Virginia State Code requires that notice for public hearings be made by publishing a legal advertisement in the newspaper and by mailing letters to adjacent property owners. Therefore,at least two fees for public notice are required before a Special Use Permit may be heard by the Board of Supervisors. Applications reviewed by the Board of Zoning Appeals,however,only require one public hearing and therefore require just one fee for public notice. The total fee for public notice will be provided to the applicant after the final cost is determined and must be paid before the application is heard by a public body. Staff estimates the total cost of legal advertisement and adjacent owner notification to be between$350 and$450 per hearing. As you will note, the application is to request approval for an offsite temporary construction sign to be erected on TMP 61A-1-8. This sign is to identify the construction occurring at the end of Pen Park Lane for the Lochlyn Hill Neighborhood. The reasons for this request are as follows: - Lochlyn Hill Neighborhood is a 200 unit multiphase residential development at the end of Pen Park Lane. Phase 1 is zoned R-4 and currently being developed By-Right. - Rio Road is the nearest cross street and carries approximately 20,000 VPD. All traffic to the neighborhood will be carried on this road. - Lochlyn Hill Neighborhood is approximately 300 ft from the intersection of Rio Road and Pen Park Lane, at an elevation approximately 30 ft lower than the intersection, and existing vegetation impacts the line of site. Photo exhibits have been provided to show the view of the property at 50 ft intervals heading West along Pen Park Lane toward Rio Road. The 'end of state maintenance' sign denotes the front edge of the Lochlyn Hill property and you will note that it is not visible at 200', 250' and at the intersection. It is imperative for the safety of the existing residents on Pen Park Lane and in the adjacent Rio Heights Neighborhood, as well as the 20,000 VPD travelers on Rio Road that Lochlyn Hill is clearly identified on the Rio Road. Until the construction trades working at the site for land development and residential home construction are familiarized with the location, a temporary construction sign is necessary. We are proposing a sign that is typical to most new residential neighborhoods and have provided a photo of the Stonewater sign that is currently erected at the Rio and Pen Park Lane intersection, on the West side. The Lochlyn Hill temp construction sign will be an A- Frame sign to identify the location of Lochlyn Hill from both the north and southbound traffic on Rio Road.
