Subject: Mountaintop Montessori School Pre-application Meeting, 1/27/2014
The following are County staff comments regarding the above noted pre-application meeting.This
meeting satisfies the requirement for a pre-application meeting prior to submittal of your special use
permit application.The purpose of the meeting is summarized below:
The purposes for a pre-application meeting are to: (i)provide the applicant and the county a
common understanding of the proposed project; (ii)inform the applicant about the proposed
project's consistency with the comprehensive plan, other relevant policies, and county
regulations; NO broadly identify the planning, zoning and other issues raised by the application
that need to be addressed by the applicant;(iv)inform the applicant about the applicable
procedure;and(v)allow the director to identify the information the applicant must submit with the
application, including the supplemental information delineated in subsection (c). Receiving the
relevant supplemental information will allow the application to be comprehensively and efficiently
reviewed.
The following are staff comments:
(ii) Consistency with the Comprehensive Plan:
• The Comprehensive Plan currently designates this area as urban density, which allows
residential (6.01-34 units/acre); and supporting uses such as religious institutions, schools,
commercial, office, and service uses.
• The proposal consists of a school that is consistent with the land use recommendations of the
Comprehensive Plan.This is an existing school with an approved Special Use Permit(SP)and
site plan. The layout of the site is proposed to change and as a result the special use permit
conditions will also need to change.
• The proposed changes specifically relate to the re-location of the playground area and the need
to eliminate the surrounding fence, which was described in the SP condition and referenced in a
note on the SP plan.
(iii)broadly identify the planning, zoning and other issues raised by the application that need to be
addressed by the applicant
• Due to the nature of this request, (minor changes to an approved special use permit conceptual
plan and conditions)as previously mentioned above, this pre-application meeting qualifies as the
mandatory pre-application meeting.

(iv) applicable procedures
• Special Use Permit application submittal with associated project narrative and conceptual plan as
described in the"Special Use Permit Checklist" (provided to you along with these comments).
• Community Meeting—the applicant is required by ordinance to undertake a community meeting
process as part of the review of the special use permit request. The purpose of the community
meeting is to inform the surrounding community of the proposal, to answer questions about the
project and to hear initial comments from residents about the project. Planning staff is not
recommending a community meeting at this time, since the requested changes are relatively
minor in nature and does not change the original intent of the special use permit.
• ARB review- In addition to the above application, Architectural Review Board issues were
discussed at the meeting. Provided below is a summary of what was covered by Margaret
Maliszewski. This is for informational purposes only, and other comments or requirements may
be provided during ARB review.
o Eliminating the fence from the proposal is not expected to have a negative impact on the
Entrance Corridor. For more information on the ARB, please contact Margaret

(v) Identify the information the applicant must submit with the application, including the supplemental
information
• A conceptual plan and narrative of the request(see attached checklist).
• The approved special use permit conditions will need to be updated.At a minimum Conditions 2
and 3 will need updating.
• See attached pre-application checklist for other required information. This checklist will need to
be filled in, signed and submitted with the SP application.

Hi Ron and Greg,
Greg- I hope the following will bring you up to speed on this SP request:the subject applicant is requesting revisions to
the SP conditions regarding fencing at the school because they will need a CO in August in order to begin using the
classroom buildings that are currently under construction.This SP request is to eliminate conditions 3 and 4(shown
below) because the fence is no longer needed.The children play area is now in a different location; no longer needing
the fence and the chain link fence is no longer in place.As you can see, if these two conditions remain,the applicant will
be in violation of the SP conditions come August when school needs to be open. I eliminated Condition 5 because that
has already occurred.The applicant also has an SP request under review to revise the layout of the site, but they had to
update the conditions asap, in order to deal with their deadline for school opening in August.
Please review and provide any comments for the following proposed conditions with SP2014-00002.This is tentatively
scheduled to go the PC on June 16. I appreciate your comments by May 26th:
1. Maximum enrollment shall be three hundred (300) students;
2. Development of the use shall be in conformity with the "Montessori Pantops Mountain Community
School Sheets SP01-SP-03", prepared by Neal R. Deputy, Architecture & Master Planning, last revised
January 16, 2007, as determined by the Director of Planning and the Zoning Administrator. To be in
conformity with the plan, development shall reflect the general size, arrangement, and location of
proposed Buildings A, B, C, D, and E, Central Lawn, Amphitheatre, playgrounds and ball fields, wooded
natural area, and parking areas. Minor modifications to the plan which do not conflict with the
elements above may be made to ensure compliance with the Zoning Ordinance;

concerns,the fence details shall include:
• At least forty eight(48) inches tall;
• No more than a two (2) inch gap under the fence;
• Openings shall be small enough that a four(4) inch sphere will not pass through;
• No ornamental indentations that can be used as a ladder;
• Maximum mesh size for chain link fences is two and one quarter(2 1/4) inches; and

Dear Mr. Ryang:
Staff has reviewed your re-submittal request for an amendment to the special use permit conditions
that were approved on March 11, 2009 for SP200900001.
The following divisions have no objection to this special use permit proposal:
Planning, Zoning and VDOT.
Architectural Review Board
The following comments related to ARB issues have been provided by Margaret Maliszewski:
1. The removal of fences from any phase of the proposed development is not expected to
have an impact on the Entrance Corridor.The design of any new fence proposed in the
future that is visible from the Entrance Corridor requires the review and approval of the
Architectural Review Board. No chain link fence shall be visible from the Entrance Corridor.
SP Conditions
The following SP Conditions were approved with SP 09-01:
• 1. Maximum enrollment shall be three hundred (300) students;
2. Development of the use shall be in conformity with the "Montessori Pantops Mountain
Community School Sheets SP01-SP-03", prepared by Neal R. Deputy, Architecture & Master
Planning, last revised January 16, 2007, as determined by the Director of Planning and the
Zoning Administrator.To be in conformity with the plan, development shall reflect the
general size, arrangement, and location of proposed Buildings A, B, C, D, and E, Central
Lawn, Amphitheatre, playgrounds and ball fields, wooded natural area, and parking
areas. Minor modifications to the plan which do not conflict with the elements above may
be made to ensure compliance with the Zoning Ordinance;
3. Fencing shall be provided at a minimum around the perimeter of the Central Lawn, Lower
Elementary Playground, and Children's House Playground, or at other locations as required

by the County to en" "e safety of children adjacent to Route'Vitt and Rolkin Road. Final
design of the fence shall be subject to review and approval by the Architectural Review
Board. However,to address safety concerns,the fence details shall include:
• At least forty-eight (48) inches tall;
• No more than a two (2) inch gap under the fence;
• Openings shall be small enough that a four (4) inch sphere will not pass through;
• No ornamental indentations that can be used as a ladder;
• Maximum mesh size for chain link fences is two and one-quarter (2-1/4) inches; and
• Maximum mesh size for diagonal lattice fences is one and three-quarter (1-3/4)
inches.
4. The existing chain link fence shall be replaced with a new fence that satisfies the
requirements of the Architectural Review Board by September 1, 2009. Alternatively,
planting shall be installed by September 1, 2009 that will screen the fence from the
Entrance Corridor.That planting shall be in accord with an approved landscape plan that
satisfies the requirements of the Architectural Review Board; and
5. Construction of proposed buildings as shown on the concept plan shall commence on or
before March 11, 2015 or this special use permit shall expire.
The following Conditions are proposed with SP2014-00002:
1. Maximum enrollment shall be three hundred (300) students;
2. Development of the use shall be in conformity with the "Montessori Pantops Mountain
Community School Sheets SP01-SP-03", prepared by Neal R. Deputy, Architecture & Master
Planning, last revised January 16, 2007, as determined by the Director of Planning and the

The County attorney and Zoning are also reviewing the proposed SP conditions. We will let you
know if there are any substantive revisions needed to the proposed conditions prior to the
Planning Commission public hearing. You are scheduled to meet with the Pantops Community
Advisory Committee on June 22 to discuss both SP2015-00011 and SP2014-00002.
In general, primarily all of the staff comments have been addressed. A public hearing with the
Planning Commission is tentatively scheduled for June 16, 2015.
Our records show that all public hearing fees have been paid. Additional notification fees will not
be required unless a deferral takes place and adjoining owners need to be notified of a new date.

The Albemarle County Planning Commission, at its meeting on June 16, 2015, by a vote of 6:0
recommended approval of the above-noted petition to the Board of Supervisors.
Please note that this recommendation is subject to the following conditions:
1. Maximum enrollment shall be three hundred (300) students;
2. Development of the use shall be in general accord with the Montessori Pantops Mountain Community
School Sheets SP01-SP-03", prepared by Neal R. Deputy, Architecture & Master Planning, last
revised January 16, 2007, as determined by the Director of Planning and the Zoning Administrator. To
be in general accord with the plan, development shall reflect the general size, arrangement, and
location of proposed Buildings A, B, C, D, and E, Central Lawn, Amphitheatre, playgrounds and ball
fields, wooded natural area, and parking areas. Minor modifications to the plan which do not conflict
with the elements above may be made to ensure compliance with the Zoning Ordinance;

Within 30 days of the date of this letter, please do one of the following:
