Khan Building Height
Dear Mr. Carter,
At their special meeting on July 14, 2015, the Board of Zoning Appeals voted 4-0 to affirm the
Zoning Administrator's determination. This determination finds that the building height for the
accessory structure under construction on Tax Map 61Z Section 1 Parcel 4 is measured from
the post-construction or finished grade.
If you are aggrieved by this decision, you have the right to appeal it within thirty (30) days of the
date of the decision, in accordance with Section 15.2-2314 of the Code of Virginia. If you do not
file a timely appeal, this decision shall be final and unappealable. An appeal shall be taken only
by filing a petition specifying the grounds on which aggrieved with the Circuit Court of Albemarle
County within the prescribed thirty (30) days.

Dear Gentlemen:
This letter is to inform you that the Albemarle County Board of Zoning Appeals will
hear the appeal request, AP2015-001, at a public hearing on Tuesday, July 14,
2015, at 2:00 p.m. This meeting will be held in Lane Auditorium, Second Floor,
County Office Building, 401 McIntire Road, Charlottesville, Virginia.
The application is as follows:
Lloyd F. Wood, Peter and Margaret Briggs, Mae McGrory and Richard Stewart
appeal the Zoning Administrator's determination of building height for a structure
under construction at 844 Chapel Hill Road on property owned by Muhammad
Khan. The appellants claim it is an incorrect determination of height as measured
from the new grade (at 9 rows of cinderblock above the foundation) rather than
from the existing grade. Tax map 061Z0-01-00-00400 is zoned Residential 1 and is
located off the west side of Rio Rd East, about 500 feet from the intersection of
Chapel Hill and Rio Roads.
