(Pinus Strobus Eastern White Pine)and
(Cryptomeria japonica &cvs), at a min of 4 foot tall at time of planting. This is being recommended as
Leyland's are known to fall down due to wind and are known to sustain substantial damage due to ice.Also
the mix of the two evergreen tree types is being recommended to aid in the appearance of a more natural
look. Staff expects that the suggested plantings are expected to be looked upon more favorably by the BOS
during consideration of the special exception than the Leyland Cypress. Please advise staff how you wish to

longer provide the screening intended by this condition as determined by the Director of
Community Development, the Authority shall promptly submit a landscape plan that complies
with Albemarle County Code§ 18-32.7.9 and which will provide screening as provided by
Albemarle County Code § 18-32.7.9.7;
C. After the landscape plan is approved by the County, the Authority shall install and
thereafter maintain any landscaping shown on the approved landscape plan;
D. The Zoning Administrator may allow minor variations in the location of the
Landscaping Easement provided that the screening purpose of the Landscaping
Easement is satisfied; and
E. The deed of easement and easement plat for the Landscaping Easement shall be subject to
review and approval by the County before they are recorded in the Clerk's Office of the
Circuit Court of Albemarle County,Virginia.
2. If the Authority does not obtain the Landscaping Easement as provided in Condition 1, it shall:
A. Submit a landscape plat that complies with Albemarle County Code§ 18-32.7.9 and which will

Bollards at the corners of the vault are considered a fixed object hazard since they are within the clear zone
of the roadway.We are not as concerned with the vault causing the hazard.We are more concerned with the
vault becoming damaged or VDOT equipment becoming damaged during mowing or snow removal
operations.
